DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/08\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tRule.\tLearned<br \/>\nAPP, waives service of rule on behalf of respondent-State.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the applicants submit that allegation against the<br \/>\napplicants is of taking away mobile and rickshaw of the complainant,<br \/>\nwhich has been returned back to him.  It is further submitted that so<br \/>\nfar as antecedent is concerned, the accused were acquitted and<br \/>\nconsidering overall facts and circumstances, by imposing suitable<br \/>\nconditions the applicants may be enlarged on bail.\n<\/p>\n<p>\tConsidering<br \/>\nthe above prima facie aspects of the matter, I find this is a fit<br \/>\ncase for granting bail.  Under the circumstances, the applicants are<br \/>\nordered to be released on bail in connection with C.R. No.I-52 of<br \/>\n2011 with Amroli Police Station, Surat, on their furnishing bond of<br \/>\nRs. 5000\/-(Rupees Five Thousand) each with one surety of like amount<br \/>\nto the satisfaction of the lower Court and subject to following<br \/>\nconditions :\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\ttheir presence before the concerned Police Station on every 1st<br \/>\n\tand 15th day of English Calendar month between 11:00 am<br \/>\n\tto 2:00 pm:\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of their residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\ttheir passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicants only if they are not required<br \/>\nin connection with any other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
