\t\tPresent
\napplication is filed by one Vishnubhai Maheshwari Prasad Dube.  It is
\nmentioned in the cause-title that this application is under the
\nprovisions of Juvenile Justice (Care and Protection of Children) Act
\n2000 for declaring the appellant \/ applicant to be juvenile. The
\nrelief prayed in the application is under:\n<\/p>\n
“20(B).\tBe
\npleased to declare the appellant applicant original accused to be
\njuvenile under the provisions of Juvenile justice (care and
\nprotection of children) Act 2000 and be pleased to release the
\napplicant appellant accused from judicial custody by way of quashing
\nand setting aside the sentence passed by the ld. Special Judge
\nappointed under the NDPS Act, passed on 17\/07\/2007, in Special NDPS
\nCase No.15 of 2005, in the interest of justice.”\n<\/p>\n
2.\t\tLearned
\nAdvocate, Mr.Baghel, for the applicant made available for perusal the
\noriginal Birth Certificate, xerox copy of which is produced at
\nAnnexure – A (Page No.8), which is taken on record.\n<\/p>\n
3.\t\tIt
\nis painful that the plea of juvenility is raised at this stage so
\nlate, because it is mentioned in the cause-title that the applicant
\nis, “presently undergoing in Vadodara Central Jail since
\n30\/05\/2005”.\n<\/p>\n
3.1\t\tThe
\ncertificate produced by the applicant is  the birth certificate
\n(which contains name column of child but does not have a column of
\nbirth date) of Vishnubhai Dubey mentioning mother’s name as Smt.
\nBhagvati Devi and father’s name as Shri Maheshwari Prasad.  Applicant
\nalso produced birth certificate of Harikrushna with mother’s name as
\nSmt. Bhagvati Devi and father’s name as Shri Maheshwari Prasad.
\nSimilarly, birth certificate of one Shri Chunnukant with mother’s
\nname being Smt. Bhagvati Devi and father’s name Shri Maheshwari
\nPrasad. Alongwith there ‘birth certificates’ extracts from ‘family
\nregister’ from ‘Nagar Panchayat’ and ‘Nyay Panchayat’ are produced.\n<\/p>\n
4.\t\tOn
\nfirst look, the birth certificate produced at Annexure – A
\nColly (Page No.8)  where name mentioned is ‘Vishnubhai Dubey’ does
\nnot inspire confidence because ‘Bhai’ is not a suffix which is
\napplied in the region from which the birth certificate is produced.\n<\/p>\n
4.1\t\tThe
\ncertificate which is produced is not a birth date certificate. It is
\nonly a birth certificate and the entire certificate does not possess
\na column wherein ‘date of birth’ is to be mentioned. The date is
\nmentioned in the title wherein it is written that this certificate is
\nissued under Section 12 \/17 of Birth \/ Death Registration Act, 1969
\nand (blank) Rule 8\/13 of  Birth \/ Death Registration Rules, Uttar
\nPradesh and Rules made thereunder.\n<\/p>\n
4.2\t\tMeaning
\nthereby, this certificate only declares that a person named
\nVishnubhai Dubey was born to a couple named Smt. Bhagvati Devi and
\nShri  Maheshwari Prasad.  It also reveals that child was born in a
\n‘Hospital’ and the permanent address of the mother and father is
\n‘Rasin’ (it appears to be the name of village). The certificate is
\nissued under the signature of ‘Upnibandhak (BHW)’, Birth \/ Death, New
\nPrimary Health Center, Rasin, P.H.C., Shivrampur, Dist: Chitrakut.
\nThe date of issuing certificate is 15\/12\/2010 alongwith signature of
\nissuing Officer, which is overwritten and the spelling of ‘Dubey’ is
\nalso wholly incorrect.\n<\/p>\n
5.\t\tAs
\nrequired under the law, the age is required to be verified from the
\nChehra Nisan Patrak (Identification Slip of the accused). It is
\nreported that the R & P of  Special NDPS Case No.15 of 2005 is
\nreceived in the Registry from the Court of District Court, Surat.\n<\/p>\n
5.1\t\tRegistry
\nis directed to make available the same to the learned Advocate, for
\nthe applicant to obtain the copy of Chehra Nisan Patrak
\n(Identification Slip of the accused) so as to produce the same before
\nthe Court in support of his application.\n<\/p>\n
6.\t\tMatter
\nto come up for hearing on 24\/03\/2011.\n<\/p>\n
