Petitioner has filed the connected<\/p>\n<p>                  writ application (C.W.J.C.No.2874 of 2008) for a<\/p>\n<p>                  direction to the respondent University to pay him<\/p>\n<p>                  the arrears of pension of his father due from<\/p>\n<p>                  February    1994     to   10.3.2003,   amount      of   part<\/p>\n<p>                  gratuity, part unutilized leave encashment, part<\/p>\n<p>                  G.I., part P.F. and difference of salary from<\/p>\n<p>                  January 1981 to January 1994 along with statutory<\/p>\n<p>                  interest.\n<\/p>\n<p>                        This Court, in a batch of cases, including<\/p>\n<p>                  the connected writ application, passed a detailed<\/p>\n<p>                  order on 12.9.2008 giving certain directions to<\/p>\n<p>                  the respondent University for payment of dues of<\/p>\n<p>                  the petitioners. The order dated 12.9.2008 and<\/p>\n<p>                  subsequent common orders passed in the batch of<\/p>\n<p>                  cases have been referred to in the order passed<\/p>\n<p>                  in M.J.C.No.566 of 2009.\n<\/p>\n<p>                             The     specific     directions    which     were<\/p>\n<p>                  issued by this Court in the writ matter were as<\/p>\n<p>                  follows :\n<\/p>\n<p>                        &#8220;(a) Before the next date fixed in this<br \/>\n<span class=\"hidden_text\">        -2-<\/span><\/p>\n<p>batch of cases, they shall see to it that<br \/>\nall admitted and lawful dues of the<br \/>\nconcerned employee of the University are<br \/>\ncalculated, settled and paid to him\/her or<br \/>\nhis\/her beneficiaries.\n<\/p>\n<p>(b) They shall see to it that all<br \/>\ncalculations are made as per the rates of<br \/>\nentitlement, including that of the pay-<br \/>\nscale admissible from time to time, of the<br \/>\nemployee concerned, as laid down in the<br \/>\nrelevant    Act\/Statutes\/Rules\/Regulations\/<br \/>\nNotifications etc. as applicable at the<br \/>\nrelevant time or as made applicable by<br \/>\njudicial pronouncement or interpretations<br \/>\nmade in the matter. Any miscalculation,<br \/>\nresulting into short or excess payment to<br \/>\nthe employee concerned or his beneficiary<br \/>\nshall be treated as non-compliance or<br \/>\nwrong compliance of order of this Court<br \/>\nand shall be viewed seriously.\n<\/p>\n<p>(c) Details of calculation under each<br \/>\nhead, with mention of relevant provision<br \/>\nof law or judicial pronouncement, as the<br \/>\ncase may be, in the margin of the<br \/>\ncalculation, along with cheque\/draft of<br \/>\nthe amount found payable (except where it<br \/>\nis directly creditable in the account)<br \/>\nshall be served on the employee or his\/her<br \/>\nbeneficiary at his\/her known place of<br \/>\nresidence,   or  shall   be  sent   through<br \/>\ninsured registered post, if the entire<br \/>\nfamily has shifted its residence out side<br \/>\nthe State. For this, address of the<br \/>\nemployee or his\/her beneficiary shall be<br \/>\nverified beforehand, if required. This<br \/>\nexercise must be completed latest by two<br \/>\nweeks prior to the next date fixed in this<br \/>\nbatch of cases.\n<\/p>\n<p>(d) In case, any specific claim raised by<br \/>\nthe petitioners in the respective writ<br \/>\npetition is found not payable, a specific<br \/>\norder in this regard shall be passed by<br \/>\nthe Vice Chancellor with reference to the<br \/>\nspecific provision of law or judicial<br \/>\npronouncement and shall be made available<br \/>\nto the employee or his\/her beneficiary<br \/>\nalong with the details of calculation and<br \/>\nthe cheque\/draft as aforesaid.\n<\/p>\n<p>(e) Latest by one week prior to the date<br \/>\nfixed in this batch of cases, the Head of<br \/>\nthe Institution concerned or the Registrar<br \/>\n<span class=\"hidden_text\">        -3-<\/span><\/p>\n<p>of the University, as the case may be,<br \/>\nshall file a personal affidavit in each<br \/>\nand every case, with copy served on the<br \/>\nlearned   counsel   for    the    petitioner,<br \/>\ncertifying    that,    to    his     personal<br \/>\nsatisfaction, entire lawful dues of the<br \/>\nemployee has been paid to the employee or<br \/>\nhis beneficiary and shall also enclose<br \/>\ncopies of the details of calculation and<br \/>\nthe cheque\/draft as served\/sent to the<br \/>\nemployee or his beneficiary in terms of\n<\/p>\n<p>(c) above, and shall also enclose copy of<br \/>\nregistration receipt, as the case may be .<br \/>\nWith the affidavit, a copy of the order of<br \/>\nthe Vice-Chancellor, if any, denying any<br \/>\nspecific claim of the petitioner, and<br \/>\nserved   upon  the   employee    or   his\/her<br \/>\nbeneficiary in the manner indicated above,<br \/>\nshall also be enclosed.\n<\/p>\n<p>(f) In case, any lawful amount of the<br \/>\nconcerned employee remains due to be paid<br \/>\nto him or his beneficiary, and no order<br \/>\ndenying the claim is served upon the<br \/>\nemployee or his\/her beneficiary in the<br \/>\nmanner indicated above, the Head of the<br \/>\nInstitution or the Registrar, as the case<br \/>\nmay be, shall disclose in his personal<br \/>\naffidavit the name and details of the<br \/>\nemployee or officer due to whose lapses or<br \/>\ndue to whose fault the amount remained<br \/>\nunpaid. In case the name and details of<br \/>\nthe employee\/officer responsible for non-<br \/>\npayment of any lawful amount of the<br \/>\nemployee concerned is not disclosed in<br \/>\nsuch personal affidavit, the Head of the<br \/>\nInstitution concerned or the Registrar, as<br \/>\nthe case may be, shall be assumed to be<br \/>\npersonally responsible for the said lapse<br \/>\nor default.\n<\/p>\n<p>(g) In case of outstanding arrears of<br \/>\nsalary on account of revision of pay-scale<br \/>\nof teachers of the University w.e.f.<br \/>\n1.1.1996, and in case University finds<br \/>\nitself unable to pay the same due to<br \/>\npaucity of fund, it shall calculate the<br \/>\namount payable separately to each of the<br \/>\nemployee concerned of the present batch of<br \/>\ncases and send a requisition to the State<br \/>\nGovt. separately with all details of<br \/>\nrevision and fixation of pay-scale, with<br \/>\nreference       to       relevant        Act\/<br \/>\n<span class=\"hidden_text\">        -4-<\/span><\/p>\n<p>Statutes\/Rules\/Regulations\/Notifications<br \/>\netc. as applicable at the relevant time or<br \/>\nas made applicable or interpreted by<br \/>\njudicial pronouncement made in the matter,<br \/>\nwith all details of the employee in the<br \/>\nformat prescribed by the State Govt. for<br \/>\nthe   purpose,    with      original    of   the<br \/>\ndocuments required by the State Government<br \/>\nor explanation for non-furnishing of the<br \/>\nsame. The requisition must be received by<br \/>\nthe concerned authority of the State<br \/>\nGovernment latest three weeks before the<br \/>\nnext date fixed in this batch of cases,<br \/>\nand copies thereof, with copy of receiving<br \/>\nmust   be   enclosed      with   the    personal<br \/>\naffidavit, as aforesaid.\n<\/p>\n<p>(h) State Government on receipt of such<br \/>\nrequisition    in    respect    of    individual<br \/>\nemployee, shall cause it to be examined,<br \/>\nand upon being satisfied, shall release<br \/>\nthe necessary fund to the University<br \/>\nspecifically earmarked for payment to the<br \/>\nconcerned employee or his\/her beneficiary<br \/>\nas the case may be within two weeks from<br \/>\nthe   date    of    receipt     of    the   said<br \/>\nrequisition and shall inform the Court on<br \/>\nthe next date fixed in the batch of cases<br \/>\nabout the same. On receipt of the said<br \/>\nfund, University shall make payment of the<br \/>\namount   to   the    employee     concerned   or<br \/>\nhis\/her beneficiary immediately with due<br \/>\nintimation to the State Government and<br \/>\nthis Court.\n<\/p>\n<p>Any miscalculation, resulting into short<br \/>\nor excess release of fund and payment<br \/>\nthereof to the employee concerned or<br \/>\nhis\/her beneficiary shall be treated as<br \/>\nnon-compliance or wrong compliance of<br \/>\norder of this Court by the University<br \/>\nauthorities or the authorities of the<br \/>\nState Government, as the case may be, and<br \/>\nshall be viewed seriously.\n<\/p>\n<p>(i)   Before    filing     of   the    aforesaid<br \/>\naffidavits    in    respective      cases,   all<br \/>\nconcerned    shall     get    satisfied,    that<br \/>\nspecific and unambiguous pleading has been<br \/>\nmade   in   the    affidavit     showing    full<br \/>\ncompliance of the directions of the Court<br \/>\nas   made    above,      and    all    necessary<br \/>\nenclosures,    as     indicted     above,    are<br \/>\nenclosed and all the heads of claims of<br \/>\n<span class=\"hidden_text\">                   -5-<\/span><\/p>\n<p>         the employee concerned are independently<br \/>\n         dealt with in separate paragraphs, so that<br \/>\n         any requirement of any further affidavit<br \/>\n         in the case may be ruled out, and the case<br \/>\n         may be in a position to be disposed of<br \/>\n         finally on the next date fixed.&#8221;\n<\/p>\n<p>         After     this        contempt          proceeding       was<\/p>\n<p>initiated, a show cause has been filed on behalf<\/p>\n<p>of      Vice-Chancellor         and     Registrar         of      the<\/p>\n<p>University on 19.02.2009 in the writ application<\/p>\n<p>itself. Along with the show cause, a calculation<\/p>\n<p>chart of the dues of the father of the petitioner<\/p>\n<p>has been annexed as Annexure-B. It is stated in<\/p>\n<p>the    show   cause     that    due    to    paucity      of    fund,<\/p>\n<p>admitted dues of the petitioner has not been paid<\/p>\n<p>to him. In this regard, a letter has also been<\/p>\n<p>written to the State Government for release of<\/p>\n<p>fund.\n<\/p>\n<p>         This show cause was filed on 19.2.2009.\n<\/p>\n<p>More than one year has elapsed. Still, nothing<\/p>\n<p>has been brought on record to show as to whether<\/p>\n<p>admitted dues of the petitioner has been paid to<\/p>\n<p>him or not.\n<\/p>\n<p>         Thus, it is apparent that admitted post-\n<\/p>\n<p>retiral    dues   of    the    father       of    the    petitioner<\/p>\n<p>still remained to be paid to the petitioner for<\/p>\n<p>which no explanation has been furnished in the<\/p>\n<p>show    cause.    Moreover,       it    is       clear   from     the<br \/>\n<span class=\"hidden_text\">                     -6-<\/span><\/p>\n<p>pleadings that other directions of this Court as<\/p>\n<p>quoted above have also not been complied with by<\/p>\n<p>the    contemnors.         Therefore,        the    contemnors        are<\/p>\n<p>held guilty of contempt of this Court.\n<\/p>\n<p>         Since         the       Registrar         and     the        Vice<\/p>\n<p>Chancellor of the University have changed during<\/p>\n<p>the pendency of this contempt proceeding, this<\/p>\n<p>Court refrains from passing any order of their<\/p>\n<p>imprisonment. However, they are punished with the<\/p>\n<p>fine of Rs.2000\/- to be deposited in the account<\/p>\n<p>of    Patna   High      Court      Legal     Services      Committee.\n<\/p>\n<p>Apart from the said fine, contemnors shall also<\/p>\n<p>be    liable      to       pay     cost      of     this     contempt<\/p>\n<p>proceeding, which is quantified at Rs.3000\/-, to<\/p>\n<p>be paid to the petitioner within one month from<\/p>\n<p>today.\n<\/p>\n<p>         In    view       of    change      of    Vice     Chancellor,<\/p>\n<p>Registrar        and       other       functionaries          of       the<\/p>\n<p>University during the pendency of this contempt<\/p>\n<p>proceeding,       this         Court   gives       liberty       to    the<\/p>\n<p>present       Vice        Chancellor         to      fix     up       the<\/p>\n<p>proportionate responsibility upon the individual<\/p>\n<p>incumbents holding the posts from the date of<\/p>\n<p>initiation       of     the      proceeding        till    today      and<\/p>\n<p>realize       the         amount       of        fine      and        cost<br \/>\n<span class=\"hidden_text\">                       -7-<\/span><\/p>\n<p>       proportionately      from     them   in    the    manner<\/p>\n<p>       admissible    in   law   after    complying    with   the<\/p>\n<p>       Principles of Natural Justice.\n<\/p>\n<p>               The    matter    is    disposed   of   with   the<\/p>\n<p>       aforesaid observations and directions.\n<\/p>\n<pre>B.T.
