Justice K.HEMA\n\n Dated :16\/09\/2008\n\n O R D E R\n                            K.HEMA, J.\n                   ------------------------------\n                      B.A. No.5845 OF 2008\n                   ------------------------------\n           Dated this the 16th day of September, 2008\n\n\n                              O R D E R\n<\/pre>\n<p>     This petition is for bail.\n<\/p>\n<p>     2. The alleged offence is under Section 8(2) of Abkari Act.<\/p>\n<p>The petitioner was arrested on 27.08.2008 when he along with<\/p>\n<p>another person was found in possession of 10 litres of arrack.<\/p>\n<p>     3. The petitioner is in custody from 27.08.2008 onwards.<\/p>\n<p>Learned Public Prosecutor submitted that he has no objection in<\/p>\n<p>granting bail to the petitioner on conditions.<\/p>\n<p>     Hence, bail is granted to the petitioner on the following<\/p>\n<p>terms and conditions:\n<\/p>\n<blockquote><p>       (i) The     petitioner  shall  execute   a  bond   for<\/p>\n<p>            Rs.25,000\/- with two solvent sureties each for<\/p>\n<p>            like sum to the satisfaction of the Magistrate<\/p>\n<p>            court concerned.\n<\/p><\/blockquote>\n<blockquote><p>       (ii) The    petitioner   shall   report   before  the<\/p>\n<p>            Investigating Officer on every Monday and<\/p>\n<p>            Thursday between 10 a.m. and 1 p.m. until<\/p>\n<p>            further orders.\n<\/p><\/blockquote>\n<p>B.A.5845 of 2008<br \/>\n<span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>         (iii) The petitioner shall not commit any offence<\/p>\n<p>               while on bail and in case of breach of this<\/p>\n<p>               condition, bail is liable to be cancelled.<\/p>\n<p>      The petition is allowed.\n<\/p>\n<\/p>\n<p>                               K.HEMA, JUDGE<\/p>\n<p>pac<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Rajappan vs State Of Kerala on 16 September, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 5845 of 2008() 1.
