JUDGMENT”;\n<\/p>\n
The appellant-Corporation is calling  question the <\/p>\n
dated 05.05.2006 passed in MVC N0-v;.:.2:647\/100%. ‘=Thell’act”relating T<\/p>\n
to the accident having occurred  and the injuries<\/p>\n
suffered by the claimant is not seridu-51;; <\/p>\n
2. The contention__.  the present appeal
\nby the appellant.;Cor:porafio\u00abnl”is\u00ab. the claimant herself was
\nnegligent as she  the center of the road and with<\/p>\n
regard to thebquanltulm. o1\u00b0dc’orn’peinsation awarded.<\/p>\n
  3_{p_’The__:lea_rned”Counsel for the appellant while assailing the<\/p>\n
awarddlw-ould’contend that the Tribunal has awarded exorbitant<\/p>\n
  Vvpcompensation.’lit lisalso contented that even on the question with<\/p>\n
 regard to  negligence, the Tribunal has erred in the matter.<\/p>\n
  regard “to the quantum of compensation, it is contented that<\/p>\n
 _pe3_*ce;j.tage of disability as reckoned by the Tribunal is on the<\/p>\n
h  ‘  iiilgher side and so also the miil\u00e9iplier reckoned. The compensation<\/p>\n
‘”0<\/p>\n
towards ‘pain and suffering’ as well as towards ‘loss of amenities
\nand enjoyment of life’ ought not have been granted in the manner<\/p>\n
in which it has been done.\n<\/p>\n
4. The learned Counsel for the respondent howey’er,V’soi.1gl1t it<\/p>\n
to justify the award. it is contended thatinsofar   <\/p>\n
the Tribunal has noticed the eviden.cfe’i~.tende’1’ed byiit.he’i..docVto’r ands’<\/p>\n
in fact the disability reckoned “by  ison vtheyliower side.
\nIt is contended that considerirrghthe the amount
\nawarded towards ‘pain’ and    of amenities’ is
\nalso contend that in fact
\nsome more   towards loss during
\ntreatment :V’periodi.VViVanfd”towards conveyance, food and<\/p>\n
nourishment.   all these aspects, the learned<\/p>\n
Counsel. \u00abwoui~d conitenidv that the award in any event does not call<\/p>\n
for interfere_nce.. , p ‘ ‘ ,.,.\n<\/p>\n
  of what has been contended and on perusal of<\/p>\n
award” passed by the Tribunal, it would indicate that the<\/p>\n
 Tribunallfhad framed issue No.1 with regard to the negligence.<\/p>\n
  considering this aspect, the Tribunal has referred to the<\/p>\n
l<\/p>\n
“-\n<\/p>\n
by the doctor namely, that she had suffered fracture of clavicle
\nright side, fracture of right humerus with radial nerve palsy,<\/p>\n
fracture of right ilium, fracture of right femur. The doctor hasalso<\/p>\n
referred in detail with regard to the manner of treatmentii<\/p>\n
to the claimant with respect to the said injuries. The\ufb02folliovvi <\/p>\n
the said treatment was also referred to indetail and  iregzardr<\/p>\n
the doctor has stated with regard to   <\/p>\n
would be faced by the claimant. As  keeping .all”vth”ese’asipectsi”<\/p>\n
in view, the doctor has stated theggi-plivsicalgg disability 90% in
\nrelation to the right upper lirnb and relation to right lower<\/p>\n
limb. In the cross~e:{{arnina:tion; itliei  stated that the<\/p>\n
manner of clivsabiilit\ufb01igas   based on the guidelines
\nprovided in ‘ALMICO’ th’e~._:Go.vernment of India guidelines for<\/p>\n
the purpose of asisesism,e.ntfof disability. Keeping in view the said<\/p>\n
e’vidcnce”itenderred A. by i5W2″”and in the background of the evidence<\/p>\n
tende_redii_c:laimant, the Tribunal has arrived at the<\/p>\n
i Vi”‘i….conclusi:,)”ni that the instant case, the disability could be<\/p>\n
recikoned at’Er0’:3’o.\n<\/p>\n
  ‘if’ iiiWhen the Tribunal has referred to the evidence on record<\/p>\n
i”  has thereafter arrived at such a \ufb01nding of fact, there is no<\/p>\n
l<\/p>\n
p<\/p>\n
room for this Court to interfere with regard to the said \ufb01nding.<\/p>\n
Thereafter, the Tribunal has considered the avocation.t:o\u00abf_i”the<\/p>\n
claimant and has come to the conclusion that the inc_oinei’l;+ei ~<\/p>\n
taken at Rs.60\/– per day and in this context has”‘cal’ci1late’dt the’<\/p>\n
compensation. Though it is contended on l’g’eh.alfi’of_i the <\/p>\n
that the multiplier reckoned by thewffgribulrl-all’ is neat’appropriatea”<\/p>\n
considering that the Tribunal had taken .note.’of.i_the age of the
\nClaimant and has thereafter the iaplpropriaite multiplier. even<\/p>\n
the said aspect of the matter doesriot call folr.inteV1’ference.<\/p>\n
8. With regard._’V   “towards ‘pain and
\nsuffering’, con_.siderin_g  the icilaimantvlwas fairly aged and had
\nsuffered injuries’\u00ab the amount awarded towards
\n‘pain and sufferiiigiis alsoll Considering the fact that
\nin” any evet1}1tl,lith~e arnountvitowards loss during treatment period has<\/p>\n
not._ awarded-.and the marginal higher grant could be<\/p>\n
 compensated li”towar’d.s”V..the head which has not been granted.<\/p>\n
VVit’l’herefore;””witl’i’regard to the said compensation awarded, the<\/p>\n
f.;1ppeJ,iam, cannot have any grievance.<\/p>\n

9. The only error which I notice is the amount which has
\nbeen awarded towards ‘loss of amenities, comfort,
\nenjoyment of life’. Though the Tribunal has adVerted__Atoi..this–‘
\nof the matter, considering the fact that ii”<\/p>\n
considered and a fair amount has been awar_de.d oi1.’thei”said:i’iheal:i;<\/p>\n
