With<\/p>\n<p>                       the consent of the party, this application is being disposed of at<\/p>\n<p>                       this stage itself.\n<\/p>\n<p>                                    Learned counsel for the petitioners submit that the<\/p>\n<p>                       evidence available on record would indicate that both the parties<\/p>\n<p>                       are agnates. Referring to the prosecution case, it is contended that<\/p>\n<p>                       on a trivial issue the occurrence is said to have taken place. It is<\/p>\n<p>                       further submitted that petitioner no.1, namely Bir Chandra Sah is<\/p>\n<p>                       the father of petitioner no.2, namely Ranjeet @ Jwala Prasad.<\/p>\n<p>                       Referring to the evidence on record, learned counsel for the<\/p>\n<p>                       petitioners submits that petitioner no.1 is related to the informant<\/p>\n<p>                       as &#8216;Bhaisur&#8217; (brother -in-law). With reference to the evidence of<\/p>\n<p>                       the defence witness, it is pointed out that prior to the present<\/p>\n<p>                       occurrence, there was some land dispute between the parties. Both<\/p>\n<p>                       the petitioners have been convicted under Sections 323, 341 and<\/p>\n<p>                       379 of the Penal Code, and sentenced to undergo S.I. for six<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>      months, one month and 18 months respectively. They have also<\/p>\n<p>      been imposed a fine of Rs. five hundred with default clause. The<\/p>\n<p>      appeal preferred by them stood rejected as the appellate Court did<\/p>\n<p>      not find any illegality, irregularity and\/ or impropriety in the<\/p>\n<p>      judgment and order of conviction and the sentence(s) recorded by<\/p>\n<p>      the learned trial Court. It appears from the two judgments that<\/p>\n<p>      petitioner no.1 is fairly aged person whereas petitioner no.2 is a<\/p>\n<p>      boy aged about 24-25 years.\n<\/p>\n<p>                  Learned A.P.P. appearing on behalf of the State has<\/p>\n<p>      not been able to demonstrate from the record that they were earlier<\/p>\n<p>      convicted for any offence. Learned trial Court has also not<\/p>\n<p>      recorded the said finding.\n<\/p>\n<p>                  Having considered the aforesaid aspects of the matter,<\/p>\n<p>      I am of the view that the following sentences shall sub serve the<\/p>\n<p>      ends of justice:-\n<\/p>\n<p>                  The sentence recorded under Section 379 of the Penal<\/p>\n<p>      Code is reduced to a period of nine months. The sentences<\/p>\n<p>      recorded under Sections 323 and 341 of the Penal Code are<\/p>\n<p>      untouched. The imposition of fine of Rs. five hundred with default<\/p>\n<p>      clause is also not interfered with.\n<\/p>\n<p>                  With the aforesaid modification in the sentences the<\/p>\n<p>      application is dismissed.\n<\/p>\n<\/p>\n<pre>Sym                                         ( Kishore K.
