MUNGER\n                                        -----------\n<\/pre>\n<p>3.   28.01.2011             Heard learned counsel for the petitioner<\/p>\n<p>                  and the State.\n<\/p>\n<p>                            The petitioner is aggrieved by the order<\/p>\n<p>                  dated 12.8.2009 by which directions have been<\/p>\n<p>                  issued for institution of a      certificate case against<\/p>\n<p>                  him with regard to non surrender of food grains<\/p>\n<p>                  given to him for public distribution.<\/p>\n<p>                            Learned counsel submits that the food<\/p>\n<p>                  grains were for a scheme of the year 2005-06. The<\/p>\n<p>                  impugned order has been issued more than 3 to 4<\/p>\n<p>                  years   later.    The    food   grains     were    liable   to<\/p>\n<p>                  deterioration    and    the   petitioner   could    not     be<\/p>\n<p>                  expected to keep it in any appropriate condition<\/p>\n<p>                  indefinitely.\n<\/p>\n<p><span class=\"hidden_text\">                               2<\/span><\/p>\n<p>                     Counsel for the State from the counter<\/p>\n<p>           affidavit is unable to satisfy the Court that any<\/p>\n<p>           opportunity to explain or any show cause notice was<\/p>\n<p>           given to the petitioner before issuance of the<\/p>\n<p>           impugned order dated 12.8.2009.\n<\/p>\n<p>                     This    Court   therefore     directs     that     no<\/p>\n<p>           coercive action shall be taken in pursuance of the<\/p>\n<p>           order   dated    12.8.2009   issued     by    the    Deputy<\/p>\n<p>           Development Commissioner, Munger.             The order is<\/p>\n<p>           directed to be treated as a show cause notice.<\/p>\n<p>                     Let the petitioner file their reply within a<\/p>\n<p>           maximum period of six weeks whereafter the Deputy<\/p>\n<p>           Development      Commissioner         shall   pass         final<\/p>\n<p>           reasoned and speaking order in accordance with law.<\/p>\n<p>                     If no cause is shown by the petitioner<\/p>\n<p>           within the time indicated, the writ petition shall be<\/p>\n<p>           deemed to have been dismissed.\n<\/p>\n<p>                     The writ application stands disposed.<\/p>\n<pre>P.
