SANKARAN, J.\n                    ---------------------------\n                    B.A. No. 5458 of 2009\n               ------------------------------------\n          Dated this the 12th day of November, 2009\n\n\n                           O R D E R\n<\/pre>\n<p>    When the Bail Application came up for hearing on<\/p>\n<p>29.10.2009, the following order was passed:<\/p>\n<blockquote><p>              &#8220;This is an application for anticipatory bail<br \/>\n        under Section 438 of the Code of Criminal<br \/>\n        Procedure.    The petitioner is accused No.2 in<br \/>\n        Crime No.      417\/2009 of Taliparamba Police<br \/>\n        Station.\n<\/p><\/blockquote>\n<blockquote><p>              2.  The    offences   alleged    against the<br \/>\n        petitioner are under Section 292 of the Indian<br \/>\n        Penal Code and Section 7 (1) and 7-B of the<br \/>\n        Cinematograph Act.\n<\/p><\/blockquote>\n<blockquote><p>              3.    The date of occurrence was on<br \/>\n        12.07.2009. The petitioner is implicated in the<br \/>\n        case on the ground that he is the owner of the<br \/>\n        theatre in which the obscene film was exhibited.\n<\/p><\/blockquote>\n<blockquote><p>              4. The petitioner has produced along with<br \/>\n        Crl. M. A. No. 5979\/2009, a true copy of the<br \/>\n        agreement dated 24.03.2009 executed between<br \/>\n        him and one Unnikrishnan.         According to the<br \/>\n        petitioner,   the    theatre     was    leased  to<br \/>\n        Unnikrishnan for a period of 11 months from<br \/>\n        01.04.2009, as per the agreement.\n<\/p><\/blockquote>\n<blockquote><p>              5. After having heard the learned counsel<br \/>\n        for the petitioner and the learned Public<br \/>\n        Prosecutor, I am of the view that before<br \/>\n        disposing of the Bail Application, an opportunity<\/p>\n<p><span class=\"hidden_text\">B.A. No. 5458 of 2009             2<\/span><\/p>\n<p>          should be given to the petitioner to appear before<br \/>\n          the investigating officer. Accordingly, there will<br \/>\n          be a direction to the petitioner to appear before<br \/>\n          the investigating officer at 9 A.M. on 4th and 5th<br \/>\n          November, 2009.\n<\/p><\/blockquote>\n<blockquote><p>                 Post on 12.11.2009.\n<\/p><\/blockquote>\n<blockquote><p>                 It is submitted by the learned Public<br \/>\n          Prosecutor that the petitioner will not be arrested<br \/>\n          until further orders in connection with Crime No.<br \/>\n          417\/2009 of Taliparamba Police Station.\n<\/p><\/blockquote>\n<blockquote><p>                 Hand over copy of this order to both sides.&#8221;<\/p><\/blockquote>\n<p>      4.   The learned counsel for the petitioner and the learned<\/p>\n<p>Public Prosecutor submitted that the petitioner has complied with<\/p>\n<p>the directions contained in the order dated 29.10.2009.<\/p>\n<p>      5.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioner.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioner, the officer in charge of the police station shall release<\/p>\n<p>him on bail on his executing bond for Rs. 15,000\/- with two<\/p>\n<p>solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<p><span class=\"hidden_text\">B.A. No. 5458 of 2009              3<\/span><\/p>\n<blockquote><p>         A) The     petitioner   shall   appear     before    the<br \/>\n            investigating officer for interrogation as and when<br \/>\n            required;\n<\/p><\/blockquote>\n<blockquote><p>         B) The petitioner shall not try to influence the<br \/>\n            prosecution    witnesses    or   tamper    with   the<br \/>\n            evidence.\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioner shall not commit any offence or<br \/>\n            indulge in any prejudicial activity while on bail.\n<\/p><\/blockquote>\n<blockquote><p>         D) In case of breach of any of the conditions<br \/>\n            mentioned above, the bail shall be liable to be<br \/>\n            cancelled.<\/p><\/blockquote>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                   K.T.
