Justice T.R.RAMACHANDRAN NAIR\n\n Dated :20\/09\/2010\n\n O R D E R\n               T.R.RAMACHANDRAN NAIR, J.\n                       ----------------------\n                 W.P.(C) No. 26299 OF 2010\n                     ---------------------------\n         Dated this the 20th day of September, 2010\n\n                       J U D G M E N T\n<\/pre>\n<p>                       ~~~~~~~~~~~<\/p>\n<p>     The petitioners herein, who are voters of Kattakada Grama<\/p>\n<p>Panchayat, are aggrieved by Exts.P2 and P3 communications<\/p>\n<p>issued by the 2nd respondent, who is the Secretary as well as<\/p>\n<p>Electoral Registration Officer.\n<\/p>\n<\/p>\n<p>     2.    In Exts.P2 and P3, the petitioners have been asked to<\/p>\n<p>show cause as to why action should not be taken against them<\/p>\n<p>under Section 27 of the Kerala Panchayat Raj Act, 1994.<\/p>\n<p>     3.    The dispute herein relates to the applications<\/p>\n<p>submitted under Form 8 by the petitioners objecting to the<\/p>\n<p>inclusion of certain names in the voters list, and for dieletion of<\/p>\n<p>them.\n<\/p>\n<\/p>\n<p>     4.    The 2nd respondent issued Exts.P2 and P3 stating that<\/p>\n<p>a notice proposing hearing on the matter was given on 1.8.2010,<\/p>\n<p>but, they did not appear or produce any records in support of<\/p>\n<p>the objections.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.26299\/2010               2<\/span><\/p>\n<p>      5.    On behalf of the 1st respondent a statement has been<\/p>\n<p>filed.     Heard     the learned      counsel appearing     for the<\/p>\n<p>2nd respondent also.        The learned standing counsel for the<\/p>\n<p>1st respondent submitted that actually on verifying the records it<\/p>\n<p>is seen that the 2nd respondent has not issued the notices<\/p>\n<p>referred to in Exts.P2 and P3. In paragraph 5 and 6 of the<\/p>\n<p>statement these details have been stated and those paragraphs<\/p>\n<p>of the statement filed by the 1st respondent are reproduced for<\/p>\n<p>easy reference.\n<\/p>\n<blockquote><p>             &#8220;5.   According to the 2nd respondent, on<br \/>\n             scrutiny of the applications it was found that<br \/>\n             most of the applications are incomplete and<br \/>\n             does not have the address of the objectors<br \/>\n             and the details of the entry objected<br \/>\n             including the address of the persons whose<br \/>\n             names are sought to be deleted.       The 2nd<br \/>\n             respondent also informed that the Forms<br \/>\n             have been filled in a very casual manner and<br \/>\n             that it does not even bear the date of the<br \/>\n             application. According to the 2nd respondent<br \/>\n             when an application for deletion of name of a<br \/>\n             voter from the electoral roll is submitted the<br \/>\n             same has to be made with responsibility and<br \/>\n             the person who seek the deletion of entry in<br \/>\n             electoral roll has to give a declaration that<br \/>\n             the facts mentioned therein are true and any<br \/>\n             person who makes a Statement or declaration<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.26299\/2010               3<\/span><\/p>\n<p>             which is false and which he either knows or<br \/>\n             believes to be false or does not believe to be<br \/>\n             true is punishable under Section 27 of the<br \/>\n             Kerala Panchayat Raj Act. According to the<br \/>\n             2nd respondent since the applications were<br \/>\n             vague no actions were taken on the claims<br \/>\n             received under Form No.8.\n<\/p><\/blockquote>\n<blockquote><p>             6.    The 2nd respondent has not taken any<br \/>\n             decision on the 1111 applications in Form No.8.<br \/>\n             The 2nd respondent has not issued the notice<br \/>\n             dated 01.08.2010 referred to in Exts.P2 and<br \/>\n             P3.&#8221;<\/p><\/blockquote>\n<p>     6.     The Commission maintains that Exts.P2 and P3 were<\/p>\n<p>not warranted on the facts and circumstances of the case.<\/p>\n<p>Learned counsel for the 2nd respondent also submitted that<\/p>\n<p>notices proposing the hearing on 1.8.2010 have not been issued<\/p>\n<p>as stated in Exts.P2 and P3.\n<\/p>\n<\/p>\n<p>     7.     The same will require fresh notice to be issued, for<\/p>\n<p>conducting due enquiry. Accordingly, Exts.P2 and P3 are<\/p>\n<p>quashed.     The learned standing counsel for the Commission<\/p>\n<p>submitted that before the last date for receipt of nomination,<\/p>\n<p>the entire exercise will be completed in accordance with the<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.26299\/2010             4<\/span><\/p>\n<p>provisions of the Act and Rules. Therefore, the action thereon<\/p>\n<p>will be finalised after issuing notice to the petitioners, and others<\/p>\n<p>if any.\n<\/p>\n<\/p>\n<p>     The Writ Petition is disposed of as above.
