    This is an appeal preferred against the<\/p>\n
order    of    the      Workmen’s     Compensation<\/p>\n
Commissioner, Kannur in       W.C.C. 24\/03.    The<\/p>\n
applicant, claimed to be an employee under the<\/p>\n
opposite party sustained injuries in a road<\/p>\n
accident and he has been awarded a compensation<\/p>\n
of  Rs.98,850\/-.   The    insurance   company  has<\/p>\n
disputed the employer-employee relationship as<\/p>\n
well as the coverage under the policy.         The<\/p>\n
substantial questions of law as allowed as per<\/p>\n
the amendment application are as follows.<\/p>\n
        “i. Whether   the   Commissioner   is<\/p>\n
        justified   in   holding   that   the<\/p>\n
        applicant who is employed as a<\/p>\n
        “Karysthan” in a Biship’s house<\/p>\n

          can be considered as an employee<\/p>\n
          of the insured who comes under the<\/p>\n
          proviso  to  Section  147  of  the<\/p>\n
          M.V.Act.\n<\/p><\/blockquote>\n
          ii. Whether a casual rider of a<\/p>\n
          motorcycle can be considered as a<\/p>\n
          driver employed by the insured who<\/p>\n
          come under the proviso to S.147 of<\/p>\n
          the M.V.Act and<\/p>\n
          iii. Whether the Commissioner is<\/p>\n
          justified in not considering the<\/p>\n
          Supreme Court decision which says<\/p>\n
          that the interest is payable only<\/p>\n
          from the date of adjudication.”<\/p>\n
    Points 1 to 3:<\/p><\/blockquote>\n
    2.    In    order to entitle the claimant to<\/p>\n
have compensation it is imperative to establish<\/p>\n
the    employer-employee relationship.    Now the<\/p>\n
sphere of controversy between the parties is<\/p>\n
that the claimant is an employee in the Bishop’s<\/p>\n
house and he is not an employee of the first<\/p>\n
opposite     party  and therefore   there  is no<\/p>\n

employer-employee relationship and therefore the<\/p>\n
claim will not lie.    When it is a Bishop’s house<\/p>\n
and     a    person  is   employed,   there   are<\/p>\n
methodologies      by  which    the parties   can<\/p>\n
successfully prove under whom the claimant is<\/p>\n
working.     If the claimant is able to establish<\/p>\n
that he is working under the first opposite<\/p>\n
party then he can be classified as an employee<\/p>\n
for the reason that one need not be a full time<\/p>\n
rider of a vehicle but in the discharge of the<\/p>\n
duty and in the course of employment if he is<\/p>\n
directed by the employer to ride a vehicle and<\/p>\n
he meets with an accident the position will be<\/p>\n
covered.      But   the fundamental  question  of<\/p>\n
employer-employee      relationship    must    be<\/p>\n
established.     When questions are put to him in<\/p>\n
the cross-examination the claimant only gives<\/p>\n
evasive answers and therefore the evidence is<\/p>\n

not properly adduced and the appreciation of the<\/p>\n
same is not in accordance with law.     Therefore<\/p>\n
the matter requires reconsideration at the hands<\/p>\n
of the Compensation Commissioner on     employer-<\/p>\n
employee relationship.\n<\/p>\n
    3.    Then    the learned   counsel for   the<\/p>\n
insurance company again would contend that even<\/p>\n
if it is found that the applicant is an employee<\/p>\n
under the first opposite party, being not a paid<\/p>\n
driver, the terms and conditions of the policy<\/p>\n
excludes     the  coverage  of  such  person  and<\/p>\n
therefore the insurance company shall not be<\/p>\n
saddled with the liability. This matter also has<\/p>\n
to be considered and the purport and impact of<\/p>\n
S.147      of    the   M.V.Act    also   requires<\/p>\n
reconsideration and that also can be looked<\/p>\n
into.     Therefore the award under challenge is<\/p>\n
set aside and the matter is remitted back to the<\/p>\n

Compensation Commissioner for the following.<\/p>\n
    (1) The claimant has to adduce evidence to<\/p>\n
satisfy      that  there   is   employer-employee<\/p>\n
relationship between him and the first opposite<\/p>\n
party and the insurance company can also tender<\/p>\n
evidence in that regard so that the Court can<\/p>\n
arrive at a reasonable conclusion.<\/p>\n
    (2) The contention of the insurance company<\/p>\n
that even if the employer-employee relationship<\/p>\n
is found whether by virtue of the terms and<\/p>\n
conditions of the policy the present applicant<\/p>\n
will be covered be also decided.\n<\/p>\n
    4.    I do not propose to interfere with the<\/p>\n
quantum awarded in this case and therefore the<\/p>\n
scope of remand is only for these two limited<\/p>\n
purposes.\n<\/p>\n
    5.    The Commissioner is directed to fix a<\/p>\n
date, send notice to the parties and give a date<\/p>\n

of hearing of the case.   If any amount is lying<\/p>\n
in deposit, let it remain there till a final<\/p>\n
decision is taken.     Since he had sustained<\/p>\n
serious injuries the Compensation Commissioner<\/p>\n
shall dispose of the matter within three months<\/p>\n
from the date of first appearance before Court.<\/p>\n
    The M.F.A. is disposed of accordingly.<\/p>\n
