PUBLIC PROSECUTOR for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 22\/07\/2010\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\n\tapplication is filed by the applicants under Section 439 of the<br \/>\n\tCriminal Procedure Code, 1973 for releasing him on regular bail in<br \/>\n\tconnection with the offences registered at I-CR No.44 of 2010<br \/>\n\tregistered with Amroli Police Station, for the offences punishable<br \/>\n\tunder Sections 454, 380 and 114 of the Indian Penal Code.\n<\/p>\n<p>\tHeard<br \/>\n\tMr.Dave, learned counsel for the applicant and Mr.U.A. Trivedi,<br \/>\n\tlearned Additional Public Prosecutor for the State.\n<\/p>\n<p>\tMr.Dave<br \/>\n\thas submitted that the applicant is innocent and is falsely involved<br \/>\n\tin this case. He read the order passed by the trial Court and prayed<br \/>\n\tto release the applicant on regular bail.\n<\/p>\n<p>\tAs<br \/>\n\tagainst this, Mr.Trivedi has strongly opposed the present<br \/>\n\tapplication and read the order passed by the trial Court.\n<\/p>\n<p>\tI<br \/>\n\thave gone through the order passed by the trial Court as well as<br \/>\n\tpapers produced on record of the case. Looking to the submissions<br \/>\n\tmade by the counsels and allegations levelled against the applicant,<br \/>\n\tI am inclined to release him on regular bail.\n<\/p>\n<p>\tLearned<br \/>\n\tcounsels for the parties do not press for reasoned order.\n<\/p>\n<p>\tConsidering<br \/>\n\tthe submissions made on behalf of the parties and having regard to<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand applicant is ordered to be released on bail in connection with<br \/>\n\tI-CR No.44 of 2010 registered with Amroli Police Station, for the<br \/>\n\toffences alleged against him in this application on his executing<br \/>\n\tbond of Rs.10,000\/-(Rupees Ten Thousand Only) with one solvent<br \/>\n\tsurety of the like amount to the satisfaction of the lower Court and<br \/>\n\tsubject to the conditions that he shall,<\/p>\n<p>(i)\tnot<br \/>\ntake undue advantage of his liberty \tor abuse his liberty;\n<\/p>\n<p>(ii)\tnot<br \/>\nact in a manner injurious to the\tthe prosecution;\n<\/p>\n<p>(iii)<br \/>\n not leave the local limits of State of   \tGujarat without the prior<br \/>\npermission\tof the concerned Sessions Judge;\n<\/p>\n<p>(iv)\tSurrender<br \/>\nhis passport, if any, to\tthe lower Court within a week;\n<\/p>\n<p>\tThe<br \/>\n\tAuthority will release the applicant only if he is not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbond to be executed before the lower Court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>\tAt<br \/>\n\tthe trial, the trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail. Rule is<br \/>\n\tmade absolute to the aforesaid extent.\n<\/p>\n<p>\tDirect<br \/>\n\tService is permitted.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
