PATHAK AGP for\nRespondent \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/02\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1\tThe subject matter of<br \/>\nchallenge in the present petition is order of suspension, which was<br \/>\npassed against the petitioner on  3.7.2001, which is at Annexure-`G&#8217;<br \/>\nto the petition.\n<\/p>\n<p>2\t\tVide Order dated  6.9.2001,<br \/>\nthe impugned order of suspension, came to be  stayed pending the<br \/>\nhearing and final disposal of this petition.  While staying the<br \/>\noperation of the order of suspension, the Court clarified   that<br \/>\ngrant of interim relief, shall not come in the way of the department<br \/>\nproceeding against the petitioner, qua, departmental inquiry,<br \/>\nproposed to be initiated against the  petitioner and take further<br \/>\naction  in accordance with law.\n<\/p>\n<p>3\t\tThe order of suspension<br \/>\nremained stayed from its operation, implementation and execution all<br \/>\nthroughout until  the petitioner attained  superannuation. This means<br \/>\nthat the petitioner has rendered his services  all throughout and has<br \/>\nalso been paid regular salary.  In view of this, I deem it fit and<br \/>\nproper to dispose of the entire petition  in terms of the interim<br \/>\nrelief which was already granted at the time of  admission of this<br \/>\npetition.  Any other  order will have a far reaching consequence<br \/>\nbecause the petitioner has already retired  from service and  a<br \/>\nsituation  should not arise  wherein  some proceedings  of recovery<br \/>\nare initiated  against the petitioner.\n<\/p>\n<p>4\t\tUnder such circumstances,  I<br \/>\ndeem it fit and proper  to dispose of this entire petition in terms<br \/>\nof the interim relief which was granted earlier  and to the aforesaid<br \/>\nextent the rule is made absolute.\n<\/p>\n<p>(J.B.PARDIWALA, J.)<\/p>\n<p>pnnair  <\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Appearance : vs Ms V.S.
