Consid-\n\tering the purpose of the relevant empowerment and its impact\n\ton  those who are likely to be affected by the\texercise  of\n\tthe  power,  it\t is clear that the power  conferred  on\t the\n\tTextile\t Commissioner in the Cotton Textile (Control)  Order\n\t1948  to issue directions is coupled with a duty to  specify\n\tthe  particular\t period for which the  directions  shall  be\n\toperative. Under the power conferred by Section  3<br \/>\n\tof the Essential Supplies (Temporary Powers) Act, 1946,\t the<br \/>\n\tCentral\t Government issued an Order called &#8220;The Cotton\tTex-<br \/>\n\ttiles  (Control) Order, 1948&#8221;.\tClause 20 of that Order,  as<br \/>\n\tamended, reads thus :&#8211;\n<\/p>\n<blockquote><p>\t\t\t    &#8220;20(1) The Textile Commissioner may from<br \/>\n\t\t      time   to time issue directions in writing  to<br \/>\n\t\t      any   manufacturer  or class of  manufacturers<br \/>\n\t\t      or  the manufacturers generally regarding\t the<br \/>\n\t\t      classes  or specifications of cloth  or  yarn,<br \/>\n\t\t      and  the\tmaximum or  the\t minimum  quantities<br \/>\n\t\t      thereof,\t which they shall or shall not\tpro-<br \/>\n\t\t      duce  during such periods as may be  specified<br \/>\n\t\t      in the directions, and they shall comply\twith<br \/>\n\t\t      such directions.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t    20(2)  In  the exercise  of\t the  powers<br \/>\n\t\t      conferred\t upon  him  by\tsub-clause  (1)\t the<br \/>\n\t\t      Textile Commissioner  shah  have regard to the<br \/>\n\t\t      capacity of the producer to produce cloth\t and<br \/>\n\t\t      yarn  of different descriptions or  specifica-<br \/>\n\t\t      tions  and  to  the needs of the general\tpub-<br \/>\n\t\t      lic.&#8221;\n<\/p><\/blockquote>\n<p>\tThe  question  for  our determination in  these\t appeals  is<br \/>\n\twhether, if the Textile Commissioner decides to issue appro-<br \/>\n\tpriate\tdirections to any manufacturer or class of  manufac-<br \/>\n\tturers,\t it is obligatory  upon him to specify\ttherein\t the<br \/>\n\tperiod for which the directions will remain in operation.<br \/>\n\t    As\t hold\tby  this  Court in <a href=\"\/doc\/1825251\/\">State  of  Uttar  Pradesh<br \/>\n\tv. Jogendra Singh,<\/a>(1) it is well settled that the word &#8220;may&#8221;<br \/>\n\tis capable of meaning &#8220;must&#8221; or &#8220;shall&#8221; in the light of\t the<br \/>\n\tcontext\t and  that where a discretion is  conferred  upon  a<br \/>\n\tpublic authority coupled with an obligation, the word  &#8220;may&#8221;<br \/>\n\twhich  denotes\tdiscretion  should be construed\t to  mean  a<br \/>\n\tcommand.  Considering the purpose of the relevant   empower-<br \/>\n\tment  and its impact on those who are likely to be  affected<br \/>\n\tby  the exercise of the power, we are clear that  the  power<br \/>\n\tconferred on the Textile Commissioner to issue directions is<br \/>\n\tcoupled\t with  the duty to specify the particular period for<br \/>\n\twhich the directions shall be operative.  Directions of\t the<br \/>\n\tkind envisaged by clause 20 are influenced and justified  by<br \/>\n\texigencies which render it imperative that the directions be<br \/>\n\treviewed  from time to time.  That becomes feasible only  if<br \/>\n\tthe directions as limited expressly to a determinate  period<br \/>\n\tof&#8221;\n<\/p>\n<p>\t(1) [1964] 2 S.C.R. 197 at 202.\n<\/p>\n<p><span class=\"hidden_text\">\t827<\/span><\/p>\n<p>\t\t\t   (Chandrachud, J.)<br \/>\n\ttime at the end of which a fresh review of facts and circum-<br \/>\n\tstances\t becomes obligatory.  There is a fear that a  direc-<br \/>\n\ttion  not limited in point of time may continue\t to  operate<br \/>\n\teven after it has outlived its utility for the reason merely<br \/>\n\tthat  the need to review it is not clearly  perceived.\t Be-<br \/>\n\tsides,\tthe manufacturers must know,  in  order\t  that\tthey<br \/>\n\tmay organize their business in their own interest as well as<br \/>\n\tin  the interest of the community at large, as to  how\tlong<br \/>\n\tany particular embargo is going to be operative.<br \/>\n\t    Accordingly,  we affirm the judgment of the\t High  Court<br \/>\n\tthough on the ground only that the impugned Notification  in<br \/>\n\tso far as it prohibits the printing of any border or heading<br \/>\n\ton  sarees  etc.  for  an indefinite period is\tultra  vires<br \/>\n\tclause 20  of  the  Cotton  Textiles (Control) Order,  1948,<br \/>\n\tsince  the  aforesaid clause casts an obligation or  a\tduty<br \/>\n\tupon  the  Textile  Commissioner to   specify\tthe   period<br \/>\n\tduring\twhich  the prohibition shall remain  in\t force.\t  We<br \/>\n\texpress no opinion on the other points, including Point\t No.<br \/>\n\t6 urged before the High Court for its consideration.<br \/>\n\t    The\t appeals are accordingly dismissed.
