The said land was<br \/>\nallotted as new tenure land. The husband of the petitioner expired on<br \/>\n 31.01.1994 and thereafter the petitioner is cultivating the said<br \/>\nland.  As there was breach of the condition of the allotment of the<br \/>\nland, Sharat Bhang Case No. 196\/90  was came to be filed against the<br \/>\npetitioner, before the Deputy Collector. The Deputy Collector, vide<br \/>\norder dated 08.10.1990 directed the Mamlatdar to take over the<br \/>\npossession of the land in question on the ground that the said land<br \/>\nhad remained uncultivated for long time. Against the said order, the<br \/>\npetitioner preferred an appeal being Appeal No. 996\/1997 before the<br \/>\nCollector, Jamnagar. The Collector, vide order dated 17.04.1997<br \/>\ndismissed the said appeal.  Being aggrieved by the said order, the<br \/>\npetitioner preferred Revision Application No. 69\/97 before the<br \/>\nSpecial Secretary [Appeals] Revenue Department-respondent no. 1<br \/>\nherein. The Secretary [Appeals] respondent no. 1 vide order dated<br \/>\n28.09.1998 rejected the said revision application. Hence, this<br \/>\npetition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record.  The  petitioner was granted the land in question in the<br \/>\nyear 1966 for the purpose of cultivation.  However, from the record<br \/>\nit appears that the petitioner had not cultivated the said land and<br \/>\nthe same had remained uncultivated for many years. Therefore, in view<br \/>\nof the breach of the condition, the respondent authority had<br \/>\ncancelled the grant.\n<\/p>\n<p>Looking to the facts of the case, and in view of the fact that the<br \/>\npetitioner had committed breach of condition of the grant, the<br \/>\nauthorities<br \/>\nbelow were completely justified in passing the impugned orders.\n<\/p>\n<p>4.\t\tConsidering<br \/>\nthe facts of the case, in my opinion, the respondent authorities were<br \/>\ncompletely justified in passing the impugned orders. I am in complete<br \/>\nagreement with the concurrent findings recorded by respondent<br \/>\nauthorities and hence, find no reason to interfere with the same.\n<\/p>\n<p>5.\t\tConsequently,<br \/>\nthe petition is dismissed.
