                                   This writ petition has been filed, inter alia, for<\/p>\n
                       quashing   of   the   Memo     No.   123   dated   29.5.2004<\/p>\n
                       (Annexure-1) whereby the respondent no.4 has refused 18<\/p>\n
                       months salary to the petitioner being for the months of<\/p>\n
                       January, 2001 to March, 2001 and from April 2002 to<\/p>\n
                       June 2003 along with interest thereon and for other<\/p>\n
                       consequential benefits.\n<\/p>\n
                                   It is not in dispute that the petitioner had<\/p>\n
                       initially been appointed as License Inspector on temporary<\/p>\n
                       basis in the Janakpur Road Notified Area Committee as<\/p>\n
                       an   unsanctioned     post.   Subsequently   the   committee<\/p>\n
                       resolved and regularized the services of the petitioner<\/p>\n
                       while also writing to the concerned authority of the State
\n Government for sanctioning of post which, however, did<\/p>\n
not come to pass. After about 14 years of continuous<\/p>\n
service, the petitioner was terminated vide Memo No. 114<\/p>\n
dated 1.7.2003 (Annexure-7).\n<\/p>\n
             On an earlier occasion, this court in C.W.J.C.<\/p>\n
No. 14247 of 2003 had by its order dated 11.2.2004 held<\/p>\n
that the petitioner could not be allowed to continue in<\/p>\n
service against unsanctioned post. However, as regards<\/p>\n
non payment of salary the petitioner was at liberty to<\/p>\n
make a representation to the respondents for redressal of<\/p>\n
his grievances.\n<\/p>\n
             The matter has since been disposed of by the<\/p>\n
concerned authority in terms of Memo No. 123 dated<\/p>\n
29.5.2004 and the petitioner’s claim for arrears has been<\/p>\n
rejected on the solitary ground that when the appointment<\/p>\n
itself was illegal being against non-sanctioned post,<\/p>\n
payment of salary for the period under consideration<\/p>\n
would not be in accordance with law.\n<\/p>\n
             Thereafter, the petitioner has also issued a<\/p>\n
legal notice dated 12.7.2004 for payment of his arrears but<\/p>\n
to no avail. He has therefore approached this court for<\/p>\n
appropriate relief.\n<\/p>\n
             This     court   is   unable   to   appreciate   the<\/p>\n
respondents’ stand for their refusal to make payment to<\/p>\n
the petitioner. It is not in dispute that the services of the
\n          petitioner were duly taken by the respondent. It is also a<\/p>\n
         matter of record that the petitioner has been serving for<\/p>\n
         over 14 years against unsanctioned post and payments<\/p>\n
         were throughout being made in the past without demur. It<\/p>\n
         further transpires that the respondent had written to the<\/p>\n
         State for sanctioning of post since the services of the<\/p>\n
         petitioner were required by the respondent.<\/p>\n
                        Having taken the services of the petitioner, the<\/p>\n
         respondents’ arbitrary stance in not paying the petitioner<\/p>\n
         for the period in question cannot be countenanced much<\/p>\n
         less endorsed.\n<\/p>\n
                        In these circumstances, it is directed that the<\/p>\n
         respondents would make payment for the entire 18<\/p>\n
         months period under reference for which services had<\/p>\n
         admittedly been taken from the petitioner but he has not<\/p>\n
         been paid for the same. The payment should be made as<\/p>\n
         expeditiously as possible preferably within a period of four<\/p>\n
         months hereof.\n<\/p>\n
                        With these directions, the writ petition is<\/p>\n
         disposed of.\n<\/p>\n<\/p>\n
