SHAH\n\t\t\n\t\n\n \n\nDate\n: 03\/08\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tPresent<br \/>\napplication under Section 482 of the Code of Criminal Procedure, 1973<br \/>\n(hereinafter referred to as &#8220;CrPC&#8221;) has been preferred by<br \/>\nthe applicant &#8211; husband to quash and set aside the impugned<br \/>\njudgment and order dated 31.05.2011 passed by the learned Sessions<br \/>\nJudge, Panchmahals in Criminal Revision Application No.103\/2010 as<br \/>\nwell as the order dated 28.09.2010 passed by the learned JMFC, Kalol<br \/>\nin Criminal Revision Application No.148\/2008, by which the applicant<br \/>\nis directed to pay a sum of Rs.800\/- per month only to respondent<br \/>\nNo.2 &#8211; wife towards maintenance.\n<\/p>\n<p>2.\tHaving<br \/>\nheard Shri Manav Mehta, learned advocate appearing on behalf of the<br \/>\napplicant and considering the impugned orders passed by both the<br \/>\nCourts below and considering the fact that only a sum of Rs.800\/- per<br \/>\nmonth is awarded by way of maintenance to respondent wife, no case is<br \/>\nmade out to interfere with the orders passed by both the Courts<br \/>\nbelow.  There are concurrent findings given by both the Courts below<br \/>\nwith respect to the income as well as desertion by the applicant<br \/>\nwhich are not required to be interfered by this Court in exercise of<br \/>\npowers under Article 227 read with Section 482 of the CrPC.  On the<br \/>\ncontrary, looking to the price rise and value of money etc., amount<br \/>\nof Rs.800\/- per month only towards maintenance can be said to be on<br \/>\nlower side.
