Heard Mr. D.R.  Jayabhar, learned Counsel  for<br \/>\nthe petitioner and  Mr. N.B.  Khandare, learned A.G.P.  for<br \/>\nthe respondents.\n<\/p>\n<p> 2. Rule  made  returnable  forthwith  with   the<br \/>\nconsent of the parties.  Mr. N.B.  Khandare, learned A.G.P.<br \/>\nwaives service for respondents.\n<\/p>\n<p> 3. The  petitioner  has approached this Court to<br \/>\ndirect the respondent no. 2 to restore the lands Gat No. 133<br \/>\nand 136 at village Katpur, Tq.  Paithan, Dist.  Aurangabad<br \/>\nto the petitioner within three months for his cultivation.<br \/>\nThe petitioner was owner of the said lands.   These  lands<br \/>\nwere required  by the Govt.  for the purposes of Jayakwadi<br \/>\nproject and, therefore, the Collector, Aurangabad  carried<br \/>\nout  a  land  acquisition  proceeding  and  the lands were<br \/>\nacquired compulsorily under the said  provisions  and  the<br \/>\ncompensation  as  provided  under the Land Acquisition Act<br \/>\nwas also paid.  The acquisition proceedings were completed<br \/>\nin the year 1965.  However, these lands have not been used<br \/>\nfor the said project and the lands are being utilized  for<br \/>\nOpen Jail  located  at Jayakwadi project.  The petitioner,<br \/>\ntherefore, has approached this Court  for  return  of  the<br \/>\nsaid land in view of the Govt.  Resolution No. LQN 3473\/HI,<br \/>\ndated  10.10.1973,  issued  by  the  Revenue  and  Forests<br \/>\nDepartment.  In clause (B) of the said Govt.   Resolution,<br \/>\nit  is  provided that if, however, the acquired land found<br \/>\nsurplus and\/or unutilized, cannot be used for  any  public<br \/>\npurpose  within the period of three years from the date of<br \/>\ntaking over possession thereof immediately, the Department<br \/>\nconcerned should relinquish the land to the  Collector  of<br \/>\nthe district  concerned.    The  Collector of the district<br \/>\nconcerned should then take steps for restoration  of  such<br \/>\nlands  to  the  original  owner,  perpetual  lessee or the<br \/>\ntenant having security of tenure under the various tenancy<br \/>\nlaws in force, on payment of market value which should not<br \/>\nexceed double the amount of  compensation  that  is  paid,<br \/>\nsubject   to   the  ceiling  limit  prescribed  under  the<br \/>\nMaharashtra Agricultural Lands [Ceiling on Holdings]  Act,<br \/>\n1961.   We have noticed that this procedure is contrary to<br \/>\nthe provisions of law and more specifically the ratio laid<br \/>\ndown by the Apex Court in the  judgment    [<a href=\"\/doc\/943108\/\">State  of  Kerala  and  others  vs.  M.<br \/>\nBhaskaran Pillai and<\/a> another].  We have also noticed  that<br \/>\nthis  Govt. Resolution  is contrary to the Maharashtra Land<br \/>\nRevenue Code (Disposal of Govt.  Lands] Rules,  1971  and,<br \/>\ntherefore, the notice was issued to the Secretary, Revenue<br \/>\n&amp; Forests  Department  to  file  an  affidavit.  After the<br \/>\nissuance of the notice, now  the  Govt.    has  filed  the<br \/>\naffidavit accepting  that  the  said  Govt.  Resolution is<br \/>\ncontrary to the existing law and it will not be  enforced.<br \/>\nIt  is  further  reported  to  this Court that all actions<br \/>\nwhich are pending as on today in view of 1973  resolution,<br \/>\nreferred  to above, are being stayed and the lands will be<br \/>\ndisposed  of  in  accordance  with  the  Maharashtra  Land<br \/>\nRevenue [Disposal of Govt.  Lands] Rules, 1971.  The Govt.<br \/>\nis  further  saying that they want to modify the Circular.<br \/>\nWe  are  least  concerned   at   this   stage   with   the<br \/>\nmodification.   Whenever  such a notification is effected,<br \/>\nit will be considered whether it is proper or not  in  the<br \/>\nlight of  the  law existing then.  As we have noticed that<br \/>\nthe Govt.  has fairly conceded to the position of law  and<br \/>\nhas  assured  that  the  lands will not be restored on the<br \/>\nbasis of  1973  Govt. Resolution  above  referred,  we  are<br \/>\nsatisfied with the approach of the Govt.  We make it clear<br \/>\nagain  that after acquisition when the possession is taken<br \/>\nby the Govt.  the land absolutely vests in the  Government<br \/>\nand  all the rights of the person who was holding the said<br \/>\nland prior to the acquisition are  extinguished  and  said<br \/>\nperson  has  no right as against that property even though<br \/>\nthe Govt.  may not have used the  said  property  for  the<br \/>\nsaid public purpose.    The  Govt.    can utilize the said<br \/>\nproperty for any other public purpose and\/or if the  Govt.<br \/>\nfeels that  the Govt.  does not want to keep the said land<br \/>\nwith it, it can dispose of the said property as laid  down<br \/>\nunder  the  Maharashtra  Land  Revenue (Disposal of Lands)<br \/>\nRules, 1971.  Thus, we find that there is no substance  in<br \/>\nthe petition.  It is hereby rejected.
