{"id":3432,"date":"2000-12-12T00:00:00","date_gmt":"2000-12-11T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/pipal-singh-vs-state-of-punjab-on-12-december-2000"},"modified":"2018-10-11T08:56:00","modified_gmt":"2018-10-11T03:26:00","slug":"pipal-singh-vs-state-of-punjab-on-12-december-2000","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/pipal-singh-vs-state-of-punjab-on-12-december-2000","title":{"rendered":"Pipal Singh vs State Of Punjab on 12 December, 2000"},"content":{"rendered":"<div class=\"docsource_main\">Supreme Court of India<\/div>\n<div class=\"doc_title\">Pipal Singh vs State Of Punjab on 12 December, 2000<\/div>\n<div class=\"doc_author\">Author: R Babu<\/div>\n<div class=\"doc_bench\">Bench: S.R.Babu, D.P.Mohapatro<\/div>\n<pre>           CASE NO.:\nAppeal (crl.) 432 1999\n\n\nPETITIONER:\nPIPAL SINGH\n\n\tVs.\n\nRESPONDENT:\nSTATE OF PUNJAB\n\nDATE OF JUDGMENT:\t12\/12\/2000\n\nBENCH:\nS.R.Babu, D.P.Mohapatro\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>RAJENDRA BABU, J.:\n<\/p>\n<p>L&#8230;..I&#8230;&#8230;&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<\/p>\n<p>      Pipal  Singh, appellant in Criminal Appeal No.  432 of<br \/>\n1999  and  Mukhtiar Singh, appellant in Criminal Appeal\t No.<br \/>\n433  of\t 1999,\twere accused along with several\t others\t for<br \/>\nhaving\tcaused\tthe  death of Sardara Ram  and\tinjuries  to<br \/>\nSukhdev\t Raj  when they were entering their own\t land.\t The<br \/>\nlearned\t Sessions Judge sentenced the appellants along\twith<br \/>\ncertain\t others\t to undergo life imprisonment and to  pay  a<br \/>\nfine of Rs.  5000\/- each or in default of payment of fine to<br \/>\nfurther\t undergo  rigorous imprisonment for one\t year  under<br \/>\nSection\t 302  IPC  read with Section 34 IPC for\t murder\t and<br \/>\nfurther\t sentence  to undergo rigorous imprisonment for\t six<br \/>\nmonths\tfor  simple  hurt under Section 323  IPC  read\twith<br \/>\nSection\t 34 IPC and both the sentences to run  concurrently.<br \/>\nOn  appeal  the High Court reappraised the evidence  adduced<br \/>\nbefore\tthe trial court and came to the conclusion that\t the<br \/>\nappellants  had\t a common cause and had come  together\tduly<br \/>\narmed  at  a place which was in possession of  the  deceased<br \/>\nwith  the common intention to commit the crime and they left<br \/>\nthe  scene  of\tthe  occurrence\t also  together\t with  their<br \/>\nrespective  weapons.   The  High   Court  recorded  the\t two<br \/>\ninjuries  found on the dead body of the deceased, viz.,\t (i)<br \/>\nT-shaped incised wound 15 cms x 2 cms by 10 x 2 cms on right<br \/>\nparietal  region, underlying bone, scalp and brain were cut,<br \/>\nand  (ii) incised wound 5 x 1.5 cms, 5 cms behind injury No.<br \/>\n1  and\tthat injury No.\t (ii) was bone deep and\t the  doctor<br \/>\nopined\tthat  injuries Nos.  (i) and (ii) were fatal in\t the<br \/>\nordinary  course  of nature.  The evidence put forth  before<br \/>\nthe  court  was\t that  while Pipal Singh  caused  the  first<br \/>\ninjury,\t injury\t No.   2  was said to have  been  caused  by<br \/>\nMukhtiar Singh.\t That evidence had been believed by the High<br \/>\nCourt.\n<\/p>\n<p>      The  learned counsel for the appellants put forth\t two<br \/>\ncontentions,  namely,  (1) the effect of acquittal of  other<br \/>\naccused\t in the case on sentencing accused under Section 302<br \/>\nIPC  by\t involving  Section 34 IPC, and (2) as\tregards\t the<br \/>\noffence stated to have been committed by each of them.\n<\/p>\n<p>      Even  where some out of several accused are  acquitted<br \/>\nit  is\topen  to  the court to\tconsider  whether  remaining<br \/>\naccused\t were  guilty of an offence by involving Section  34<br \/>\nIPC  by\t reason of having committed the offence\t along\twith<br \/>\nothers\tacquitted.   With  a view to  determine\t the  common<br \/>\nintention,  the\t nature\t of   injuries,\t background  of\t the<br \/>\nincident and the nature of weapon used to cause the injuries<br \/>\nbesides other factors are needed to be considered.  There is<br \/>\nno principle in law which prevents from adopting that course<br \/>\nset  out  above by us.\tIn the circumstances arising in\t the<br \/>\ncase  the  High\t Court has done the  necessary\texercise  in<br \/>\nfinding out whether the accused needed to be convicted under<br \/>\nSection\t 302  IPC  read\t with Section 34 IPC.\tWe  find  no<br \/>\ninfirmity in the same.\n<\/p>\n<p>      So  far as the evidence alleged against the accused is<br \/>\nconcerned  and\tthe manner in which they have committed\t the<br \/>\nsame,  it is clear that Section 304 Part II would not  arise<br \/>\nas  rightly  held  by  the High Court.\tSo  neither  of\t the<br \/>\ncontentions raised by the learned counsel for the appellants<br \/>\ncan survive close scrutiny and stand rejected.\n<\/p>\n<p>      The appeals are dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Pipal Singh vs State Of Punjab on 12 December, 2000 Author: R Babu Bench: S.R.Babu, D.P.Mohapatro CASE NO.: Appeal (crl.) 432 1999 PETITIONER: PIPAL SINGH Vs.
