The petitioners are accused 1 to 6.<\/p>\n<p>Altogether there are ten accused persons. They face allegations inter<\/p>\n<p>alia under Sections 308 and 153A read with 149 I.P.C.                The<\/p>\n<p>petitioners were arrested on two different dates i.e. on 30\/8\/2007 and<\/p>\n<p>31\/8\/2007. They continue in custody from the said dates.<\/p>\n<p>      2.    The crux of the allegations is that the petitioners used to<\/p>\n<p>cause disturbance to the proper running of a temple in the locality.<\/p>\n<p>The petitioners do not belong to the Hindu community. Objections<\/p>\n<p>were raised and infuriated by such conduct on the part of the<\/p>\n<p>devotees of raising objections, the accused persons, who were<\/p>\n<p>members of an unlawful assembly, in prosecution of the common<\/p>\n<p>object of the unlawful assembly unleashed an attack on the temple<\/p>\n<p>and the persons who raised objections against the conduct of the<\/p>\n<p>accused.   The alleged incident took place on 28\/8\/2007.          In the<\/p>\n<p>incident, as many as nine persons had suffered injuries. Damage was<\/p>\n<p>suffered by the temple also.            The petitioners were arrested on<\/p>\n<p>30\/08\/2007 and 31\/8\/2007. They continue in custody from that date.<\/p>\n<p>      3.    The learned counsel for the petitioners prays, the learned<\/p>\n<p>Public Prosecutor does not oppose the said prayer on condition that<\/p>\n<p><span class=\"hidden_text\">B.A.No.5512\/07                       2<\/span><\/p>\n<p>the investigating officer     is granted reasonable further time to<\/p>\n<p>complete the investigation and appropriate safeguards may be<\/p>\n<p>insisted to ensure that the law and order situation in the locality is not<\/p>\n<p>jeopardised and I am satisfied that the petitioners can now be<\/p>\n<p>directed to be released on bail subject to appropriate conditions.<\/p>\n<p>      4.    In the result, this petition is allowed. The petitioners shall<\/p>\n<p>be released on bail on the following terms and conditions:<\/p>\n<p>      i)    The petitioners shall not be released on bail on the<\/p>\n<p>strength of this order prior to 26\/09\/2007.
