On account of one incident of misconduct with school girl<br \/>\n\t\tstudying in Std.IX  by the petitioner, pursuant to which one<br \/>\n\t\tletter\/notice issued to the petitioner on 2.7.1996.\n<\/p>\n<p>   The<br \/>\n\t\tpetitioner vide his letter dated 13.7.96 replied to the notice.<br \/>\n\t\tHowever, on 26.11.1997 inquiry was initiated against the petitioner<br \/>\n\t\tand inquiry report was submitted. Out of three members of the<br \/>\n\t\tInquiry Committee, two members have exonerated the petitioner from<br \/>\n\t\tall the charges levelled against him.\n<\/p>\n<p>    On<br \/>\n\t\t29.11.97, show-cause notice was issued to the petitioner to which<br \/>\n\t\tpetitioner replied on 8.12.1997. The proposal thereafter was sent<br \/>\n\t\tby the school management to the District Education Officer and on<br \/>\n\t\t25.2.98 without following due process of law under Section 36 of<br \/>\n\t\tthe Act, petitioner was dismissed from the service.\n<\/p>\n<p>    Being<br \/>\n\t\taggrieved by the dismissal order, petitioner preferred Application<br \/>\n\t\tNo.147 of 1998 before the Hon&#8217;ble Tribunal which came to have been<br \/>\n\t\tdismissed by the Tribunal on 18.10.2007.\n<\/p>\n<p>    Being<br \/>\n\t\taggrieved by the order of dismissal dated 18.10.2007 passed by the<br \/>\n\t\tTribunal, the petitioner has approached this Court by way of filing<br \/>\n\t\tthe present petition.\n<\/p>\n<p>The<br \/>\n\tlearned Advocate for the petitioner has submitted that two members<br \/>\n\tout of three of the Inquiry Committee have exonerated him from the<br \/>\n\tcharges levelled against him. The learned advocate has submitted<br \/>\n\tthat on the date of alleged incident of misbehaviour with Ms.Pragati<br \/>\n\tSukani i.e. 26.6.1996, the petitioner was on duty leave and hence,<br \/>\n\tthe statement of Ms.Pragati Sukani should not be believed and taken<br \/>\n\tinto consideration as emphasized by the District Education Officer<br \/>\n\toverlooking the inquiry report submitted by the school management to<br \/>\n\thim. The learned Advocate has also submitted that the Tribunal while<br \/>\n\tpassing the order of dismissal of the petitioner has not given<br \/>\n\treasoned order.\n<\/p>\n<p>The<br \/>\n\tlearned advocate Ms.Tejal Vashi who appears on caveat has submitted<br \/>\n\tthat the Tribunal has rightly passed the order of dismissal against<br \/>\n\tthe petitioner after going through all materials scrutinized by the<br \/>\n\tInquiry Committee. The learned advocate has submitted that the order<br \/>\n\tof dismissal passed by the Tribunal does not require any<br \/>\n\tinterference by this Hon&#8217;ble Court since it is passed in its true<br \/>\n\tspirit. The learned advocate has drawn attention of the Court to<br \/>\n\tpage-53 of the petition which is a compromise arrived at between the<br \/>\n\tpetitioner and the school management wherein the petitioner<br \/>\n\tundertook that he would leave the school.\n<\/p>\n<p>  I<br \/>\n\thave heard the learned counsel for both the sides and gone through<br \/>\n\tthe materials adduced before the Tribunal by the Inquiry Committee.<br \/>\n\tI am in complete agreement with the findings given by the learned<br \/>\n\tTribunal in its para-7 wherein he has given reasons in detail while<br \/>\n\trejecting the application of the petitioner.  It is also to be noted<br \/>\n\tthat the charges against the petitioner are of very serious nature<br \/>\n\tand in such a case no person like the petitioner should have to<br \/>\n\tcontinue with any school management emphasizing the safety major of<br \/>\n\tstudents studying in such school.
