Shukla\nRespondent Counsel :- C.S.C.,Pankaj Pandey\n\nHon'ble Shri Narayan Shukla,J.\n<\/pre>\n<p> Personal Affidavit filed by Mr. Santosh Kumar Gupta, Village<br \/>\nDevelopment Officer, Vikas Khand Tulsipur as well as reply of the<br \/>\nsame are taken on record.\n<\/p>\n<p> Through the affidavit Mr. Santosh Kumar Gupta has submitted<br \/>\nthat he went to the house of the petitioner continuously for three<br \/>\ndays but could not meet with him. He pasted the notice on the<br \/>\npetitioner&#8217;s door on 30.11.2009, in presence of two witnesses;<br \/>\nnamely; Mahesh Kumar Shukla and Ravindra Nath Shukla.<br \/>\n Disputing the same, the learned counsel for the petitioner<br \/>\nsubmits that through the reply of the same the petitioner has<br \/>\nbrought on record the cheque signed by him as well as by Mr.<br \/>\nSantosh Kumar Gupta on 30.11.2009, which establishes that on<br \/>\n30.11.2009 both on them met and signed the cheque as well as<br \/>\nnecessary documents, which indicates that the affidavit<br \/>\nsubmitted by Mr. Santosh Kumar Gupta is false.<br \/>\n The petitioner has challenged the order impugned dated<br \/>\n19.3.2010, whereby his administrative as well as financial power<br \/>\nhas been seized being in violation of principles of natural justice<br \/>\nas no notice was served to him prior to the order impugned.<br \/>\n Keeping in view the facts and circumstances of the case, the<br \/>\ncontention of the petitioner appears to be correct. Therefore,<br \/>\nbeing prima facie satisfied with the contention of the petitioner, I<br \/>\nhereby quash the order impugned dated 19th March, 2010<br \/>\n(Annexure No. 1 to the writ petition), whereby the petitioner&#8217;s<br \/>\nadministrative as well as financial power has been seized, with<br \/>\nliberty to the District Magistrate concerned to pass fresh order<br \/>\nafter providing proper opportunity of hearing to the petitioner.<br \/>\nThus without interfering in the proceeding initiated against the<br \/>\npetitioner the order impugned is hereby quashed.<br \/>\n In the aforesaid term, the writ petition is disposed of finally.\n<\/p>\n<p>Order Date :- 2.7.2010<br \/>\nGSY\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Ram Abhilash Shukla vs State Of U.P.Through Prin.
