This appeal is by the insurance company “cia’lli’ng’.jn<\/p>\n
question the order of the Commissioner .ayva:rding <\/p>\n
compensation to the respondenbelraimantiiHaindf’the.i_i_main it<\/p>\n
rievance of the insurance icomhiian  .. thatiikthe<\/p>\n
Commissioner for Workmen’iCompensation_ erre’cl:”in..taking<\/p>\n
disability percentage at_65%.\n<\/p>\n
2. Learned     \ufb02appellant Sri.
\nS.Shrishaila,   of accident and
\nthe emplo3:”er–e,.tnp’io$*Ce  aspect, argued that the
\nonly  Commissioner is that disability
\npercentage  though Doctor had put it at<\/p>\n
50% and  from this,..i~’the claimant had obtained driving<\/p>\n
 p_ 1ice’ri’ce:’for heayy”tra_n.sport vehicle on 23\/ 08\/2003 and this<\/p>\n
‘itself showfs_d”th_at the claimant had no such disability.<\/p>\n
‘l’he’refore,i–u.”gjthAevicommissioner could not have taken the<\/p>\n
‘V disability 65% andmawarded a sum of Rs.2,49,8’77\/–.<\/p>\n
i:=.,Ti1erefore, the quantum of compensation is on the higher<\/p>\n
  and hence the appeal be allowed.\n<\/p>\n

3. On the other hand, learned counsel for the<\/p>\n
respondent–claimant submitted that no such contentionliwas<\/p>\n
put forward by the appellant–insurance company   <\/p>\n
Commissioner and it is not now open to theiiappeilant  putt’ it<\/p>\n
forward such a contention in ‘-this”‘naippeal;’~  <\/p>\n
submission made is that  the-diaimanti put his!’<\/p>\n
income at Rs.4,000\/~ per month-with Rsi[50.]fv-V. asvfbata as a
\ndriver, yet the Comn:.i.s:s,ionier ;_hadV._’,’tval{en the income at<\/p>\n
Rs.3,000\/– per month.   ‘V<\/p>\n
4.   “the”ii,_abov.e’ submission so far as
\nthe  “conicerned, no doubt, the
\nComrriissioner same at 65% and in the
\nprocess has_gobsie1’V.ed,_v the claimant has got very deep<\/p>\n
concealed fracture__in,the pelvic region, number of pieces<\/p>\n
\u00abmere  the pelvic region and the claimant suffered<\/p>\n
ii’fro1r1,*comip”1″esai’ire myloneuropathy of the lumber spinal cord<\/p>\n
ancl’ therefore, the Commissioner took the percentage of<\/p>\n
 at 65%. No doubt the learned counsel for the<\/p>\n
i  appellant submitted that the claimant obtained licence to<\/p>\n
  “drive HTC on 23\/08\/2003, but on going through the order of<\/p>\n
>3<\/p>\n
the Commissioner as well as the order sheet maintained by<\/p>\n
the Commissioner, it becomes clear that no such<\/p>\n
as is now canvassed before this Court was put  <\/p>\n
the insurance company before _the_ Coimmissioneril  it<\/p>\n
therefore, see no case being made, o1;jt”b\ufb02r the “arppellaiatl’for<\/p>\n
this Court to interfere with ethe.._Vorder=.of the l’Com1nissiioner.’t. ‘<\/p>\n
Moreover, no substantial question  law also appears to
\narise in this case.\n<\/p>\n
5. For-the ab\ufb01ovej reasons\ufb01he appeal is dismissed.
\nHowever, onlyl” rate”of.i;1terest is concerned, it
\nis to be y’1’1″lOC_lifl’L:”?Cl  =.7%%=. frorriwthle date of the claim<\/p>\n
application till theijdaiteof order of the Commissioner and<\/p>\n
thereafterwardsiiat il*2F’_\/ciittilillpi\u00e9lyment is made. Except to the<\/p>\n
 above \u00abaspect of irriodvification of the rate of interest, the<\/p>\n
l’eappe’al   in other respects. Amount in deposit be<\/p>\n
