Justice R.BASANT\n\n Dated :31\/10\/2007\n\n O R D E R\n                          R.BASANT, J.\n                       ----------------------\n                       B.A.No.6653 of 2007\n                   ----------------------------------------\n           Dated this the 31st day of October 2007\n\n                              O R D E R\n<\/pre>\n<p>      Application for anticipatory bail.                 The petitioners are<\/p>\n<p>spouses. They face allegations under Section 420 read with 34<\/p>\n<p>I.P.C. The crime has been registered on the basis of a private<\/p>\n<p>complaint filed by a bank which had offered a loan for purchase<\/p>\n<p>of a car. The crux of the allegations is that the car purchased by<\/p>\n<p>the petitioners was disposed of by the petitioners without<\/p>\n<p>making it available to the complainant to proceed for recovery of<\/p>\n<p>the amount.\n<\/p>\n<p>      2.   The learned counsel for the petitioners prays, the<\/p>\n<p>learned Public Prosecutor does not oppose the said prayer and I<\/p>\n<p>am satisfied that the petitioners can be granted anticipatory bail<\/p>\n<p>subject to appropriate terms and conditions.<\/p>\n<p>      3.   In the result, this petition is allowed.                Following<\/p>\n<p>directions are issued under Section 438 Cr.P.C in favour of the<\/p>\n<p>petitioners.\n<\/p>\n<p>      i)   Petitioners    shall     surrender         before  the    learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on 07\/11\/2007. They<\/p>\n<p><span class=\"hidden_text\">B.A.No.6653\/07                   2<\/span><\/p>\n<p>shall be released on regular bail on condition that they execute<\/p>\n<p>bonds for Rs.25,000\/-(Rupees twenty five thousand only) each<\/p>\n<p>with two solvent sureties each for the like sum to the satisfaction<\/p>\n<p>of the learned Magistrate.\n<\/p>\n<p>      ii)   The petitioners shall make themselves available for<\/p>\n<p>interrogation before the investigating officer between 10 a.m<\/p>\n<p>and 3 p.m on 08\/11\/2007 and 09\/11\/2007 and thereafter as and<\/p>\n<p>when directed by the investigating officer in writing to do so.<\/p>\n<p>      (iii) If the petitioners do not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to<\/p>\n<p>arrest the petitioners and deal with them in accordance with law,<\/p>\n<p>as if these directions were not issued at all.<\/p>\n<p>      (iv) If they were arrested prior to 07\/11\/2007, they shall<\/p>\n<p>be released from custody on their executing a bond for<\/p>\n<p>Rs.25,000\/- (Rupees twenty five thousand only) without any<\/p>\n<p>sureties, undertaking to appear before the learned Magistrate on<\/p>\n<p>07\/11\/2007.\n<\/p>\n<\/p>\n<p>                                             (R.BASANT, JUDGE)<br \/>\njsr<\/p>\n<p><span class=\"hidden_text\">B.A.No.6653\/07    3<\/span><\/p>\n<p><span class=\"hidden_text\">B.A.No.6653\/07    4<\/span><\/p>\n<p>       R.BASANT, J.\n<\/p>\n<p>         CRL.M.CNo.\n<\/p>\n<p>            ORDER<\/p>\n<p>21ST DAY OF MAY2007<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Reeja vs The Sub Inspector Of Police on 31 October, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 6653 of 2007(R) 1.
