Sethi\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>SHAH, J.\n<\/p>\n<p>\tLeave granted.\n<\/p>\n<p>\tIn these appeals the appellant has challenged the order dated<br \/>\n5.12.2000 passed by the High Court of Punjab and Haryana at Chandigarh in<br \/>\nC.W.P. No. 5428 of 2000 and order dated 22nd December, 2000 passed in<br \/>\nReview Application C.M. No. 31005 of 2000 in C.W.P. No.5428 of 2000.<br \/>\nBy the impugned order, the High Court allowed the petition filed by<br \/>\nRespondent No.1 Gurmeet Singh Sidhu and held that he was eligible for<br \/>\nconsideration for the post of Lecturer in Sociology and as he was not<br \/>\ninterviewed, directions were issued to hold his interview for the said post.  It<br \/>\nwas also further held that if respondent No.1 was found to be better on merit<br \/>\nthan the selected candidate, the appointing authority will take necessary<br \/>\nsteps in that behalf.\n<\/p>\n<p>\tAt the time of hearing, learned counsel for the appellant, who was<br \/>\nselected and appointed to the post of  lecturer and whose selection is set<br \/>\naside in pursuance of the aforesaid directions, submitted that respondent was<br \/>\nnot selected as he was not having qualifications prescribed by the UGC for<br \/>\nthe said post.\n<\/p>\n<p>\tAs against this, learned counsel for respondent No.1 submitted that<br \/>\nrespondent was duly qualified and the direction issued by the High Court is<br \/>\non the basis of qualifications prescribed by the Punjabi University.  At the<br \/>\ntime of hearing of this matter, none appeared for the Punjabi University and<br \/>\nthe learned counsel who has filed his appearance for the State of Punjab<br \/>\nsubmitted that he was not having any instructions.\n<\/p>\n<p>\tFor appreciating the issue involved, we would refer to the<br \/>\nadvertisement (Annexure P3) dated 22nd October, 1999 which provides for<br \/>\nqualifications for the post in question.  The relevant part is as under:\n<\/p>\n<p>7.  Lecturer in Sociology   One on regular basis<\/p>\n<p>8 to 19 xx\txx\txx\t\txx\txx<\/p>\n<p>Qualification and Grade as per UGC\/Punjabi<br \/>\nUniversity rules.  Enclose Bank Draft of Rs.100\/-<br \/>\nfor the post of Lecturer and Rs.50\/- for the other<br \/>\nposts in favour of Principal Khalasa College,<br \/>\nPatiala alongwith attested copies within 15 days<br \/>\nfrom the date of the publication.  For the post of<br \/>\nLecturer application may only be sent to Dean<br \/>\nCollege Development Council, Punjabi University,<br \/>\nPatiala.  Applications be addressed in the name of<br \/>\nPrincipal, Khalasa College, Patiala.  The<br \/>\ncandidates who have already sent applications in<br \/>\nresponse to advertisement published in English and<br \/>\nPunjabi Tribune dated 3.6.99 need not send<br \/>\napplication again.  Their earlier application will be<br \/>\nconsidered.\n<\/p>\n<p>\tAs per the said advertisement, required qualification is as prescribed<br \/>\nby the UGC rules and the Punjabi University rules.\n<\/p>\n<p>\tIn the written statement filed on behalf of respondent-University<br \/>\nbefore the High Court,\tit has been specifically stated that respondent no.1<br \/>\nhas suppressed from the High Court the fact that qualifications for<br \/>\nappointment to the post of lecturer were amended and an amendment was<br \/>\ncirculated to all colleges vide Circular dated 18th May, 1999. As per the said<br \/>\nCircular, a candidate was eligible to be appointed as a lecturer in Sociology<br \/>\nif he had cleared the eligibility test, namely, NET for lecturers conducted by<br \/>\nUGC, CSIR or similar test accredited by the University.\t It was also pointed<br \/>\nout that Punjabi University, Patiala had received a letter dated 21st<br \/>\nSeptember, 1999 signed by the UGC to the effect that NET examination was<br \/>\ncompulsory for a person to be appointed as a lecturer and only the<br \/>\ncandidates who had completed their M.Phil or submitted their Ph.D thesis up<br \/>\nto December 31, 1993 were exempted from passing the NET examinations.<br \/>\nThe University further submitted that as per the advertisement appointment<br \/>\nwas to be made on the basis of the qualifications prescribed by the Punjabi<br \/>\nUniversity\/UGC.\t The respondent no.1 was not fulfilling the above<br \/>\nqualifications, therefore, he was rightly not appointed.\n<\/p>\n<p>\tFurther the appellant has produced a letter (Annexure P1) dated 18th<br \/>\nMay, 1999 circulated by the University which, inter alia, provides that<br \/>\nbesides fulfilling the above qualifications, candidates should have cleared<br \/>\nthe eligibility test (NET) for lecturers conducted by the UGC, CSIR or<br \/>\nsimilar test accredited by the UGC.\n<\/p>\n<p>From the facts stated above, the High Court held that the<br \/>\nadvertisement requires that the qualifications of a candidate should be as<br \/>\nlaid down by the University\/UGC and this would mean that if the<br \/>\nqualifications have not been laid down by the University, the qualification<br \/>\nwould be the one which may have been laid down by the UGC.  The High<br \/>\nCourt observed that University has laid down the qualifications for the post<br \/>\nin question by a notification dated 24th March, 1999.  This reasoning of the<br \/>\nHigh Court ignores the written statement filed on behalf of the University<br \/>\nclarifying that Punjabi University, Patiala had amended the qualifications for<br \/>\nappointment of lecturers and had circulated the same by letter dated 18th<br \/>\nMay, 1999 to the affiliated colleges.  Further Respondent No.1 has applied<br \/>\nfor the post of Lecturer on the basis of the said advertisement and it was not<br \/>\nopen to him to contend that he was not required to fulfil the qualifications<br \/>\nprescribed by the UGC. Admittedly, he was not eligible as per the<br \/>\nqualifications prescribed by the U.G.C. as he has not cleared NET.  The<br \/>\nHigh Court materially erred in ignoring the circular issued by letter dated<br \/>\n18th May, 1999 by observing that unless University adopts the<br \/>\nrecommendations of the UGC, it would not become applicable to the<br \/>\nUniversity and without adopting the same by the Syndicate, Circular was<br \/>\nissued by the University.\n<\/p>\n<p>Learned counsel for the respondent No.1 submitted that the High<br \/>\nCourt has rightly arrived at the conclusion that recommendations of the<br \/>\nUGC were adopted by the Syndicate of the University on 29th June, 2000<br \/>\nand, therefore, it would be applicable to the University and to the affiliated<br \/>\ncolleges after the said date.  In our view, this submission ignores the fact that<br \/>\nthe advertisement dated 22nd October, 1999 issued by the College<br \/>\nspecifically provided that candidate must be eligible as per the qualifications<br \/>\nprescribed by the UGC and the University.  That advertisement was as per<br \/>\nCircular dated 18th May, 1999 by which all the non-government colleges<br \/>\naffiliated to the University were informed that qualification for appointment<br \/>\nto the post of lecturer was as per the UGC qualifications and the candidate<br \/>\nmust have cleared the eligibility test, that is, NET for lecturer conducted by<br \/>\nthe UGC, CSIR or similar test accredited by the UGC.  Learned counsel for<br \/>\nthe appellant has also produced on record the Interview Call Letter<br \/>\n(Annexure P5) dated 8th March 2000 written to respondent No.1 which<br \/>\nspecifically provides that passing of UGC test is necessary  or that candidate<br \/>\nmust be M.Phil before December 1993 and at the time of coming for<br \/>\ninterview, he must satisfy that he was having necessary qualifications.\t After<br \/>\naccepting interview call and applying on the basis of advertisement it was<br \/>\nnot open to respondent No. 1 to contend that the University had no power to<br \/>\ncirculate to all colleges the Circular dated 18th May, 1999.  Further, it is<br \/>\nstated that there is nothing to record to show that prior to the decision dated<br \/>\n29th June, 2000 taken by the Syndicate, it has earlier not prescribed<br \/>\nqualifications for the post of lecturers.  The resolution of the Syndicate<br \/>\nwhich is produced on record only reiterates the previous position and<br \/>\nprovides that NET shall remain the compulsory requirement for appointment<br \/>\nas lecturer even for candidates having Ph. D. degree.  Relevant part of the<br \/>\nresolution is as under: &#8211;\n<\/p>\n<p>\tNET shall remain the compulsory requirement for<br \/>\nappointment as Lecturer even for candidates having<br \/>\nPh.D. degree.  However, the candidate who have<br \/>\ncompleted M. Phil. Degree or have submitted Ph. D.<br \/>\nthesis in the concerned subject up to 31st December,<br \/>\n1993, are exempted from appearing in the NET<br \/>\nexamination.\n<\/p>\n<p>Therefore, it cannot be said that for the first time NET qualification<br \/>\nwas introduced by the Syndicate or prior to 29th June, 2000, the said<br \/>\nqualification was not compulsory.  Further, we would only mention that the<br \/>\nlearned counsel for the appellant has pointed out that UGC (Qualifications<br \/>\nRequired of a Person to be Appointed to the Teaching Staff of a University<br \/>\nand Institutions Affiliated to it) Regulations, 1991 as amended in 1995 do<br \/>\nlay down that for appointment as lecturer in a college, the candidates apart<br \/>\nfrom possessing prescribed academic qualifications, should have cleared the<br \/>\neligibility test for lecturers conducted by the UGC, CSIR or similar test<br \/>\naccredited by the UGC.\tAs this was not pointed out to the High Court, it is<br \/>\nnot required to be dealt with or decided in this appeal.\n<\/p>\n<p>For the reasons stated above, the order passed by the High Court<br \/>\ncannot be sustained.  The impugned order passed by the High Court is<br \/>\nquashed and set-aside.\tIt is held that respondent no.1 Gurmeet Singh Sidhu<br \/>\nwas not eligible to be appointed as lecturer and that appellant was properly<br \/>\nappointed to the post of lecturer Sociology by respondent No.4 Khalasa<br \/>\nCollege, Patiala.  Hence, appeals are allowed.\tThere shall be no order as to<br \/>\ncosts.\n<\/p>\n<p>\t\t\t\t\t\t   &#8230;.J.\n<\/p>\n<p>\t\t\t\t\t\t (M.B.
