This appeal coming on for A’drni\u00bbssion Court
\ndelivered the following: —\n<\/p>\n
 A  <\/p>\n
Heard the le.a1′.ned_cou_’slnel’\n<\/p>\n
2. H piheipappeiiaht ewesiictheppiainhff before the trial Court.
\nIt is the plaint_iff’s’c’a3e_that”theprcperty described in schedule “A”<\/p>\n
was his absolatel pvrolpertyl anildp-.the property described in schedule<\/p>\n
   of “schedpu”;e “A” property. Hence, sought for<\/p>\n
hreicoyeryp “<)4fi'ip_espse–ssion insofar as schedule "B" property was<\/p>\n
concerned. .  suit was contested whereby the defendant claimed<\/p>\n
 <.___'that schedule "B" property was gornal land and the defendant had<\/p>\n
 _ibee'n,_in.–' unauthorised occupation of the same since the year I992<\/p>\n
 on an application seeking regularisation of unauthorised<\/p>\n
A " occupation, an Hakku Patra had been granted by the competent<\/p>\n
2<\/span><\/p>\n
authority. Therefore, her possession and title to the said <\/p>\n
been regularised. The trial Court however, on the issues  =<\/p>\n
decreed the suit in favour of the plaintiff’.’Ai”T’i:e sa_me_, bieen\ufb02. it<\/p>\n
challenged in appeal by the respondent, the lower  <\/p>\n
has found that the appellant wasiiitlaimingp Vuade\ufb01axreygistered
\npartition deed executed on xhibipijmi\u00e9whereas
\nthe Hakkupatra under\u00bb \\whic.h…:t_lie  claiming was
\nissued on   found that the
\ndefendantv,,w.asv_Ainfpois:sessiori–ii,oi  property since the
\nyear l99\ufb01;._p   thus held that the burden<\/p>\n
was on the plaintiff  .establish that schedule “B” property formed<\/p>\n
‘Jlpart ofschedule “tit” property and that it was the family property<\/p>\n
 the”appe_llarit,,_which was available for partition under Exhibit<\/p>\n
  Pluarid u_nlesis*,.–the title to the land was proved, Exhibit P10 would<\/p>\n
not eonfett any title on the appellant since there was a serious<\/p>\n
  about the identity of the land and availability of the same<\/p>\n
i  for partition in favour of the appellant. The appellant had not<\/p>\n
produced documents to establish title to the said schedule <\/p>\n

3. The appellant ha:s__’fil’e.d.7an before this
\nCourt under Order    Civil Procedure,
\n1908 seeking tode–ed”:fdalt.ed.-5.5.1965 and copies of
\nR.T.C.    “B” property was indeed<\/p>\n
part of schedule  it belonged to the family of<\/p>\n
C   the learned counsel for the respondent would<\/p>\n
  subnjit4Vthat.’th:ere is no foundation laid to produce the said<\/p>\n
U”i\u00a7”.’A”–._doeuments__at this belated stage before. this Court and he would<\/p>\n
 e.f’urjther–.contend that even if such documents are accepted on face<\/p>\n
i  yaltie, without testing the veracity therein, it cannot be established<\/p>\n
3 that schedule “B” property is part of schedule “A” property, in the<\/p>\n
3<\/span><\/p>\n
face of which, the appeal would have to fail at the <\/p>\n
Therefore, the question of considering the applicatior-ri\ufb01lecii ~<\/p>\n
Order XLI Rule 27 of the Code of Civil’ii>reeiee1:ireQ.ijaos .Vwo_1ji,1di’, he<\/p>\n
not arise for consideration as the conditions prescribed\u00ab. <\/p>\n
Order XLI Rule 27 are not met  appe’lla_ntei’n  to
\nproduce the said documents\n<\/p>\n
5. In the z\u00abjh:Q’_v.e biiekgre;rriri;’\u00ab~es-..it the burden on the<\/p>\n
plaintiff~appeliiaiitijtoiesia.b:li’shj’.–tit’le_sehedule “B” property and
\nthe appe1:Vlaiitiha*=ii\u00bbngdoesomand in the absence of any<\/p>\n
material pleadings that “de”ed in respect of the property was<\/p>\n
V lost orgjwas misplaced  the pendency of the proceedings<\/p>\n
‘r.4_eitherl”‘bef2ore the trial Court or the lower appellate Court, the<\/p>\n
appellhlaiitiv’seeking’to produce the alleged sale deed pertaining to<\/p>\n
‘,schedule  property at this stage of the proceedings does not<\/p>\n
r~:arisei’for consideration. Even if this document is taken on record,<\/p>\n
  question of appellant finding a case for himself on the material<\/p>\n
 on record is dim and the reasoning of the lower appellate Court<\/p>\n
7:.\n<\/p>\n
cannot be fauited. Therefore, no substantial question of law arises  _i <\/p>\n
for consideration. The findings are \ufb01ndings of fact.<\/p>\n
6. Hence, the appeal is rejected.\n<\/p>\n
