                                   This criminal miscellaneous petition has been<\/p>\n
                    filed for quashing the order dated 10. 11. 2008, passed<\/p>\n
                    in Singhia P.S. Case No. 37 of 2008 whereby and<\/p>\n
                    whereunder cognizance has been taken under Section<\/p>\n
                    302 and 120 B\/34 of the Indian Penal Code.<\/p>\n
                                   The prosecution as alleged in the Fard Beyan<\/p>\n
                    by the informant Mukhtar that on 29. 03. 2008, he<\/p>\n
                    went to house of his relation at Village- Navdga and<\/p>\n
                    remained stayed and on 30. 03. 2008 at about 12 Noon,<\/p>\n
                    his uncle Md. Hasim informed on telephone that his<\/p>\n
                    wife is serious and he is taking her to Singhia for<\/p>\n
                    treatment and asked to come Singhia. It is alleged by<\/p>\n
                    the informant that he reached at Singhia, he did not<\/p>\n
                    found his uncle and wife and again he received a call
\n                  2<\/span><\/p>\n
from his uncle then he was informed that his wife is<\/p>\n
dead and then he reached to his house and saw the<\/p>\n
dead body of his wife.     The uncle of the informant<\/p>\n
disclosed that his wife Tamanna Khatoon had gone to<\/p>\n
watch maize field and in that field she was lying and her<\/p>\n
mouth and nose was tied with her duppatta.         In the<\/p>\n
meantime one co-villager Heera Sada while returned<\/p>\n
with her daughter      heard the sound and went there<\/p>\n
and found the deceased wife of Mukhtar, then Heera<\/p>\n
Sada raised hulla and on hulla his uncle and other<\/p>\n
came there and taken her to Singhia for treatment then<\/p>\n
the victim died in way.    It is further alleged that Md.<\/p>\n
Raju and Md. Halim @ Mangnu, co-villagers threatened<\/p>\n
that   nothing   has    happen   and      threatened   the<\/p>\n
prosecution parties in the said case and it was claimed<\/p>\n
that Md. Raju and Md. Halim in collusion with common<\/p>\n
intention committed murder of his wife.<\/p>\n
         On the basis of Fard Beyan, F.I.R. was lodged.<\/p>\n
During investigation a protest petition was also filed by<\/p>\n
the informant Md. Mukhtar.       However, charge sheet<\/p>\n
was submitted against Md. Hasim and other petitioners<\/p>\n
including the informant in two installments.       Earlier<\/p>\n
charge sheet was submitted against Md. Hasim, Md.<\/p>\n
Noor Hasan, Md. Safique and Jhori Sada, thereafter,<\/p>\n
against Md. Najre Alam, Md. Farukh, Md. Mukhtar
\n                    3<\/span><\/p>\n
(informant) and Md. Shamshul and cognizance was<\/p>\n
taken by order dated 10. 11. 2008 and again by 10. 12.<\/p>\n
2008.\n<\/p>\n
         Learned counsel for the petitioners however,<\/p>\n
contends that on record to the occurrence for taking<\/p>\n
cognizance under Sections 302 and 120 B\/34 of the<\/p>\n
Indian Penal Code, there is no iota evidence whatsoever<\/p>\n
against these petitioners.      However, accused persons<\/p>\n
are also witnesses in the case.        However, two sets of<\/p>\n
witnesses, one set of witnesses have supported the<\/p>\n
prosecution case about the occurrence and another set<\/p>\n
of witnesses though, has stated that the husband of the<\/p>\n
deceased may have murdered his wife, but they have<\/p>\n
not   seen   the   occurrence    and    they   stated   about<\/p>\n
implication of informant, the husband on doubt.<\/p>\n
         However, in the entire case diary, there is no<\/p>\n
eye witness of the occurrence. However, charge sheet<\/p>\n
has been filed only on suspicion that the husband may<\/p>\n
have murdered. However, except suspicion there is no<\/p>\n
evidence whatsoever or circumstance to suggest or give<\/p>\n
theory that chain of circumstance as such to infer<\/p>\n
irresistible conclusion about the guilt of accused<\/p>\n
persons and hence submission of the charge sheet and<\/p>\n
even taking cognizance is merely on pure suspicion and<\/p>\n
hence are based on conjecture and surmises. However,
\n                            4<\/span><\/p>\n
       going into the case diary, there is no iota of evidence<\/p>\n
       and there is no circumstance or chain circumstance to<\/p>\n
       even   create   a   strong       suspicion    however   to   take<\/p>\n
       cognizance on mere suspicion that husband may have<\/p>\n
       cause the death when there is no iota of any evidence<\/p>\n
       and a chain circumstance to suggest the guilt is abuse<\/p>\n
       of the process of Court.\n<\/p>\n
                 Learned counsel for the State has submits<\/p>\n
       that even suspicion is made out a criminal prosecution<\/p>\n
       may continue.           The learned counsel for the State<\/p>\n
       specifically mentioned paras 13, 14, 16, 17 and 18, but<\/p>\n
       those paragraphs no evidence against the accused for<\/p>\n
       their implication and mere suspicion without any iota<\/p>\n
       or evidence is not warranted in law.\n<\/p>\n
                 Hence         having      regard     to    fact    and<\/p>\n
       circumstance, there is no iota of evidence either direct<\/p>\n
       or circumstantial to infer the implication of the accused<\/p>\n
       and it appears that the order taking cognizance passed<\/p>\n
       without   proper        application   of     mind,   hence    the<\/p>\n
       impugned order taking cognizance is hereby set aside<\/p>\n
       and allowing the prosecution to continue without<\/p>\n
       evidence is the abuse of the process of Court. Hence<\/p>\n
       the impugned order taking cognizance is hereby set<\/p>\n
       aside and the criminal prosecution is quashed.<\/p>\n
