Munna Rajbhar\n                                           Versus\n                                   STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>2.   15.6.2010             Heard learned counsel for the petitioners<\/p>\n<p>                 and the State.\n<\/p>\n<p>                           The defence of the petitioners in a Police<\/p>\n<p>                 case under Sections 435 and 436\/34 of the Penal<\/p>\n<p>                 Code is that there has been no fire at the house of the<\/p>\n<p>                 informant when there is otherwise a case and counter<\/p>\n<p>                 case between them on account of the land dispute.<\/p>\n<p>                           In view of the specific assertion in the F.I.R.<\/p>\n<p>                 that the petitioners set fire to the house of the<\/p>\n<p>                 informant, this Court is not persuaded to grant the<\/p>\n<p>                 privilege of anticipatory bail.\n<\/p>\n<p>                           The application is rejected.\n<\/p>\n<p>                           In any application for regular bail, the Court<\/p>\n<p>                 below is obliged to consider from the case diary if sign<\/p>\n<p>                 of any fire have been found at the house of the<\/p>\n<p>                 informant and in that light decide the prayer for<\/p>\n<p>                 regular bail, without being prejudiced by the present<\/p>\n<p>                 order.\n<\/p>\n<\/p>\n<pre>P.
