MOHAPATRA,J.\n<\/p>\n<p>      The  respondents\therein,\t who   were  Post-  Graduate<br \/>\nstudents  of  the  Andhra Pradesh  Agricultural\t University,<br \/>\nfiled  a  writ\tpetition (Writ Petition\t No.16050  of  1991)<br \/>\nagainst\t the  State  of Andhra Pradesh, represented  by\t the<br \/>\nSecretary,  Food and Agriculture Department (Agrl.III),\t and<br \/>\nthe  Andhra Pradesh Agricultural University, represented  by<br \/>\nthe  Registrar,\t challenging  the   Government\tOrder\ti.e.<br \/>\nG.O.Ms.No.742  dated  3rd December, 1990, in which the\tdate<br \/>\nfrom which they are entitled to stipend at the enhanced rate<br \/>\nwas  specified and sought a direction to the respondents  to<br \/>\npay  the enhanced rate of stipend to them from 1st  October,<br \/>\n1989  as  in the case of Post-Graduate students\t of  Medical<br \/>\nColleges  in  the  State.   It\tis  the\t case  of  the\twrit<br \/>\npetitioners  that prior to the issue of the  afore-mentioned<br \/>\nGovernment Order, Post-Graduate students of the Agricultural<br \/>\nUniversity were receiving stipend at the rates of Rs.1,000\/-<br \/>\nper month during the first year, Rs.1,100\/- per month during<br \/>\nthe  second year and Rs.1,200\/- per month in the third year,<br \/>\nsame as in the case of the Post-Graduate students of Medical<br \/>\nColleges.   By the Government Order, G.O.Ms.No.655,  Health,<br \/>\nMedical\t and  Family  Welfare (E-II) Department\t dated\t26th<br \/>\nDecember,  1989, considering the representation made by\t the<br \/>\nAndhra\tPradesh\t Junior Doctors Association, the  rates\t of<br \/>\nstipend were enhanced to Rs.1,500\/- per month for first year<br \/>\nstudents,  Rs.1,900\/- per month for second year students and<br \/>\nRs.2,000\/-  per\t month\tfor  third   year  students  with  a<br \/>\ndirection  that the order of enhancement was to take  effect<br \/>\nfrom  1st October, 1989.  A similar enhancement of the\trate<br \/>\nof  stipend  was  made\tby   the  G.O.Ms.No.742,  Food\t and<br \/>\nAgriculture  (Agrl.III)\t Department, for  the  Post-Graduate<br \/>\nstudents  of  the Agricultural University but the order\t was<br \/>\ngiven  effect from 3rd December, 1990.\tThe case of the writ<br \/>\npetitioners was that the State Government had always treated<br \/>\nthe Post-Graduate students of the Agricultural University at<br \/>\npar  with the Post- Graduate students of Medical Colleges in<br \/>\nthe  matter  of stipend and there was no rational  basis  to<br \/>\nmake  a\t difference regarding the effective date from  which<br \/>\nthe  enhanced  rates  of stipend will be paid  to  the\tPost<br \/>\nGraduate  students  of the Agricultural University  on\tthis<br \/>\noccasion.  The respondents in the writ petition, denying the<br \/>\nclaim  of the writ petitioners, contended inter alia that it<br \/>\nis  not correct to assume that the State Government was\t all<br \/>\nalong\ttreating   the\tPost-Graduate\t students   of\t the<br \/>\nAgricultural  University  at  par   with  the  Post-Graduate<br \/>\nstudents  of  Medical Colleges simply because the  rates  of<br \/>\nstipend\t paid  to the two groups of  Post-Graduate  students<br \/>\nhappened  to  be  the same.  According to  the\trespondents,<br \/>\nthere was no comparison between the writ petitioners and the<br \/>\nPost- Graduate students of Medical Colleges since the nature<br \/>\nof  studies,  research work and practical duty done by\tthem<br \/>\nare  not similar.  It was further contended on behalf of the<br \/>\nrespondents  in the writ petition that the writ\t petitioners<br \/>\nrepresented   their  case  to\tthe  State  Government\t for<br \/>\nenhancement of the rate of stipend and the State Government,<br \/>\nafter  due consideration of the case of the petitioners\t and<br \/>\nthe  Post-Graduate students of Medical Colleges, passed\t the<br \/>\norder  enhancing  the  rate  of\t stipend  with\teffect\tfrom<br \/>\ndifferent  dates.  A single Judge of the Andhra Pradesh High<br \/>\nCourt,\tvide  judgment dated 28th April, 1992,\tallowed\t the<br \/>\nwrit petition granting the relief sought.  The learned Judge<br \/>\nobserved  :  It is very vaguely stated in the counter  that<br \/>\nnothing prevents the petitioners to make a representation to<br \/>\nthe   Government.   That  is  not   a  valid   answer.\t  No<br \/>\nintelligible  differentia  has been pointed out by  the\t 1st<br \/>\nrespondent  to discriminate the petitioners from that of the<br \/>\nmedical\t post-graduates.   As  such, the action of  the\t 1st<br \/>\nrespondent  in\tdepriving the petitioners of  the  increased<br \/>\nstipend\t amounts  on  par with medical\tpost-graduates\twith<br \/>\neffect\tfrom  1-10-1989 results in invidious  discrimination<br \/>\ninfracting  fundamental\t right\tof equality before  law\t and<br \/>\nequal  protection  of  laws enshrined under  Article  14  of<br \/>\nIndian Constitution.\n<\/p>\n<p>      Being  aggrieved\tby the judgment, the  Government  of<br \/>\nAndhra\tPradesh\t filed an appeal (W.A.S.R.No.29437 of  1993)<br \/>\nchallenging  the same.\tA Division Bench of the High  Court,<br \/>\nby  the judgment dated 7th July, 1993, dismissed the  appeal<br \/>\non the ground of being grossly barred by time.\tThe Division<br \/>\nBench  of  the High Court, on perusal of the condonation  of<br \/>\ndelay  petition\t (W.A.M.P.No.815  of   1993)  filed  by\t the<br \/>\nappellant,  held  The  facts   referred\t to  above  clearly<br \/>\nestablish that no sufficient cause is made out for condoning<br \/>\nthe  inordinate\t delay\tof 365 days in\tfiling\tthe  appeal.<br \/>\nTherefore,  the\t petition is dismissed. The said  order\t is<br \/>\nunder  challenge in this appeal filed by the State of Andhra<br \/>\nPradesh.   The respondents have not appeared despite service<br \/>\nof  notice  on them.  We have heard learned counsel for\t the<br \/>\nappellant.  We have also perused the judgment of the learned<br \/>\nsingle\tJudge, the judgment passed by the Division Bench and<br \/>\nthe  other relevant records included in the paper book.\t  It<br \/>\nis our considered view that on the pleadings of the parties,<br \/>\nthe learned single Judge rightly came to the conclusion that<br \/>\nthe  State  Government\tfailed to show that  there  was\t any<br \/>\nreasonable  basis  or  intelligible differentia\t for  giving<br \/>\neffect\t to   the  enhanced  rates   of\t stipend   for\t the<br \/>\nPost-Graduate students of the Agricultural University from a<br \/>\ndate different from the effective date of the Post- Graduate<br \/>\nstudents  of the Medical Colleges, particularly when it\t was<br \/>\nthe  specific  case of the writ petitioners that  the  State<br \/>\nGovernment  had all along maintained parity in the matter of<br \/>\nstipend\t paid  to  the Post-Graduate students  of  both\t the<br \/>\ninstitutions.\tOn this occasion also regarding the rates of<br \/>\nstipend\t payable  to  Post-Graduate   students\tin  the\t two<br \/>\ninstitutions was maintained.  However, a differentiation was<br \/>\nmade  in  so  far  as the date with effect  from  which\t the<br \/>\nbenefit\t of the enhanced rates will be available;  while  in<br \/>\ncase  of  Post-Graduate\t students of Medical  Colleges,\t the<br \/>\nbenefit\t was  extended with effect from an anterior date  in<br \/>\nthe  case  of  Post-Graduate students  of  the\tAgricultural<br \/>\nUniversity,  the benefit was extended from a date subsequent<br \/>\nthereto.   This\t departure  from the parity  in\t the  matter<br \/>\nbetween\t the two groups of Post-Graduate students, which had<br \/>\nadmittedly  been  maintained  all  along,  was\tassailed  as<br \/>\narbitrary  and\tdiscriminatory.\t  When\tthe  action  of\t the<br \/>\nGovernment was challenged on the ground of arbitrariness and<br \/>\ndiscrimination\t it   was  for\t the  Government  to   plead<br \/>\njustification  for  fixing  the two different dates  in\t the<br \/>\nmatter.\t  It neither stated in the pleadings any  reasonable<br \/>\nor  rational basis for giving effect to the enhanced rate of<br \/>\nstipend\t with  effect from different dates nor did it  place<br \/>\nany  material  before  the Court in that regard.   For\tthis<br \/>\npurpose it is of no relevance that courses of studies of the<br \/>\nPost-  Graduate\t students  in the two institutions  and\t the<br \/>\nnature of practical duty done by them are different, for the<br \/>\nreason\tthat the matter under challenge related to the\tdate<br \/>\nwith effect from which the enhanced stipend is to be paid to<br \/>\nPost-Graduate  students of Agricultural University.  In such<br \/>\ncircumstance  the learned single Judge cannot be faulted for<br \/>\nhaving\ttaken  the  view  that\t the  action  of  the  State<br \/>\nGovernment  in the matter was not supported by any  rational<br \/>\nbasis  or intelligible differentia.  The Division Bench,  in<br \/>\nthe  facts and circumstances of the case, rightly  dismissed<br \/>\nthe  appeal  filed by the appellant herein.
