Sanghi, Advocate, for<br \/>\n               the complainant.\n<\/p>\n<\/p>\n<pre>                             .      .      .\n\nAJAI LAMBA, J (Oral)\n\n<\/pre>\n<p>              Challenge in this petition is to Order<\/p>\n<p>dated 11.8.2008 whereby after consideration of facts<\/p>\n<p>and circumstances of the case, it has been observed<\/p>\n<p>by the Court below that Dinesh (a witness) cannot<\/p>\n<p>speak and is unable to write with his left hand,<\/p>\n<p>therefore, it would be in the interest of justice<\/p>\n<p>that Dinesh be examined with aid and assistance of<\/p>\n<p>an expert.\n<\/p>\n<p>              Reply has been filed. In Para 3 of the<\/p>\n<p>reply, the following has been stated:-<\/p>\n<blockquote><p>              &#8220;3. That para no.-3 of the petition is correct to the<br \/>\n              extent that reply was filed by the accused persons to the<br \/>\n              above said application, but it is wrong to allege by them<br \/>\n Crl. Misc. No. M-21845 of 2008                                            [2]<\/p>\n<p>                  that they had been implicated falsely. The<br \/>\n                  Neurosurgery Department, Pt. B.D. Sharma,<br \/>\n                  P.G.I.M.S., Rohtak vide its report in the letter No.<br \/>\n                  NS\/08\/244 dated 30.06.08 and its latest report dated<br \/>\n                  8.11.2008 has specifically opined that the Brock&#8217;s<br \/>\n                  Aphasia (not able to speak) is due to the head injury of<br \/>\n                  victim Dinesh. It is wrong to allege by the petitioner<br \/>\n                  that Dinesh had not received the said injury in the<br \/>\n                  present occurrence, although his statement was<br \/>\n                  recorded by the investigating officer during the course<br \/>\n                  of investigation, but as submitted above, the victim has<br \/>\n                  developed the disability for the present time and thus it<br \/>\n                  does not lie in the mouth of the petitioner to allege that<br \/>\n                  the prosecution has made the application on false<br \/>\n                  excuses to avoid searchy cross examination.&#8221;<\/p><\/blockquote>\n<p>                  Contention of learned counsel for the<\/p>\n<p>petitioner       that      statement         of    Dinesh         taken        under<\/p>\n<p>Section 161 Cr.P.C. is sufficient to indicate that<\/p>\n<p>Dinesh     can    communicate         without        aid     of    an    expert,<\/p>\n<p>cannot be accepted in view of the fact that he is<\/p>\n<p>now required to be examined on oath in Court and<\/p>\n<p>would also be required to be cross examined.<\/p>\n<p>                  Learned counsel for the petitioner has<\/p>\n<p>referred to document placed on record as Annexure<\/p>\n<p>P-1 to say that Dinesh can write.\n<\/p>\n<p>                  On perusal of the writing, it transpires<\/p>\n<p>that it is a writing in broken letters and does not<\/p>\n<p>indicate         the       comfort          of       the        witness          in<\/p>\n<p>communicating.
