original<br \/>\ndefendant posing the substantial questions of law as follow on the<br \/>\ngrounds set out in the memo of appeal:\n<\/p>\n<p>\t(1)\tWhether<br \/>\nthere is proper appreciation of \tevidence by the lower Court?\n<\/p>\n<p>\t(2)\tIt<br \/>\nis the duty of either party to aid the \tCourt in ascertaining the<br \/>\ntrue boundaries?\n<\/p>\n<p>\t(3)\tWhether<br \/>\nthe boundaries would prevail over \tthe revenue records and\/or survey<br \/>\nnumber?\n<\/p>\n<p>(4)\tWhether<br \/>\nthe possession of the property can be decided on the basis of the<br \/>\nboundaries or on the basis of Survey Number?\n<\/p>\n<p>(5)\tWhether<br \/>\nthe plaintiff is entitled to a decree of protection of possession in<br \/>\nabsence of showing the description and\/or mentioning of the<br \/>\nboundaries?\n<\/p>\n<p>(6)\tWhether<br \/>\nit is mandatory under Order VII Rule 3 of the Code of Civil Procedure<br \/>\nfor the plaintiff to narrate the boundaries in the plaint under the<br \/>\nrules of pleadings, and in absence of it, can the decree for<br \/>\nprotection of possession be passed?\n<\/p>\n<p>(7)\tWhether<br \/>\nthe Court below erred in passing the decree for protection of<br \/>\npossession of the plaintiff, when he himself has admitted the<br \/>\npossession of the defendant, which is shown in the Written Statement?\n<\/p>\n<p>(8)\tWhether<br \/>\nunder Section 34 of the Specific Relief Act, can the decree for<br \/>\nprotection of possession be passed when the plaintiff is not in<br \/>\npossession of the suit property?\n<\/p>\n<p>(9)\tWhether<br \/>\nthe title of the property is decided on the basis of the revenue<br \/>\nrecord, more particularly when the revenue record is not a document<br \/>\nof title?\n<\/p>\n<p>(10)\tWhether<br \/>\nthe decree for protection of possession is passed where the trail<br \/>\nCourt has not properly framed the issues?\n<\/p>\n<p>(11)\tWhether<br \/>\nthe judgment and decree passed by the trial Court is legal and<br \/>\nproper?\n<\/p>\n<p>2.\tThe<br \/>\nfacts of the case briefly stated are that the respondent &#8211;<br \/>\noriginal plaintiff filed a Civil Suit No. 175 of 1998 before the<br \/>\nCourt of Joint Civil Judge (J.D.), Nadiad, which came to be decreed<br \/>\nby holding that the land bearing survey No. 891\/4 belongs to the<br \/>\nplaintiff and he is the owner and in possession of the said land and<br \/>\ndefendant has no right title or interest in the said land. The said<br \/>\norder was challenged by way of Regular Civil Appeal No. 34 of 2004<br \/>\nwhich also came to be dismissed by  the Additional District Judge,<br \/>\nNadiad. Therefore, the present Second Appeal has been preferred.\n<\/p>\n<p>3.\tHeard<br \/>\nthe learned counsel Mr. Mrugen Purohit for the appellant and learned<br \/>\ncounsel Mr. Adeshra for the respondents. As it transpires from the<br \/>\nfacts and the contentions raised, the substantial questions of law,<br \/>\nwhich have been posed, cannot be said to be any questions of law much<br \/>\nless any substantial questions of law. It is not in dispute that the<br \/>\nappellant is the owner of land bearing survey No. 891\/2 and the<br \/>\nrespondents original plaintiffs are the owners of land bearing survey<br \/>\nNo.891\/4. From the evidence including the Panchnama made before the<br \/>\nCivil Court and the testimonies of both the plaintiffs and the<br \/>\ndefendant are not disputed on this aspect. However, the dispute which<br \/>\nhas been raised, as submitted by learned counsel Mr. Mrugen Purohit,<br \/>\nis with regard to identification of the land bearing survey No. 891\/2<br \/>\nand 891\/4. In view of the evidence brought on record which is also<br \/>\ndiscussed by the lower Appellate Court on the basis of the material<br \/>\nand evidence, this aspect about the boundary of the particular land<br \/>\ncannot be said to be a question of law much less any substantial<br \/>\nquestion of law. In the name of the boundaries or the identification<br \/>\nof the particular plot the issue cannot be re-agitated in the second<br \/>\nappeal when the facts are in narrow compass based on the factual<br \/>\nevidence. Therefore, as there is no substantial question of law which<br \/>\ncould be said to have been involved the concurrent findings given by<br \/>\nthe two courts below do not call for any interference.\n<\/p>\n<p>4.\tHaving<br \/>\nregard to the aforesaid facts and circumstances, the present second<br \/>\nappeal cannot be entertained in light of the settled legal position<br \/>\nthat scope of second appeal under Section 100 of Code of Civil<br \/>\nProcedure is very limited and unless any substantial question of law<br \/>\ninvolves, the Court need not entertain such second appeal as observed<br \/>\nby the Hon&#8217;ble Apex Court in the judgment reported in (2007) 1<br \/>\nSCC 546<br \/>\nin the case of <a href=\"\/doc\/1754551\/\">Gurdev Kaur &amp; Ors. v. Kaki &amp;<br \/>\nOrs. The<\/a><br \/>\nsame view has been reiterated in the judgment reported in (2008)<br \/>\n8 SCC 92 in<br \/>\nthe case of <a href=\"\/doc\/1539259\/\">State Bank of India &amp; Ors. v.<br \/>\nS.N. Goyal<br \/>\nand<\/a> also in the judgment reported in (2009) 5 SCC<br \/>\n264 in<br \/>\nthe case of <a href=\"\/doc\/1077888\/\">Narayanan Rajendran &amp; Anr. v.<br \/>\nLakshmy Sarojini &amp; Ors. Therefore,<\/a><br \/>\npresent second appeal deserves to be dismissed and accordingly stands<br \/>\ndismissed.
