DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with First Information Report registered as<br \/>\nI-C.R.No.15\/2011 with Athwa Police Station, District Surat for the<br \/>\noffences punishable under Sections 420, 465, 467, 468, 471, 504,<br \/>\n506(2)m 120-B, 114 of Indian Penal Code.\n<\/p>\n<p>2.\t\tLearned<br \/>\ncounsel appearing for the applicants submits that the applicant is<br \/>\nclaiming parity especially when the complainant has adopted a<br \/>\nselective approach in settling the case with another co-accused and<br \/>\nqua the said accused, the complaint is quashed and set aside by order<br \/>\ndated 6.5.2011 by coordinate Bench of this Court (Coram : Hon&#8217;ble<br \/>\nMr.Justice M.D.Shah, J) in Criminal Miscellaneous Application No.3346<br \/>\nof 2011 where the offences under Sections 420, 465, 467, 468, 471,<br \/>\n504, 506(2), 120-B and 114 of Indian Penal Code are registered.<br \/>\nAnother two co-accused have been enlarged on bail by coordinate Bench<br \/>\nof this Court (Coram : Hon&#8217;ble Mr.Justice J.B.Pardiwala,J) vide order<br \/>\ndated 14.7.2011 passed in Criminal Miscellaneous Application No. 8936<br \/>\nof 2011 and also by this Court vide order dated 26.4.2011 passed in<br \/>\nCriminal Miscellaneous Application No.4922 of 2011, the applicant<br \/>\ncannot be deprived of the benefit of bail when the transaction is a<br \/>\npart of the disputed Power of Attorney executed in favour of the<br \/>\napplicant.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned APP Ms.Manisha L Shah for the respondent-State and learned<br \/>\nadvocate Mr.A.B.Munshi for the original complainant.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard learned counsels for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the applicant and on the ground of<br \/>\nparity, by imposing suitable conditions, I deem it just and proper to<br \/>\nenlarge the applicant on bail.\n<\/p>\n<p>5.\t\tLearned<br \/>\ncounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith First Information Report registered as I-C.R.No.15\/2011 with<br \/>\nAthwa Police Station, Surat on executing a bond of Rs.5,000\/- (Rupees<br \/>\nFive Thousand only) with one surety of the like amount to the<br \/>\nsatisfaction of the Trial Court and subject to the conditions that he<br \/>\nshall;\n<\/p>\n<p>(a)\t\tnot<br \/>\ntake undue advantage of liberty or misuse liberty.\n<\/p>\n<p>(b)\t\tnot<br \/>\nact in a manner injurious to the interest of the prosecution.\n<\/p>\n<p>(c)\t\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>(d)\t\tsurrender<br \/>\npassport, if any, to the lower Court, within a week.\n<\/p>\n<p>(e)\t\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(f)\t\tmark<br \/>\npresence at the concerned Police Station on every 1st and<br \/>\n15th day of English calender month between 11.00 a.m. to<br \/>\n2.00 P.M.;\n<\/p>\n<p>(g)\t\tfurnish<br \/>\nthe present address of his residence to the Investigating Officer and<br \/>\nalso to the Court at the time of execution of the bond and shall not<br \/>\nchange the residence without prior permission of this Court.\n<\/p>\n<p>7.\t\tThe<br \/>\nauthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>8.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge will be free to issue warrant or take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>7.\t\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>8.\t\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>9.\t\tRule<br \/>\nis made absolute.
