      All \u00a0 the \u00a0 petitioners \u00a0 were \u00a0 appointed \u00a0 as \u00a0 Lecturers \u00a0 in \u00a0 the \u00a0 respective\u00a0<br \/>\ndepartments\u00a0in\u00a0Lucknow\u00a0University.\u00a0All\u00a0of\u00a0them\u00a0were\u00a0allowed\u00a0Reader&#8217;s\u00a0scale\u00a0<br \/>\nw.e.f.\u00a027.7.1998,\u00a0and\u00a0were\u00a0given\u00a0the\u00a0designation\u00a0as\u00a0Readers\u00a0w.e.f.\u00a022.10.2001\u00a0<br \/>\nexcept\u00a0petitioner\u00a0No.\u00a04.\u00a0He\u00a0was\u00a0given\u00a0Reader&#8217;s\u00a0designation\u00a0on\u00a03.5.2001.\u00a0\n<\/p>\n<p>       The \u00a0 petitioners \u00a0 were \u00a0 considered \u00a0 for \u00a0 promotion \u00a0 under \u00a0 the \u00a0 &#8216;Career\u00a0<br \/>\nAdvancement \u00a0 Scheme&#8217; \u00a0 in \u00a0 the \u00a0 month \u00a0 of \u00a0 January\/February, \u00a0 2007. \u00a0 The\u00a0<br \/>\nrecommendations\u00a0 of \u00a0 the \u00a0 Selection \u00a0 Committee \u00a0 were \u00a0 not \u00a0 put \u00a0 up \u00a0 before \u00a0 the\u00a0<br \/>\nExecutive\u00a0Committee\u00a0for\u00a0four\u00a0months\u00a0and\u00a0thus\u00a0in\u00a0terms\u00a0of\u00a0Section\u00a031\u00a0(8)\u00a0(aa)\u00a0<br \/>\nof\u00a0the\u00a0U.P.\u00a0State\u00a0Universities\u00a0Act,\u00a01973,\u00a0the\u00a0recommendations\u00a0were\u00a0referred\u00a0to\u00a0<br \/>\nthe\u00a0Chancellor.\u00a0By\u00a0his\u00a0order\u00a0dated\u00a0July\u00a03,\u00a02007,\u00a0the\u00a0Chancellor\u00a0did\u00a0not\u00a0agree\u00a0<br \/>\nwith \u00a0 the \u00a0 recommendations \u00a0 on \u00a0 the \u00a0 ground \u00a0 that \u00a0 on \u00a0 the \u00a0 dates, \u00a0 when \u00a0 the\u00a0<br \/>\nSelection\u00a0Committees\u00a0met\u00a0i.e.\u00a04.1.2007\u00a0and\u00a022.2.2007,\u00a0the\u00a0Statutes\u00a0in\u00a0terms\u00a0<br \/>\nof\u00a0 the\u00a0 &#8216;Career\u00a0 Advancement\u00a0Scheme&#8217;\u00a0were\u00a0neither\u00a0made\u00a0nor\u00a0 amended\u00a0and\u00a0<br \/>\nthus\u00a0the\u00a0meeting\u00a0of\u00a0the\u00a0Selection\u00a0Committee\u00a0could\u00a0not\u00a0be\u00a0held\u00a0in\u00a0accordance\u00a0<br \/>\nwith\u00a0the\u00a0law.\u00a0The\u00a0petitioners\u00a0filed\u00a0this\u00a0Writ\u00a0Petition\u00a0in\u00a0which\u00a0on\u00a025.10.2007\u00a0<br \/>\nthis\u00a0Court\u00a0after\u00a0hearing\u00a0both\u00a0the\u00a0parties\u00a0passed\u00a0following\u00a0orders:\u00ad<br \/>\n               &#8220;Notice\u00a0on\u00a0behalf\u00a0of\u00a0respondent\u00a0no.\u00a01\u00a0has\u00a0been\u00a0accepted \u00a0by\u00a0Sri \u00a0<br \/>\n       Devendra\u00a0Arora\u00a0and\u00a0on\u00a0behalf\u00a0of\u00a0respondent\u00a0Nos.\u00a02\u00a0and\u00a03\u00a0notice\u00a0has \u00a0<br \/>\n       been \u00a0 accepted \u00a0 by \u00a0 Sri \u00a0 I.B. \u00a0 Singh. \u00a0 The \u00a0 respondents \u00a0 pray \u00a0 for \u00a0 and \u00a0 are \u00a0<br \/>\n       granted\u00a0four\u00a0weeks\u00a0time\u00a0to\u00a0file\u00a0counter\u00a0affidavit.\n<\/p>\n<p>               Submission \u00a0 of \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 petitioner \u00a0 Sri \u00a0 Sandeep \u00a0<br \/>\n       Dixit,\u00a0is\u00a0that\u00a0the\u00a0view\u00a0expressed\u00a0by\u00a0the\u00a0Chancellor\u00a0and\u00a0Executive\u00a0Council \u00a0<br \/>\n       on \u00a0 20th \u00a0 February \u00a0 2007 \u00a0 for \u00a0 considering \u00a0 the \u00a0 promotion \u00a0 under \u00a0 Career \u00a0<br \/>\n       Advancement\u00a0Scheme\u00a0on\u00a0the\u00a0post\u00a0of\u00a0Professor\u00a0was\u00a0not\u00a0valid\u00a0because\u00a0the \u00a0<br \/>\n       Statute\u00a0was\u00a0amended\u00a0as\u00a0per\u00a0the\u00a0assent\u00a0given\u00a0by\u00a0the\u00a0Chancellor\u00a0only\u00a0on \u00a0<br \/>\n       20th\u00a0June\u00a02007\u00a0and\u00a0for\u00a0that\u00a0mater\u00a0direction\u00a0to\u00a0hold\u00a0a\u00a0fresh\u00a0Selection \u00a0<br \/>\n       Committee\u00a0requires\u00a0reconsideration\u00a0by\u00a0the\u00a0Chancellor,\u00a0in\u00a0view\u00a0of\u00a0the\u00a0fact \u00a0<br \/>\n       that \u00a0 the \u00a0 amended \u00a0 Statute \u00a0 namely; \u00a0 11.24 \u00a0 gives \u00a0 the \u00a0 promotion \u00a0 under \u00a0<br \/>\n       Career\u00a0Advancement\u00a0Scheme\u00a0from\u00a0the\u00a0date\u00a0of\u00a0eligibility\u00a0of\u00a0the\u00a0incumbent \u00a0<br \/>\n<span class=\"hidden_text\">                                                  2<\/span><\/p>\n<p>        or\u00a0from\u00a027th\u00a0July\u00a01998 \u00a0whichever \u00a0is\u00a0later,\u00a0and \u00a0not\u00a0from\u00a0the\u00a0date \u00a0of \u00a0<br \/>\n        taking \u00a0 over \u00a0the \u00a0 charge \u00a0of \u00a0the \u00a0 higher \u00a0post, \u00a0and \u00a0therefore, \u00a0even \u00a0if, \u00a0the \u00a0<br \/>\n        Selection \u00a0Committee \u00a0had \u00a0recommended \u00a0promotion \u00a0prior \u00a0 to \u00a0the \u00a0 assent \u00a0<br \/>\n        given \u00a0 by \u00a0 the \u00a0 Chancellor \u00a0 to \u00a0 the \u00a0 proposed \u00a0 amended \u00a0 Statute \u00a0 which \u00a0 was \u00a0<br \/>\n        being\u00a0done\u00a0in\u00a0pursuance\u00a0of\u00a0the\u00a0directive\u00a0\u00a0issued\u00a0by\u00a0the\u00a0University\u00a0Grant \u00a0<br \/>\n        Commission,\u00a0no\u00a0prejudice\u00a0would\u00a0be\u00a0caused\u00a0to\u00a0any\u00a0person\u00a0and\u00a0the\u00a0benefit \u00a0<br \/>\n        of \u00a0 the \u00a0 promotion \u00a0 will \u00a0 be \u00a0 given \u00a0 to \u00a0 the \u00a0 petitioner \u00a0 from \u00a0 the \u00a0 date \u00a0 of \u00a0<br \/>\n        eligibility\u00a0irrespective\u00a0of\u00a0the\u00a0date,\u00a0on\u00a0which\u00a0the\u00a0Statute\u00a0was\u00a0amended.\n<\/p>\n<p>                Sri\u00a0Devendra\u00a0Arora,\u00a0learned\u00a0counsel\u00a0appearing\u00a0for\u00a0the\u00a0respondent \u00a0<br \/>\n        no.\u00a01\u00a0could\u00a0not\u00a0satisfy\u00a0the\u00a0Court\u00a0on\u00a0the\u00a0said\u00a0issue\u00a0otherwise\u00a0and\u00a0about \u00a0<br \/>\n        the\u00a0outcome\u00a0of\u00a0the\u00a0orders\u00a0passed\u00a0by\u00a0the\u00a0Chancellor\u00a0which\u00a0in\u00a0fact,\u00a0though \u00a0<br \/>\n        means\u00a0holding\u00a0of\u00a0a\u00a0fresh\u00a0meeting\u00a0but\u00a0again\u00a0the\u00a0benefit\u00a0of\u00a0the\u00a0promotion \u00a0<br \/>\n        would\u00a0be\u00a0given\u00a0from\u00a0the\u00a0date\u00a0to\u00a0which\u00a0the\u00a0petitioner\u00a0is\u00a0entitled\u00a0under\u00a0the \u00a0<br \/>\n        Act.\n<\/p>\n<p>                We,\u00a0therefore,\u00a0provide\u00a0as\u00a0an\u00a0interim\u00a0measure\u00a0that\u00a0the\u00a0Chancellor \u00a0<br \/>\n        may\u00a0reconsider\u00a0his\u00a0direction\u00a0for\u00a0holding\u00a0of\u00a0fresh\u00a0Selection\u00a0Committee\u00a0in \u00a0<br \/>\n        view \u00a0 of \u00a0 the \u00a0 pleadings \u00a0 of \u00a0 the \u00a0 writ \u00a0 petition \u00a0 and \u00a0 also \u00a0 in \u00a0 view \u00a0 of \u00a0 the \u00a0<br \/>\n        arguments\u00a0raised\u00a0before\u00a0us\u00a0which\u00a0have\u00a0been\u00a0referred\u00a0to\u00a0above.\u00a0We\u00a0expect \u00a0<br \/>\n        that \u00a0a\u00a0period \u00a0of\u00a0four \u00a0weeks \u00a0will \u00a0be \u00a0sufficient \u00a0for \u00a0this\u00a0purpose \u00a0for \u00a0the \u00a0<br \/>\n        Chancellor\u00a0to\u00a0take\u00a0a\u00a0decision.\u00a0We\u00a0direct\u00a0that\u00a0in\u00a0the\u00a0meantime\u00a0the\u00a0later \u00a0<br \/>\n        portion\u00a0of\u00a0the\u00a0order\u00a0dated\u00a03.7.2007\u00a0in\u00a0which\u00a0direction\u00a0for\u00a0holding\u00a0fresh \u00a0<br \/>\n        meeting\u00a0has\u00a0been\u00a0given,\u00a0shall\u00a0remain\u00a0in\u00a0abeyance.&#8221;\n<\/p>\n<p>       The\u00a0matter\u00a0was\u00a0reconsidered\u00a0by\u00a0the\u00a0Chancellor.\u00a0By\u00a0his\u00a0decision\u00a0dated\u00a0<br \/>\n22.1.2008,\u00a0the\u00a0Chancellor\u00a0has\u00a0reiterated\u00a0his\u00a0earlier\u00a0view\u00a0and\u00a0has\u00a0directed\u00a0the\u00a0<br \/>\nUniversity\u00a0to\u00a0act\u00a0accordingly.\n<\/p>\n<p>       Learned\u00a0counsel\u00a0for\u00a0petitioners\u00a0has\u00a0challenged\u00a0both\u00a0the\u00a0orders\u00a0of\u00a0the\u00a0<br \/>\nChancellor\u00a0on\u00a0the\u00a0grounds,\u00a0that\u00a0by\u00a0Government\u00a0Order\u00a0dated\u00a016.1.2007\u00a0the\u00a0<br \/>\namendment\u00a0to\u00a0the\u00a0paragraph\u00ad14\u00a0of\u00a0the\u00a0&#8216;Career\u00a0Advancement\u00a0Scheme&#8217;\u00a0dated\u00a0<br \/>\n3.5.2001 \u00a0 (also \u00a0 incorporated \u00a0 as \u00a0 Statute \u00a0 11.24 \u00a0 of \u00a0 the \u00a0 Statutes \u00a0 of \u00a0 Lucknow\u00a0<br \/>\nUniversity),\u00a0was\u00a0approved\u00a0by\u00a0the\u00a0Chancellor\u00a0on\u00a016.6.2007.\u00a0The\u00a0amendment\u00a0<br \/>\ndid\u00a0 not\u00a0 make\u00a0 any\u00a0 difference\u00a0 to \u00a0 the\u00a0 eligibility\u00a0 and\u00a0 the\u00a0 right\u00a0 of \u00a0 the\u00a0 eligible\u00a0<br \/>\ncandidates\u00a0to\u00a0be\u00a0considered\u00a0for\u00a0promotion.\u00a0The\u00a0only\u00a0change\u00a0brought\u00a0about\u00a0by\u00a0<br \/>\nthe\u00a0amendment\u00a0is\u00a0that\u00a0whereas\u00a0in\u00a0the\u00a0unamended\u00a0para\u00a014\u00a0the\u00a0next\u00a0higher\u00a0<br \/>\ngrade\u00a0was\u00a0admissible\u00a0from\u00a0the\u00a0date\u00a0of\u00a0eligibility,\u00a0or\u00a027.7.1998,\u00a0whichever\u00a0is\u00a0<br \/>\nlater,\u00a0\u00a0but\u00a0the\u00a0designation\u00a0(if\u00a0any)\u00a0was\u00a0to\u00a0be\u00a0given\u00a0from\u00a0the\u00a0date\u00a0of\u00a0taking\u00a0over\u00a0<br \/>\ncharge;\u00a0the\u00a0amendment\u00a0made\u00a0on\u00a0the\u00a0recommendation\u00a0of\u00a0the\u00a0University\u00a0Grants\u00a0<br \/>\n<span class=\"hidden_text\">                                                3<\/span><\/p>\n<p>Commission \u00a0 provides \u00a0 for \u00a0 grant \u00a0 of \u00a0 both \u00a0 the \u00a0 next \u00a0 higher \u00a0 grade \u00a0 as \u00a0 well \u00a0 as\u00a0<br \/>\ndesignation \u00a0 to \u00a0 be \u00a0 admissible \u00a0 from \u00a0 the \u00a0 date \u00a0 of \u00a0 eligibility \u00a0 or \u00a0 27.7.1998,\u00a0<br \/>\nwhichever\u00a0is\u00a0later.\n<\/p>\n<p>        It\u00a0is\u00a0submitted\u00a0that\u00a0the\u00a0amendment\u00a0will\u00a0not\u00a0make\u00a0any\u00a0difference\u00a0to\u00a0the\u00a0<br \/>\nselections\u00a0 made\u00a0 prior\u00a0 to\u00a0 the\u00a0 amendment,\u00a0 \u00a0 under\u00a0 the\u00a0 &#8216;Career\u00a0 Advancement\u00a0<br \/>\nScheme&#8217;.\u00a0 It\u00a0 will\u00a0 only\u00a0 make\u00a0 a \u00a0 difference\u00a0 to \u00a0 the \u00a0 admissibility\u00a0 of \u00a0 designation\u00a0<br \/>\nfrom\u00a0the\u00a0date\u00a0of\u00a0eligibility\u00a0or\u00a027.7.1998,\u00a0whichever\u00a0is\u00a0later.\u00a0In\u00a0the\u00a0case\u00a0of\u00a0all\u00a0<br \/>\nthe\u00a0petitioners\u00a0they\u00a0will\u00a0get\u00a0the\u00a0promotions\u00a0from\u00a0the\u00a0date\u00a0of\u00a0eligibility,\u00a0as\u00a0all\u00a0<br \/>\nof\u00a0them\u00a0were\u00a0eligible\u00a0for\u00a0promotions.\n<\/p>\n<p>        Shri\u00a0Alok\u00a0Mathur\u00a0appearing\u00a0for\u00a0Chancellor\u00a0would\u00a0submit\u00a0that\u00a0since\u00a0the\u00a0<br \/>\namendment\u00a0was\u00a0proposed\u00a0and\u00a0was\u00a0under\u00a0consideration\u00a0of\u00a0the\u00a0Vice\u00a0Chancellor,\u00a0<br \/>\nthe\u00a0Selection\u00a0Committee\u00a0could\u00a0not\u00a0be\u00a0held\u00a0prior\u00a0to\u00a0the\u00a0consideration\u00a0of\u00a0the\u00a0<br \/>\namendment. \u00a0 He \u00a0 would \u00a0 submit \u00a0 that \u00a0 the \u00a0 amendment \u00a0 may \u00a0 not \u00a0 affect \u00a0 the\u00a0<br \/>\neligibility\u00a0of\u00a0the\u00a0petitioners,\u00a0or\u00a0the\u00a0proceedings\u00a0of\u00a0the\u00a0Selection\u00a0Committee\u00a0but\u00a0<br \/>\nthat \u00a0 the \u00a0 resultant \u00a0 benefit \u00a0 could \u00a0 be \u00a0 given \u00a0 only \u00a0 after \u00a0 the \u00a0 amendment \u00a0 was\u00a0<br \/>\napproved\u00a0by\u00a0the\u00a0Chancellor.\n<\/p>\n<p>        Learned\u00a0counsel\u00a0appearing\u00a0for\u00a0the\u00a0University\u00a0has\u00a0not\u00a0denied\u00a0that\u00a0the\u00a0<br \/>\namended \u00a0 &#8216;Career \u00a0 Advancement \u00a0 Scheme&#8217; \u00a0 was \u00a0 in \u00a0 vogue, \u00a0 prior \u00a0 to \u00a0 the\u00a0<br \/>\namendment,\u00a0\u00a0and\u00a0that\u00a0\u00a0the\u00a0pendency\u00a0of\u00a0the\u00a0proposal\u00a0of\u00a0the\u00a0amendments\u00a0and\u00a0<br \/>\nits \u00a0 approval \u00a0 by \u00a0 the \u00a0 Chancellor, \u00a0 will \u00a0 not \u00a0 make \u00a0 any \u00a0 difference \u00a0 to \u00a0 the\u00a0<br \/>\nrecommendations\u00a0made\u00a0by\u00a0the\u00a0Selection\u00a0Committee.\n<\/p>\n<p>        After \u00a0 hearing \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 parties, \u00a0 we \u00a0 find \u00a0 that \u00a0 the \u00a0 then\u00a0<br \/>\nChancellor\u00a0appears\u00a0to\u00a0have\u00a0taken\u00a0the\u00a0\u00a0decision\u00a0under\u00a0an\u00a0impression\u00a0that\u00a0prior\u00a0<br \/>\nto \u00a0 the \u00a0 amendment \u00a0 there \u00a0 was \u00a0 no \u00a0 provision \u00a0 for \u00a0 \u00a0 the \u00a0 &#8216;Career \u00a0 Advancement\u00a0<br \/>\nScheme&#8217;\u00a0and\u00a0that\u00a0the\u00a0Selection\u00a0Committee\u00a0could\u00a0not\u00a0be\u00a0convened\u00a0to\u00a0make\u00a0<br \/>\nselections \u00a0 and \u00a0 recommendations \u00a0 for \u00a0 appointments. \u00a0 He \u00a0 has \u00a0 not \u00a0 taken \u00a0 into\u00a0<br \/>\nconsideration \u00a0 the \u00a0 observations \u00a0 made \u00a0 by \u00a0 the \u00a0 Court \u00a0 in \u00a0 the \u00a0 order \u00a0 dated\u00a0<br \/>\n25.10.2007\u00a0and\u00a0the\u00a0\u00a0&#8216;Career\u00a0Advancement\u00a0Scheme&#8217;\u00a0\u00a0issued\u00a0on\u00a013.5.2001\u00a0w.e.f.\u00a0<br \/>\n27.7.1998.\u00a0\n<\/p>\n<p>        It \u00a0 is \u00a0 also \u00a0 not \u00a0 denied \u00a0 by \u00a0 the \u00a0 respondents \u00a0 that \u00a0 the \u00a0 petitioners \u00a0 were\u00a0<br \/>\neligible\u00a0to\u00a0be\u00a0considered\u00a0and\u00a0that\u00a0the\u00a0recommendations\u00a0made\u00a0by\u00a0the\u00a0Selection\u00a0<br \/>\nCommittee\u00a0 were\u00a0valid.\u00a0The\u00a0 &#8216;Career\u00a0 Advancement\u00a0Scheme&#8217;\u00a0was\u00a0 in\u00a0 existence\u00a0<br \/>\nsince \u00a0 3.5.2001 \u00a0 w.e.f. \u00a0 27.7.1998. \u00a0 The \u00a0 pendency \u00a0 of \u00a0 the \u00a0 proposal \u00a0 of \u00a0 the\u00a0<br \/>\namendment \u00a0 in \u00a0 the \u00a0 scheme \u00a0 could \u00a0 not \u00a0 have \u00a0 taken \u00a0 away \u00a0 the \u00a0 right \u00a0 of \u00a0 the\u00a0<br \/>\npetitioners\u00a0to\u00a0be\u00a0considered\u00a0by\u00a0the\u00a0Selection\u00a0Committee\u00a0constituted\u00a0by\u00a0the\u00a0<br \/>\nUniversity \u00a0 in \u00a0 accordance \u00a0 with \u00a0 the \u00a0 then \u00a0 existing \u00a0 provisions, \u00a0 when \u00a0 all \u00a0 the\u00a0<br \/>\npetitioners\u00a0had\u00a0become\u00a0eligible\u00a0to\u00a0be\u00a0promoted\u00a0as\u00a0Professors\u00a0under\u00a0the\u00a0&#8216;Career\u00a0<br \/>\nAdvancement\u00a0Scheme&#8217;,\u00a0on\u00a027.7.2006,\u00a0and\u00a0that\u00a0both\u00a0the\u00a0Selection\u00a0Committees\u00a0<br \/>\n<span class=\"hidden_text\">                                               4<\/span><\/p>\n<p>were\u00a0constituted\u00a0after\u00a0the\u00a0date\u00a0of\u00a0their\u00a0entitlement,\u00a0i.e.\u00a0after\u00a027.7.2006.\u00a0The\u00a0<br
