DESAI - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMS\nAVANI S MEHTA for\nPetitioner(s) : 1, \nMR KISHOR M PAUL for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/08\/2010  \n \nORAL JUDGMENT<\/pre>\n<p>\tBy<br \/>\nway of this petition, the petitioner has challenged the judgment and<br \/>\norder dated 24.1.2007 passed by the Labour Court, Nadiad in Reference<br \/>\n(LCN) No.472 of 2000 whereby the Labour Court has granted<br \/>\nreinstatement of the respondent with continuity of service and 40%<br \/>\nbackwages.\n<\/p>\n<p>2.\tThe<br \/>\nrespondent was working as a Conductor with the<br \/>\npetitioner-Corporation. On 20.2.1992, a chargesheet was issued<br \/>\nagainst him stating that when he was on duty on the route from Karjan<br \/>\nto Khambhat, he had collected money from the passengers but not<br \/>\nissued tickets to them; he gave unpunched ticket to one passenger by<br \/>\ncollecting money from him so that it can be reused; he did not<br \/>\ncollect money  nor give the ticket of two passengers and when the<br \/>\ncash was checked, it was found less. On completion of inquiry, the<br \/>\nrespondent was dismissed from service vide order dated 20.2.1995.<br \/>\nAgainst the aforesaid order, the respondent filed first appeal and<br \/>\nsecond appeal and as nothing was heard from the Department he<br \/>\nultimately, filed the Reference before the Labour Court. By judgment<br \/>\nand order date 24.1.2007,  the reference was partly allowed and the<br \/>\norder of dismissal was set aside and the petitioner was ordered to<br \/>\nreinstate the respondent on his original post with continuity of<br \/>\nservice and 40% backwages. However, the punishment was imposed of<br \/>\nstoppage of two increments with permanent effect. Hence, this<br \/>\npetition.\n<\/p>\n<p>3.\tI<br \/>\nhave heard the learned counsel for the parties and perused the record<br \/>\nand have also gone through the impugned judgment and order of the<br \/>\nLabour Court.\n<\/p>\n<p>4.\tKeeping<br \/>\nin mind the previous record of 11 defaults, the Tribunal has<br \/>\nsubstituted the penalty of dismissal by imposing the punishment of<br \/>\nstoppage of two increments with permanent effect and has reinstated<br \/>\nthe workman by cancelling the penalty of dismissal. I am in complete<br \/>\nagreement with the said order of the Labour Court. However, looking<br \/>\nto the fact that no reasons are assigned, the order granting 40% of<br \/>\nbackwages is required to be quashed and set aside.\n<\/p>\n<p>5.\tIn<br \/>\nthe result, the petition is partly allowed.
