In pursuance to the said order, the detenu has been<br \/>\ndetained in Nadiad Jail.\n<\/p>\n<p>2.\t\tHeard<br \/>\nthe learned advocate for the detenu and learned AGP Ms T.K. Patel for<br \/>\nthe respondents. No affidavit in reply is filed by the respondents<br \/>\ncontroverting the averments made on behalf of the detenu.\n<\/p>\n<p>3.\t\tThe<br \/>\ndetenu came to be detained as  Bootlegger  in connection with one<br \/>\noffence being CR No.182 of 2008 registered with Gandhigram  Police<br \/>\nStation, Rajkot City for the offences punishable under the provisions<br \/>\nof the Bombay Prohibition Act.\n<\/p>\n<p>4.\t\tThe<br \/>\nlearned advocate for the detenu has submitted that it is a settled<br \/>\nlegal position that on registration of single solitary offence, no<br \/>\norder of detention could have been passed branding the detenu as a<br \/>\n Bootlegger . He has further submitted that the activities of the<br \/>\ndetenu cannot be said to be injurious to the  public health  or<br \/>\n public order .  Further is submitted by the learned advocate<br \/>\nthat there is gross delay in passing the order of detention and there<br \/>\nis gross delay in executing the order.\n<\/p>\n<p>5.\t\tI<br \/>\nhave gone through the grounds of detention and considered the<br \/>\narguments advanced by the learned advocate for the detenu as well as<br \/>\nthe learned AGP. In the opinion of this Court, there is much<br \/>\nsubstance in the arguments advanced by the learned advocate for the<br \/>\ndetenu. It is seen from the grounds that a general statement has been<br \/>\nmade by the detaining authority that consuming liquor is injurious to<br \/>\nhealth. In fact, a perusal of the order passed by the detaining<br \/>\nauthority shows that the grounds which are mentioned in the order are<br \/>\nin reference to the situation of  Law and order  and not  Public<br \/>\norder . Therefore, on this ground, the subjective satisfaction<br \/>\narrived at by the detaining authority is vitiated on account of<br \/>\nnon-application of mind and therefore, the impugned order is required<br \/>\nto be quashed and set aside.\n<\/p>\n<p>6.\t\tExcept<br \/>\ngeneral statements of some witnesses, there is no material on record<br \/>\nwhich shows that the detenu is carrying out illegal activities which<br \/>\nis harmful to the health of the public. In the case of  ASHOKBHAI<br \/>\nJIVRAJ @ <a href=\"\/doc\/687998\/\">JIVABHAI SOLANKI vs. POLICE COMMISSIONER, SURAT,<\/a> reported in<br \/>\n2001(1) GLH 393, having considered the decision of the<br \/>\nHon&#8217;ble Apex Court in the case of  RAM MANOHAR LOHIA vs. STATE<br \/>\nOF BIHAR, reported in AIR 1966 SC 740, this Court has held<br \/>\nthat the cases wherein the detention orders are passed on the basis<br \/>\nof the statements of such witness falls under the maintenance of  law<br \/>\nand order  and not &#8216;Public order&#8217;.\n<\/p>\n<p>7.\t\tApplying<br \/>\nthe ration of the above decisions, it is clear that before passing an<br \/>\norder of detention, the detaining authority must come to a definite<br \/>\nfinding that there is threat to the &#8216;public order&#8217; and it is very<br \/>\nclear that the present case would not fall within the category of<br \/>\nthreat to &#8216;public order&#8217;. In that view of the matter, when the order<br \/>\nof detention has been passed by the detaining authority without<br \/>\nhaving adequate grounds for passing the said order, it cannot be<br \/>\nsustained and, therefore, it deserves to be quashed and set aside.\n<\/p>\n<p>8.\t\tIn<br \/>\nthe result, this Special Civil Application is allowed. The impugned<br \/>\norder of detention dated 18.12.2008 passed by the detaining<br \/>\nauthority, i.e. respondent No.2- Police Commissioner, Rajkot City is<br \/>\nhereby quashed and set aside. The detenu is ordered to be set at<br \/>\nliberty forthwith, if his presence is not required in any other case.<br \/>\nRule is made absolute accordingly.
