SANKARAN, J.\n\n             ---------------------------------\n\n                    B.A. NO. 2333 OF  2007\n\n             ---------------------------------\n\n            Dated this the 17th day of April, 2007\n\n\n\n                           O R D E R\n<\/pre>\n<p>     This   is   an   application     under   Section   438   of   the<\/p>\n<p>Code   of   Criminal   Procedure   for   granting   anticipatory<\/p>\n<p>bail.\n<\/p>\n<p>     2.     The   petitioners   are   the   accused   in   Crime<\/p>\n<p>No.257   of   2006,   Kareelakulangara   Police   Station.     The<\/p>\n<p>offences   alleged   against   the   petitioners   are   under<\/p>\n<p>Sections 294(b), 354, 427 and 452 read with Section 34<\/p>\n<p>of the Indian Penal Code.\n<\/p>\n<p>           3.  Learned Public Prosecutor submits that the<\/p>\n<p>final   report   is   filed   on   29.11.2006   and   the   case   is<\/p>\n<p>pending   as   C.C.No.780   of   2006,   on   the   file   of   the<\/p>\n<p>Judicial   Magistrate   of   the   First   Class,   Haripad.     The<\/p>\n<p>petitioners   are  respectively  accused  Nos.2,  3  and  1  in<\/p>\n<p>the   case.     The   learned   Public   Prosecutor   also   submits<\/p>\n<p>that   since  the  petitioners  failed  to  appear  before  the<\/p>\n<p>B.A.NO.   2333  OF 2007<\/p>\n<p>                                 ::  2  ::\n<\/p>\n<p>court   below,   non-bailable   warrant   was   issued   against<\/p>\n<p>the petitioners.\n<\/p>\n<p>        4.   In the light of the facts and circumstances as<\/p>\n<p>disclosed and the submission made by the learned Public<\/p>\n<p>Prosecutor,   it  is  for  the  petitioners  to  appear  before<\/p>\n<p>the   court   below     and   apply   for   regular   bail.
