Basheer, J.\n\n      - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                     O.P.No. 19982 OF 1995\n      - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 9th day of September, 2009\n\n                             JUDGMENT\n<\/pre>\n<p>Basheer, J.\n<\/p>\n<p>     Petitioner organisation viz, Bakel Samrakshana Samity,<\/p>\n<p>Kasaragode, claims that it has been constituted for the<\/p>\n<p>purpose of upholding the cause of local people who are<\/p>\n<p>against       &#8220;lop-sided      decision      making      process&#8221;.    The<\/p>\n<p>organisation further claims that it wants to preserve the<\/p>\n<p>historically important areas and prevent ecological and<\/p>\n<p>environmental degradation.\n<\/p>\n<p>     2. Petitioner has filed this Original Petition way back in<\/p>\n<p>the year 1995 as a Public Interest Litigation alleging that the<\/p>\n<p>proposed project envisaged by the Union of India and the<\/p>\n<p>State Government to implement a thousand Crore tourism<\/p>\n<p>project in Kasaragode District would result in destruction of<\/p>\n<p>ecology and also historical importance of the Bakel area. The<\/p>\n<p>prayers in the Original Petition are extracted hereunder:<\/p>\n<p>               &#8220;i. issue a writ certiorari to quash Exhibit P6, P7,<\/p>\n<p>O.P. No.19982 of 1995<br \/>\n<span class=\"hidden_text\">                                      -:2:-<\/span><\/p>\n<p>         P8, P9, P11, P12, P16 and P20.\n<\/p>\n<p>                ii.    issue a writ of mandamus directing the<\/p>\n<p>         respondents to forbear from the implementing the 1000<\/p>\n<p>         crore Bakel Tourism Project at Bakel, Kanhangad, Kasargod<\/p>\n<p>         District except after conducting the Environment Impact<\/p>\n<p>         Assessment,      carrying   capacity   study   and     coastal<\/p>\n<p>         Management Study.\n<\/p>\n<p>                iii. issue a writ of mandamus directing the 1st and 2nd<\/p>\n<p>         respondents constitute an Expert Committee constituting<\/p>\n<p>         veteran      environmentalists,   expert,   scientists   and<\/p>\n<p>         technicians and humanists to look into the viability and<\/p>\n<p>         feasibility of the Bakel Tourism Project.&#8221;<\/p>\n<p>     3.    As mentioned by us earlier this Original Petition has<\/p>\n<p>been pending before this Court since 1995. Much water has<\/p>\n<p>flowed under the bridge thereafter.\n<\/p>\n<p>     4. When this Original Petition came up for consideration<\/p>\n<p>today, Smt.K.Meera, learned Senior Government Pleader has<\/p>\n<p>placed before us a communication received by her from the<\/p>\n<p>Government. The Government of India had declared Bakel as<\/p>\n<p>Special Tourism Area in 1992 and Bakel Tourism Authority was<\/p>\n<p>formed for the purpose of implementation of the above project.<\/p>\n<p>Later, Bakel Resort Development Corporation was established.<\/p>\n<p>O.P. No.19982 of 1995<br \/>\n<span class=\"hidden_text\">                               -:3:-<\/span><\/p>\n<p>After preparing a master plan, the Company had proceeded to<\/p>\n<p>implement the scheme. As part of the scheme in the area the<\/p>\n<p>Company had acquired 220 acres of land for developing beach<\/p>\n<p>resorts of international standards. These resort sites have been<\/p>\n<p>developed by the Company.        The communication will further<\/p>\n<p>reveal that while implementing the project, special care has been<\/p>\n<p>taken not to disturb the ecology or historical importance of the<\/p>\n<p>area in question.     Adequate safeguards have been taken to<\/p>\n<p>preserve these vital components at appropriate places.<\/p>\n<p>     5. We do not propose to deal with each and every item of<\/p>\n<p>the several projects indicated under the Scheme at this stage, for<\/p>\n<p>the obvious reason that the Government appears to have made a<\/p>\n<p>major headway in implementation of the project in question since<\/p>\n<p>1995.\n<\/p>\n<p>     We have carefully perused the averments contained in the<\/p>\n<p>Original Petition and we have also perused the materials available<\/p>\n<p>on record. At this distance of time we do not find any reason to<\/p>\n<p>keep this Original Petition pending on the files of this Court, since<\/p>\n<p>O.P. No.19982 of 1995<br \/>\n<span class=\"hidden_text\">                               -:4:-<\/span><\/p>\n<p>the project in question has taken shape to a considerable extent.<\/p>\n<p>More importantly, many of the apprehensions projected by the<\/p>\n<p>petitioner seem to be misconceived and baseless. Therefore, the<\/p>\n<p>Original Petition is closed.\n<\/p>\n<\/p>\n<p>                                         S.R.
