A. No. 1834\/2010\n12-7-10<\/pre>\n<p>                Shri Rakesh Khare, learned counsel for the appellant.<br \/>\n                I.A.   No.   4853\/2010,   which     is   an    application    for<br \/>\n          condonation of delay.\n<\/p>\n<p>                Before considering the application for condonation of<br \/>\n          delay I thought it appropriate to look into the merits of the case.\n<\/p>\n<p>                This is an appeal against the award dated 30.11.2009<br \/>\n          passed by the Motor Accident Claims Tribunal, Lakhnadon in<br \/>\n          MCC    No.89\/2009    whereby    the     tribunal    has   awarded    a<br \/>\n          compensation of Rs.21,500\/- to the appellant along with<br \/>\n          interest. The appeal has been preferred for enhancement.\n<\/p>\n<p>                The claim was filed on the ground that appellant<br \/>\n          sustained permanent disability because of fracture on right<br \/>\n          wrist. The appellant has not examined any doctor to prove the<br \/>\n          disability or its percentage. No disability has been found. On<br \/>\n          that basis the tribunal has held that the permanent disability of<br \/>\n          the appellant was not proved. In this connection, the reliance<br \/>\n          can be profitably had to the decision rendered by the Apex<br \/>\n          Court in Rajesh Kumar vs. Yaduvir and others, (2008) 7 SCC<br \/>\n          305 wherein it is held that the disability cannot be held proved<br \/>\n          and the disability certificate cannot be admissible in evidence<br \/>\n          unless the doctor who has treated the injured and given the<br \/>\n          disability certificate is examined before the Court and states as<br \/>\n          to on what basis the said opinion with regard to disability is<br \/>\n          tendered.\n<\/p>\n<p>                The appellant has filed Ex.P-10 and P-11 as the medical<br \/>\n          papers but on scrutiny of the same the tribunal has not found<br \/>\n                                                           M.A. No. 1834\/2010<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>     any correlation between them as the medicine prescribed by the<br \/>\n     doctor in Ex.P-11 which was the prescription of the doctor did<br \/>\n     not match with the medicine described on the medical bill<br \/>\n     Ex.P10 produced by the appellant.\n<\/p>\n<p>           The tribunal has found that the appellant sustained<br \/>\n     fracture on her right wrist for which the tribunal has awarded a<br \/>\n     sum of Rs.10,000\/- as compensation. Since there was fracture<br \/>\n     on the hand and the appellant could not have done her labour<br \/>\n     job for a month the tribunal has also awarded a sum of<br \/>\n     Rs.1,500\/- on that count. The tribunal has awarded a total sum<br \/>\n     of Rs.21,500\/-.\n<\/p>\n<p>           In view of the aforesaid, I do not find that the tribunal has<br \/>\n     committed any illegality in allowing the compensation for a sum<br \/>\n     of Rs.21,500\/-. The compensation so awarded is jut and proper.<br \/>\n     No case for enhancement of the award of compensation is<br \/>\n     made out.\n<\/p>\n<p>           In the application for condonation of delay it is only<br \/>\n     stated that the appellant could not arrange for money for filing<br \/>\n     of the appeal in time. No day to day delay has been explained.<br \/>\n     The reason for condonation of delay is also not sufficient.\n<\/p>\n<p>           Finding no merits in the appeal and no reason for<br \/>\n     condonation of delay, the I.A. No.4853\/2010 stands dismissed.<br \/>\n     Accordingly, the present appeal also stands dismissed.\n<\/p>\n<p>                                          (R.K.
