     The writ petitions have been heard and decided today<\/p>\n
itself because of the reason that several similar writ<\/p>\n
petitions have already been disposed of and one of which is<\/p>\n
SBCWP No.3835\/2009 – Kanwar Lal & Ors. Vs. State of
\n                                           3<\/span><\/p>\n
            Rajasthan & Ors., decided on 19th May, 2009.<\/p>\n
                 Accordingly, these writ petitions are also disposed of in<\/p>\n
            terms of the judgment referred above with following order:-<\/p>\n
                 (1)The    automatic    termination     orders     of     the<\/p>\n
                   petitioner\/s are set aside. The respondents are<\/p>\n
                   directed to continue the petitioner\/s in service till<\/p>\n
                   regularly selected candidates by regular mode of<\/p>\n
                   recruitment are made available.\n<\/p><\/blockquote>\n
                 (2)The petitioner\/s shall not be entitled for wages<\/p>\n
                   relating to the period of vacations; and<\/p>\n
                 (3)On availability of the selected candidates by regular<\/p>\n
                   mode    of   recruitment,   may    that   be   by    direct<\/p>\n
                   recruitment or by way of promotion, it shall be open<\/p>\n
                   for the respondents to terminate the Vidhyarthi<\/p>\n
                   Mitras by adhering the principles of “last come first<\/p>\n
                   go”, by determining their seniority at State level.<\/p>\n<\/blockquote>\n
