PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\nDate\n: 29\/10\/2010 \n\n \n\n \n ORAL\nORDER<\/pre>\n<p>\tThis<br \/>\napplication is preferred under Section 439 of the Code of Criminal<br \/>\nProcedure, 1973 seeking regular bail by the applicant, who came to be<br \/>\narrested in connection with FIR registered as C.R. No. I &#8211; 1 of<br \/>\n2010 with DCB  Police Station for the offence punishable under<br \/>\nSections 406, 467, 468, 471, 201 and 114 of the Indian Penal Code.\n<\/p>\n<p>\tThis<br \/>\nis a successive bail application. Earlier, the applicant had<br \/>\npreferred Criminal Misc. Application No. 3257 of 2010 through<br \/>\nAdvocate Mr. Sikander Saiyed. The matter was argued at length and the<br \/>\nsame was rejected by a speaking order dated 26.04.2010.  Thereafter<br \/>\nthe applicant has preferred the present application through another<br \/>\nadvocate.\n<\/p>\n<p>\tIn<br \/>\nthe order dated 26.04.2010 passed in Criminal Misc. Application No.<br \/>\n3257 of 2010 this Court has observed as under:\n<\/p>\n<p>&#8220;I<br \/>\nhave considered the role attributed to the applicant which is<br \/>\nreflected in the F.I.R. at Annexure A to the application. I have<br \/>\ncarefully taken into consideration the panchama of muddamal articles<br \/>\nseized by the investigating agency, F.S.L. report, statement of<br \/>\nwitnesses and other material produced for my perusal. The applicant<br \/>\nalong with the other accused was found in possession of gas cutter<br \/>\nand other instrument used for the purpose of changing the number<br \/>\nplates and tampering with the chasis number in garage. The F.S.L.<br \/>\nreport mentions tampering with chasis number and number plates of the<br \/>\nvehicles. Thus, considering the role attributed to the applicant,<br \/>\nnature of offence, manner in which the offence is committed by the<br \/>\napplicant along with the other accused, provisions of Sections 406,<br \/>\n467, 471, 201 and 114 of the Indian Penal Code and quantum of<br \/>\npunishment etc., I am of the view that the applicant is not entitled<br \/>\nto claim discretionary relief, as prayed for in the application.\n<\/p>\n<p>\tThe<br \/>\nabove application was also filed after filing of the charge sheet.<br \/>\nThe only subsequent change sought to be pressed into service by the<br \/>\napplicant is that a co-accused has been enlarged on bail by this<br \/>\nCourt, vide order dated 21.09.2010 passed in Criminal Misc.<br \/>\nApplication No. 8605 of 2010.  The same cannot be said to be a<br \/>\nsubsequent change, much less a substantial change.\n<\/p>\n<p>\tIn<br \/>\nthe circumstances, there is no merit in the application.
