(2)  23  1990 SCC  Supl.  722\n JT 1989  Supl.\t   308\t  1989 SCALE  (2)1096\n\n\nACT:\n    Educational Institutions: Education Act: Application for\nrecognition of educational institution--Necessity for  early\ndisposal by Government-Emphasised.\n\n\n\nHEADNOTE:\n    The\t petitioners in the special leave petition  started,\nwithout\t recognition, a teachers training college in  Bihar,\nand  later applied for permission to allow its\tstudents  to\nappear at the examination on the ground that the question of\nits recognition had not been decided by the Government.\t The\npetitioners  failed to get the desired relief from the\tHigh\nCourt.\nDismissing the special leave petition, this Court,\n    HELD: (1) A number of mushroom institutions have  sprung\nup in the State of Bihar without getting any recognition and\nthereafter have tried to get the permission from courts that\nits  students  be allowed to appear at\tthe  examination  on\ngrounds of sympathy. [24G]\n    (2)\t It is not possible to grant any such permission  as\nprayed for because the granting of such permission would  be\nclearly violating the provisions of the Education Act. [25B]\n    S.L.P.  No. 12014 of 1987 decided on November  25,\t1987\n<a href=\"\/doc\/197490\/\">A.P. Christians Medical Educational Society v. Government of\nA.P. &amp; Anr.,<\/a> [1986] 2 SCC 667, referred to.\n    (3)\t The  application for recognition in this  case\t was\nmade  by the petitioners as early as 1986 and that  applica-\ntion  has  not still been disposed of. The  same  should  be\ndisposed of within 4 weeks from today. [25F]\n    (4) The concerned department of the Government of Bihar,\nshould see to it that applications for recognition of educa-\ntional\tinstitutions are decided promptly and where such  an\napplication is without\n24\nmerit, the Government should promptly reject,  the same\t and\ntake steps to see to it that the rejection is brought to the\nattention  of the students of the institution  concerned  so\nthat they may not waste further time and money by undergoing\ntraining in that institution. [25C]\n    (5)\t The failure of the Government to take\tsuch  action\nwould only reflect callous indifference to the interests  of\nthe  young  students to whom the Government  certainly\towes\ncertain responsibilities. [25D]\n    (6) The State should consider taking such steps,  Crimi-\nnal  or Civil, as open to it in law, to stop  such  institu-\ntions  and those who run them from misleading  students\t and\ndeceiving them. [25E]\n    (7)\t The State Government of Bihar shall  get  published\nadvertisements\tin at least three newspapers in\t that  State\nwith wide circulation warning students not to take admission\nin any educational institution which has not got recognition\nand making it clear that if they do so, they would be  doing\nso at their own risk. Sharma  and  Ms.  Sangeeta<br \/>\nTripathi for the Petitioners.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\n    KANIA, J. This is one more case of an educational insti-<br \/>\ntution\tstarted\t in the State of Bihar\twithout\t recognition<br \/>\napplying  for permission to allow the students, whom it\t has<br \/>\nadmitted and, from whom it has presumably recovered substan-<br \/>\ntial  fees, to be allowed to appear at the ensuing  examina-<br \/>\ntion on the ground that the question of its recognition\t has<br \/>\nnot  been  decided by the Government. It  appears  from\t the<br \/>\njudgment of the High Court that a number of similar mushroom<br \/>\ninstitutions  have sprung up in the State of  Bihar  without<br \/>\nprior  recognition,  have admitted students,  received\tfees<br \/>\nfrom  them and allowed them to undergo training for  a\tsub-<br \/>\nstantial period of time without getting any recognition\t and<br \/>\nthereafter tried to get permission from the Court for  their<br \/>\nstudents  to  be  allowed to appear at\tthe  examination  on<br \/>\ngrounds of sympathy. This impression has been gathered\tfrom<br \/>\na<br \/>\n<span class=\"hidden_text\">25<\/span><br \/>\nnumber\tof  similar applications made to this Court  in\t the<br \/>\nlast few months.\n<\/p>\n<p>    It\tis  not\t possible to grant any\tsuch  permission  as<br \/>\nprayed for because the granting of such permission would  be<br \/>\nclearly\t violating the provisions of the Education Act\t(See<br \/>\nthe judgments in S.L.P. No. 120 14 of 1987 decided on Novem-<br \/>\nber  25,  1987 and the <a href=\"\/doc\/173865\/\">A.P. Christians\tMedical\t Educational<br \/>\nSociety\t v.  Government of A.P. &amp; Anr., AIR<\/a>  1986  SC  1490:<br \/>\n[1986]\t2  SCC\t667. What is however,  unfortunate  is\tthat<br \/>\napplications made by various educational institutions to the<br \/>\nGovernment for recognition are not promptly disposed of.  In<br \/>\nfact,  we are of the view that the concerned  department  of<br \/>\nthe  Government of Bihar should see to it that\tapplications<br \/>\nfor  recognition  of educational  institutions\tare  decided<br \/>\npromptly and where such an application is without merit, the<br \/>\nGovernment should promptly reject the same and take steps to<br \/>\nsee to it that the rejection is brought to the attention  of<br \/>\nthe  students of the institution concerned so that they\t may<br \/>\nnot  waste further time and money by undergoing training  in<br \/>\nthat institution. The failure of the Government to take such<br \/>\naction would only reflect callous indifference to the inter-<br \/>\nests of the young students to whom the Government  certainly<br \/>\nowes  certain responsibilities. We also feel that the  State<br \/>\nGovernment should issue advertisement through newspapers and<br \/>\nother possible channels, if any, to ensure that students  do<br \/>\nnot get misled by such unrecognised institutions into  wast-<br \/>\ning  their  precious time and money in\tundergoing  training<br \/>\nwhich  will be of no avail to them. We find that  there\t ap-<br \/>\npears to be a large number of students in the State who\t are<br \/>\nmisled\tby  such  institutions. In fact,  the  State  should<br \/>\nconsider taking such steps, criminal or civil, as open to it<br \/>\nin law to stop such institutions and those who run them from<br \/>\nmisleading students and deceiving them.\n<\/p>\n<p>    We\tare informed that in the present case, the  applica-<br \/>\ntion  for  recognition was made by the\tpetitioners  and  as<br \/>\nearly  as 1986 that application has not still been  disposed<br \/>\nof.  We direct that, if this so, the application  should  be<br \/>\ndisposed of within 4 weeks from today.\n<\/p>\n<p>    In\tthese circumstances, we direct the State  Government<br \/>\nof  Bihar to get published advertisements in at least  three<br \/>\nnewspapers  in\tthat  State with  wide\tcirculation  warning<br \/>\nstudents  not to take admission in any educational  institu-<br \/>\ntion which has not got recognition and making it clear\tthat<br \/>\nif they do so, they would be doing so at their own risk. The<br \/>\nadvertisements to be issued within three weeks from the date<br \/>\nof  receipt  of this order by the department  concerned.  We<br \/>\ndirect that the<br \/>\n<span class=\"hidden_text\">26<\/span><br \/>\ncopies of this order be sent forthwith to the Chief Minister<br \/>\nof Bihar, the Minister in-charge of the Education Department<br \/>\nand the Secretary of that department.\n<\/p>\n<p>    Special leave petition is dismissed with these  observa-<br \/>\ntions.
