\npetition, under Article 226 of the Constitution of India, has been
\npreferred with the following prayers:\n<\/p>\n
“(A)\tYour
\nLordships be pleased to issue a writ of mandamus or any other
\nappropriate writ, order or direction, commanding the respondents
\nherein to formulate and prepare a permanent scheme for the purpose of
\naccording permanent or quasi permanent status to the daily wagers of
\nthe Forest Department in light of their long service rendered on
\ndaily wages in the Forest Department;\n<\/p>\n
(B)\tYour
\nLordships be pleased to permanently restrain the respondents herein
\nfrom terminating or discontinuing in any other manner the service of
\nthe petitioners No.2 to 14;\n<\/p>\n
(C)\tYour
\nLordships be pleased to issue a writ of mandamus or any other
\nappropriate writ, order or direction, commanding the respondents
\nherein to grant the following benefits to the petitioners No.2 to 14
\nherein:\n<\/p>\n
(a)\tPermanent
\nabsorption in service or a fair scheme for regularization of service.\n<\/p>\n
(b)\tRegular
\npay scale.\n<\/p>\n
(c)\tIncrements.\n<\/p>\n
(d)\tWeekly
\noff.\n<\/p>\n
(e)\tGroup
\nInsurance.\n<\/p>\n
(f)\tCasual
\nleave, earned leave and medical leave.\n<\/p>\n

\nLordships be pleased to issue a writ of mandamus or any other
\nappropriate writ, order or direction, commanding the respondents
\nherein to apply Government Resolution dated 17.10.1988 to the
\npetitioners No.2 to 14 herein and to grant all benefits admissible
\nunder the said Government Resolution dated 17.10.1988 to the
\npetitioners No.2 to 14 herein depending on the length of each
\nemployee;\n<\/p>\n
(E)\tYour
\nLordships be pleased to issue a writ of mandamus or any other
\nappropriate writ, order or direction, commanding the respondents
\nherein to grant workcharged benefits payable under the final judgment
\ndated 30.1.1996 passed by this Hon’ble High Court in Special Civil
\nApplications No.3607\/82, 422\/83 and 423\/83 to the petitioners No.2 to
\n14 herein just as such benefits have been paid to 746 daily wagers of
\nthe Narmada Water Resources, Water Supply and Kalpasar Department and
\n288 daily wagers of the Roads and Buildings Department;\n<\/p>\n
(F)\tPending
\nadmission and final hearing of the present petition, Your Lordships
\nbe pleased to restrain the respondents  herein from terminating the
\nservice of the petitioners No.2 to 14 herein;\n<\/p>\n
(G)\tPending
\nadmission and final hearing of the present petition, Your Lordships
\nbe pleased to direct the present respondents to grant to the
\npetitioners benefits similar in nature to those made available to the
\ndaily wagers of the Roads & Buildings Department and the Narmada
\nWater Resources, Water Supply and Kalpasar Department vide Government
\nResolution dated 17.10.1988 depending to their length of service;\n<\/p>\n
(H)\tYour
\nLordships be pleased to pass any other appropriate order, as deemed
\nfit in the interest of justice.”\n<\/p>\n
\tIt
\nis the case of the petitioners that certain Departments of the State
\nGovernment such as Roads and Building Department, Narmada, Water
\nResources, Water Supply and Kalpasar Department and Fisheries
\nDepartment  have formulated Schemes for grant of permanent status to
\ndaily wagers working in the said Departments, after they complete a
\nstipulated period of service. According to the petitioners, the
\nForest Department under which the petitioners, who are members of the
\npetitioner No.1 – Union, are working, ought to frame a Scheme
\nfor daily wagers on similar lines, as the work that they perform is
\nperennial in nature,  and is a full-time employment. Most of the
\nmembers of the petitioner No.1 – Union have to perform 24 hours’ duty
\nround the clock and most have, by now, put in service of 5 to 30
\nyears as daily wagers in the Forest Department. It is further the
\ncase of the petitioners that looking to the age factor of its
\nmembers, they are now not eligible for employment elsewhere. Most of
\nthem are Tribals \/ Adivasis and may not qualify to perform any other
\nwork. Several petitions came to be filed by similarly situated
\npersons, being Special Civil Application No.8647 of 2008 and cognate
\nmatters, wherein this Court, by order dated 29.10.2010 issued certain
\ndirections. The said directions are reproduced below:-\n<\/p>\n
“7.\tIn the
\ninterest of justice, the following directions are issued which will
\nmeet with the ends of justice:\n<\/p>\n
The
\n\timpugned order dated 03.05.2008 passed by the Secretary, Forest &
\n\tEnvironment Department, State of Gujarat is quashed and set aside.\n<\/p>\n
The
\n\tSecretary, Forest & Environment Department, State of Gujarat, is
\n\tdirected to consider the case of the petitioners for regularization
\n\t\/conferring permanent status, afresh in light of the facts of each
\n\tindividual case keeping in mind the observations made hereinabove
\n\tand also to consider the scope of framing a scheme for giving quasi
\n\tpermanent status to the petitioners-daily wagers at par with
\n\tthe scheme for daily wagers in other Government Departments like
\n\tRoads & Buildings Department, Narmada Water Resources, Water
\n\tSupply and Kalpasar Department, etc., contained in Government
\n\tResolution dated 17.10.1988.  In case, the authority is of the view
\n\tthat the benefits as prayed for cannot be granted then a reasoned
\n\torder be passed supported by detailed reasons.\n<\/p>\n
The
\n\taforesaid exercise be undertaken within a period of two months from
\n\ttoday.\n<\/p>\n
Liberty
\n\tto revive the petitions in case of difficulty by filing required
\n\tapplication\/s.”\n<\/p>\n
\tAccording
\nto the petitioners, for the purposes of this petition, the directions
\nat Paragraph-7B and C are relevant. As is seen from the order
\nreproduced hereinabove, one of the directions was to the Secretary,
\nForest and Environment Department, Government of Gujarat, to consider
\nthe cases of the petitioners therein for regularization \/ conferring
\npermanent status, keeping in view the facts of each individual case
\nand to consider framing a scheme for giving quasi-permanent status to
\nthe daily wagers at par with the Scheme for daily wagers in other
\nGovernment Departments. It is the case of the petitioners that the
\nabove directions would also be applicable to them, hence, the State
\nGovernment ought to consider their cases along similar lines.\n<\/p>\n
\tToday,
\nwhen the matter is taken up for hearing, Mr.Maulik G.Nanavati,
\nlearned Assistant Government Pleader, states upon the basis of the
\ncommunication dated 07.04.2011 of the Principal Conservator of
\nForests, which is taken on the record of the case, and upon oral
\ninstructions received from Shri S.K.Nanda, Principal Secretary,
\nForests and Environment Department that:\n<\/p>\n
“The
\nindividual cases of the petitioners for regularization \/ conferring
\npermanent status shall be considered in light of the observations
\nmade by this Court in Paragraph-7B of order dated 29.10.2010 passed
\nin Special Civil Application No.8647 of 2008 and cognate matters,
\nwithin a period of six months from today.”\n<\/p>\n
\tIn
\nview of the above statement made by the learned Assistant Government
\nPleader, Mr.Shalin N.Mehta, learned advocate for the petitioners,
\nstates that he may be permitted to withdraw the petition, with
\nliberty to approach this Court in case of difficulty.\n<\/p>\n
\tPermission
\nto withdraw the petition with liberty to approach the Court in case
\nof difficulty is granted.\n<\/p>\n
\tThe
\npetition is disposed of as withdrawn. Notice is discharged.\n<\/p>\n
