SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/03\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Present<br \/>\n\tJudge&#8217;s Summons has been taken out by the applicant claiming the<br \/>\n\tamount on the basis of the order passed by the Labour Court in<br \/>\n\tRecovery Application No.274 of 2009, as an employee \/ worker of M\/s.<br \/>\n\tPioneer Equipments Pvt. Ltd. (in liquidation).\n<\/p>\n<p>It<br \/>\n\tis the specific case on behalf of the applicant that he was the<br \/>\n\temployee of M\/s. Pioneer Equipments Pvt. Ltd. (in liquidation).<br \/>\n\tHowever, when the recovery application was submitted, it was against<br \/>\n\tPioneer Foundry and therefore, the applicant submitted an<br \/>\n\tapplication for amendment \/ review application which was granted and<br \/>\n\tin place of    M\/s. Pioneer Foundry in the recovery certificate \/ in<br \/>\n\tthe order passed by the Labour Court, it is directed to be mentioned<br \/>\n\tas M\/s. Pioneer Equipments Pvt. Ltd. It is the case on behalf of the<br \/>\n\tapplicant that despite the same, the claim of the petitioner arising<br \/>\n\tout of the order passed by the Labour Court passed in aforesaid<br \/>\n\trecovery application is not considered by the Official Liquidator.\n<\/p>\n<p>On<br \/>\n\tthe other hand, it is the case on behalf of the Official Liquidator<br \/>\n\tthat as such, there is nothing on record that applicant was the<br \/>\n\temployee \/ worker of M\/s. Pioneer Equipments Pvt. Ltd. as the name<br \/>\n\tof the applicant does not figure in the list submitted by the Union.<br \/>\n\tIt is further submitted that even the order passed in review<br \/>\n\tapplication is nullity as there was no permission to join the<br \/>\n\tOfficial Liquidator as party to the said review application \/<br \/>\n\trecovery application submitted by the petitioner as required under<br \/>\n\tSection 446 of the Companies Act. Therefore, as such, Official<br \/>\n\tLiquidator is denying that the applicant was the employee of M\/s.<br \/>\n\tPioneer Equipments Pvt. Ltd.\n<\/p>\n<p>Petitioner,<br \/>\n\tparty-in-person, has submitted that he has got ample documentary<br \/>\n\tevidences to suggest that he was the employee of erstwhile M\/s.<br \/>\n\tPioneer Equipments Pvt. Ltd. and he can satisfy the Official<br \/>\n\tLiquidator.\n<\/p>\n<p>In<br \/>\n\tview of the above, let the applicant approach by way of an<br \/>\n\tapplication to Office of the Official Liquidator along with<br \/>\n\tsupporting documentary evidence to suggest \/ show that applicant was<br \/>\n\tan employee of erstwhile M\/s. Pioneer Equipments Pvt. Ltd. within a<br \/>\n\tperiod of 4 (four) weeks from today and on receipt of such<br \/>\n\tapplication, along with the documentary evidence, if any, Official<br \/>\n\tLiquidator is directed to consider the claim of the applicant and<br \/>\n\tthe status of the applicant and find out whether in-fact applicant<br \/>\n\twas the employee of erstwhile M\/s. Pioneer Equipments Pvt. Ltd.(now<br \/>\n\tin liquidation) or not and the said exercise is to be completed<br \/>\n\twithin a period of 6 (six) weeks from the date of receipt of the<br \/>\n\tapplication along with supporting documentary evidence, if any, and<br \/>\n\tcommunicate the outcome of the same to the applicant immediately. If<br \/>\n\tit is found that applicant was the employee of M\/s. Pioneer<br \/>\n\tEquipments Pvt. Ltd., in that case, the claim of the applicant be<br \/>\n\tconsidered along with other employees \/ workers of the M\/s. Pioneer<br \/>\n\tEquipments Pvt. Ltd. in accordance with law and on merits.
