Justice M.SASIDHARAN NAMBIAR\n\n Dated :24\/09\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.2699 of 2009\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner is the wife of deceased Rajendran,<\/p>\n<p>Secretary  of   Karichal  Handloom   Society   Ltd.<\/p>\n<p>No.3414.   First   respondent   filed    Annexure-A<\/p>\n<p>complaint alleging that Karichal Handloom Society,<\/p>\n<p>through the Secretary and President, for and on<\/p>\n<p>behalf  of  the  Society   as  well  as  in   their<\/p>\n<p>individual capacity, issued the dishonoured cheque<\/p>\n<p>and failed to pay the same on demand in writing and<\/p>\n<p>thereby committed the offence under Section 138 of<\/p>\n<p>Negotiable Instruments Act. Judicial First Class<\/p>\n<p>Magistrate-VI, Neyyattinkara took cognizance of the<\/p>\n<p>offence    as    C.C.No.1192\/2007.    Subsequently,<\/p>\n<p>Rajendran,  Secretary  of  the  Society,  shown  as<\/p>\n<p>representing the Society, the first accused, died.<\/p>\n<p>First respondent filed a petition to implead his<\/p>\n<p>widow as an additional accused. Learned Magistrate<\/p>\n<p>issued summons to her. This petition is filed under<\/p>\n<p><span class=\"hidden_text\">CRMC 2699\/09              2<\/span><\/p>\n<p>Section 482 of Code of Criminal Procedure by his<\/p>\n<p>widow to quash the proceedings in C.C.No.1192\/2007<\/p>\n<p>as against her.\n<\/p>\n<p>    2. Case of the petitioner is that as she is not<\/p>\n<p>a signatory to the cheque, she cannot be impleaded<\/p>\n<p>as an accused in the case especially when, no<\/p>\n<p>notice was sent to her, as provided under Section<\/p>\n<p>138(b) of Negotiable Instruments Act.<\/p>\n<p>    3. Learned counsel appearing for the first<\/p>\n<p>respondent submitted that summons was issued to the<\/p>\n<p>petitioner in an application filed by the first<\/p>\n<p>respondent for impleading, as she was subsequently<\/p>\n<p>appointed the Secretary of the Society, on the<\/p>\n<p>death   of   the  original Secretary,  her  husband<\/p>\n<p>Rajendran and Learned Magistrate issued summons to<\/p>\n<p>the petitioner in that petition alone and not as an<\/p>\n<p>accused.\n<\/p>\n<p>    4. If the Secretary, who was representing the<\/p>\n<p>original    accused,  is  no more,   the  successor<\/p>\n<p>Secretary could, definitely, be impleaded in the<\/p>\n<p><span class=\"hidden_text\">CRMC 2699\/09               3<\/span><\/p>\n<p>proceedings. But, if petitioner is to be impleaded<\/p>\n<p>as  the    widow  of  Rajendran, in  her  individual<\/p>\n<p>capacity,    as  rightly submitted  by  the  learned<\/p>\n<p>counsel appearing for the petitioner, she cannot be<\/p>\n<p>impleaded as an additional accused. As learned<\/p>\n<p>counsel     appearing  for   the  first   respondent<\/p>\n<p>submitted that petitioner is not so far impleaded,<\/p>\n<p>petitioner    is   at  liberty  to  raise  all   the<\/p>\n<p>contentions before the learned Magistrate in the<\/p>\n<p>application filed by the first respondent.<\/p>\n<p>     Petition is disposed.
