1.\tRule.\n<\/p>\n
Shri R.C. Kodekar, learned Additional Public Prosecutor  waives
\nservice of Rule on behalf of respondent-State. By consent, Rule is
\nfixed forthwith.\n<\/p>\n
2.\tThe
\napplicants original accused, who have not been named as accused in
\nCR.-I-No.13 of 2010 registered with Umrala. Police Station for the
\noffences punishable under Sections 457,380,511,307 and 114 of Indian
\nPenal Code and Section 25(1)(c) of the Arms Act have moved this Court
\nunder Section 439 of the Code of Criminal Procedure for seeking bail
\npending investigation and trial.\n<\/p>\n
3.\tThe
\naccused moved the application being Criminal Misc. Application No.223
\nof 2010 before the concerned Sessions Court, which came to be
\nrejected on 18.5.2010.\n<\/p>\n
4.\tLooking
\nto averments made in the F.I.R and the allegations as well as the
\nlikelihood of punishment of conviction, this Court is persuaded to
\nexercise discretion in favour of the applicants-accused to enlarge
\nthem on bail for the following reasons:\n<\/p>\n
(i)\tPrima-facie,
\nno specific role attributable to present applicants emerge.\n<\/p>\n
(ii)\tLooking
\nto the averments and nature of evidence and role of the applicants,
\nthey deserve to be enlarged on bail pending trial.\n<\/p>\n
(iii)\tThe
\napplicants have their wherewithal at their ordinary place of
\nresidence and therefore, there is no likelihood of they fleeing from
\njustice and their presence could be procured at the time of trial.\n<\/p>\n
(iv)\tThe
\nprosecution has not voiced any grievance or expressed any
\napprehension that they are likely to flee from justice, if the
\napplicants are released on bail.\n<\/p>\n
(v)\tThe
\nprosecution has also not expressed any grievance or apprehension that
\nthey are capable of tempering with evidences or influencing the
\nwitnesses, if the applicants are released on bail.\n<\/p>\n
(vi)\tThe
\nSessions Court has not appreciated these aspects and therefore, the
\nsaid order deserves to be quashed and set aside and accordingly, it
\nis quashed and set aside.\n<\/p>\n
5.\tThe
\naforesaid observations are made only for the purpose of examining the
\nprayer for bail pending trial. These observations are prima-facie and
\nshall have no bearing whatsoever upon the trial and the trial Court
\nshall not be influenced by it in any way and come to its own
\nconclusion after analyzing the evidence that may be led during the
\ntrial.\n<\/p>\n
6.\tConsidering
\nthe submissions made on behalf of the parties and having regard to
\nthe circumstances and facts of the case, the application is allowed
\nand the applicants are ordered to be released on bail in connection
\nwith CR.-I-No.13 of 2010 registered with Umrala Police Station on
\ntheir executing a bond of Rs.5,000\/- (Rupees Five  Thousand only)
\neach  with one surety each of the like amount to the satisfaction of
\nthe lower Court and subject to the conditions that they shall:\n<\/p>\n
\t(a)\tnot
\n\ttake undue advantage of their liberty or abuse their liberty:\n<\/p>\n
\t(b)\tnot
\n\tact in a manner injurious to the interest of the prosecution:\n<\/p>\n
\t(c)\tmaintain
\n\tlaw and order;\n<\/p>\n
\t(d)\tmark
\n\ttheir presence before concerned Police Station on every 15th
\n\tday of  each English calendar month between 9.00 a.m. to 2.00 p.m.<\/p>\n
\t(e)\tnot
\n\tleave the State of Gujarat without the prior permission of the
\n\tSessions Court concerned;\n<\/p>\n
\t(f)\tfurnish
\n\tthe address of their residence at the time of execution of the bond
\n\tand shall not change the residence without prior permission of this
\n\tCourt;\n<\/p>\n
\t(g)\tsurrender
\n\tthe passport, if any, to the Lower Court within a week.\n<\/p>\n
7.\tIf
\nbreach of any of the above conditions is committed, the Sessions
\nJudge concerned will be free to issue warrant or to take appropriate
\naction in the matter.\n<\/p>\n
8.\tBail
\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n
9.\tRule
\nis made absolute. Direct Service is permitted.\n<\/p>\n
