Justice K.HEMA\n\n Dated :28\/01\/2011\n\n O R D E R\n                           K.HEMA, J.\n          -----------------------------------------------\n              Criminal Appeal No.116 of 2011\n          -----------------------------------------------\n                  Dated 28th January, 2011.\n\n                        J U D G M E N T\n<\/pre>\n<p>           This appeal is filed against an order of acquittal.<\/p>\n<p>           2.   The appellant is the complainant.      He filed a<\/p>\n<p>complaint before the Magistrate Court, alleging offence under<\/p>\n<p>Section 138 of the Negotiable Instruments Act against first<\/p>\n<p>respondent herein. According to appellant, the accused issued<\/p>\n<p>a cheque drawn on an account maintained by him with the<\/p>\n<p>Bank at Mangalore for Rs.62,000\/- for discharge of a debt in<\/p>\n<p>favour of appellant. The cheque, on presentation was returned<\/p>\n<p>unpaid on the ground &#8220;funds insufficient&#8221;. Thereafter, a lawyer<\/p>\n<p>notice was issued demanding payment, but no payment was<\/p>\n<p>made. Hence, the complaint was filed.\n<\/p>\n<p>           3.    To prove the prosecution case, PW1 was<\/p>\n<p>examined and Exts.P1 to P6 were marked. The accused denied<\/p>\n<p>all the allegations and contended that she had no transaction<\/p>\n<p>with the complainant. She is a total stranger to the<\/p>\n<p>complainant. Ext.P1 is not supported by consideration. She<\/p>\n<p>had borrowed a sum of Rs.10,000\/- from one Shetty and 3<\/p>\n<p>signed blank cheques were handed over to him. Out of those<\/p>\n<p><span class=\"hidden_text\">Crl.Appeal No.116\/11                    2<\/span><\/p>\n<p>cheques, one was misused by the complainant to file a false<\/p>\n<p>complaint against her.\n<\/p>\n<p>             4. The trial court convicted the accused, but the<\/p>\n<p>appellate court acquitted him on the ground that the trial court<\/p>\n<p>had no jurisdiction to enter a finding of guilt against accused. It<\/p>\n<p>was held by the appellate court in paragraph 12 as follows :<\/p>\n<blockquote><p>               &#8220;12. Here, it is pertinent to note that the complainant has<\/p>\n<p>               not adduced any evidence to show that he was residing at<\/p>\n<p>               his address given in the complaint and that he was<\/p>\n<p>               conducting any business at Kasaragod.         From the oral<\/p>\n<p>               testimony of PW1 itself, it is brought out that the alleged<\/p>\n<p>               transaction, ie., issue of cheque, presentation of the cheque<\/p>\n<p>               for collection, dishonour etc. are all done at Mangalore.<\/p>\n<p>               Further, it is brought out that the complainant has his<\/p>\n<p>               permanent residence at Mangalore and he was doing<\/p>\n<p>               business there.&#8221;<\/p><\/blockquote>\n<p>             5. I have gone through the evidence of PW1 and I<\/p>\n<p>am satisfied of the findings entered into by the trial court,<\/p>\n<p>which are extracted above. It is clear that the appellant is a<\/p>\n<p>permanent resident of Mangalore. All other transactions, such<\/p>\n<p>as issuance of cheque, presentation, dishonour etc. are all at<\/p>\n<p><span class=\"hidden_text\">Crl.Appeal No.116\/11               3<\/span><\/p>\n<p>Mangalore. The accused is also a resident of Mangalore, but<\/p>\n<p>complaint is filed at Kasaragode, the motive of which must be<\/p>\n<p>known to the appellant himself. The trial court has also relied<\/p>\n<p>upon two decisions in paragraph 13 and found that the trial<\/p>\n<p>court had no jurisdiction to entertain the complaint. I do not<\/p>\n<p>find any reason to interfere with those findings.<\/p>\n<p>             6. Learned counsel for petitioner argued that the<\/p>\n<p>address of the complainant in the complaint is that of<\/p>\n<p>Kasaragod. He has stated that he is residing in Kasaragode etc.<\/p>\n<p>But, from the evidence, it is quite clear that ration card and<\/p>\n<p>voters list etc. all referred to his residential address and the<\/p>\n<p>business address at Mangalore.
