Justice K.HEMA\n\n Dated :07\/07\/2010\n\n O R D E R\n                                 K.HEMA, J\n                            -----------------------\n                        B.A No.3953 OF 2010\n                        --------------------------------\n                 Dated this the 7th day of July 2010\n\n                                   ORDER\n<\/pre>\n<p>         This petition is for anticipatory bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 323, 354, 506(i) of<\/p>\n<p>IPC and Section 3(i)(X) &amp;(XI) of SC\/ST (Prevention of Atrocities) Act.<\/p>\n<p>According to prosecution, on 08\/02\/2010, petitioner was cutting<\/p>\n<p>tree from a disputed property and de facto complainant questioned<\/p>\n<p>the same, when she was beaten up by petitioner. Her modesty was<\/p>\n<p>outraged by dragging her through the road by catching hold of her<\/p>\n<p>jacket. She was criminally intimidated. She was insulted in public<\/p>\n<p>by calling her caste name.\n<\/p>\n<p>      3. Learned counsel for petitioner submitted that the property<\/p>\n<p>in which the incident happened belonged to petitioner. There was<\/p>\n<p>a long-standing civil dispute between the parties in respect of<\/p>\n<p>possession of the property. A suit was filed for injunction against<\/p>\n<p>petitioner by de facto complainant&#8217;s husband, but, it was dismissed.<\/p>\n<p>An appeal was filed and it was also dismissed. Though a crime was<\/p>\n<p>registered including Section 447 of IPC, it was subsequently<\/p>\n<p>deleted.\n<\/p>\n<p>      4. Originally, only bailable offences under Sections 323 and<\/p>\n<p>447 of IPC were included.           But, now, offences are altered to<\/p>\n<p><span class=\"hidden_text\">B.A No.3953 OF 2010              2<\/span><\/p>\n<p>Sections 354, 506(i) of IPC and Sections     3(i)(x)&amp;(xi) of SC\/ST(PA)<\/p>\n<p>Act. The alteration was done pursuant to a petition given by de<\/p>\n<p>facto complainant&#8217;s husband to the M.L.A. In the report itself of the<\/p>\n<p>police, it is stated that such a petition was given to M.L.A and<\/p>\n<p>hence the Sections are altered.       Petitioner is innocent of the<\/p>\n<p>allegations made. He has not acted in the manner alleged now, it<\/p>\n<p>is submitted.\n<\/p>\n<p>      4. Learned Public Prosecutor conceded that offence under<\/p>\n<p>Section 447 of IPC was subsequently deleted.          Offence under<\/p>\n<p>Section 354 of IPC was included subsequently. In FIS, there was no<\/p>\n<p>case for the de facto complainant that she was dragged through<\/p>\n<p>the road by catching hold of her jacket etc. It is also pointed out<\/p>\n<p>that the allegation which constitute offence under Sections 3(i)(x)&amp;<\/p>\n<p>(xi) of SC\/ST(PA) Act are also absent in FIS.<\/p>\n<p>      5. On hearing both sides, considering the circumstance under<\/p>\n<p>which offence under the SC\/ST(PA) Act is introduced and also the<\/p>\n<p>circumstances under which allegations regarding outraging of<\/p>\n<p>modesty are brought in,      I am satisfied that petitioner can be<\/p>\n<p>granted anticipatory bail     on conditions since petitioner has a<\/p>\n<p>strong and arguable case regarding involvement of offence under<\/p>\n<p>the SC\/ST(PA) Act. Hence, the following order is passed.<\/p>\n<p><span class=\"hidden_text\">B.A No.3953 OF 2010                 3<\/span><\/p>\n<p>        (1) Petitioner shall, in the event of arrest be released<\/p>\n<p>              on bail, on his executing a bond for Rs.10,000\/-<\/p>\n<p>              (Rupees ten thousand only) with two solvent<\/p>\n<p>              sureties each for the like sum to the satisfaction of<\/p>\n<p>              the arresting officer on the following conditions:<\/p>\n<blockquote><p>                      (i) Petitioner shall report before the<br \/>\n                          Investigating Officer as and when<br \/>\n                          directed     and     co-operate     with<br \/>\n                          investigation.\n<\/p><\/blockquote>\n<blockquote><p>                     (ii) Petitioner shall not enter the limits of<br \/>\n                          the police     station  within    which<br \/>\n                          the    crime is registered, except for<br \/>\n                          compliance of condition no.1.\n<\/p><\/blockquote>\n<blockquote><p>                     (iii) Petitioner shall   not influence or<br \/>\n                          intimidate any witness       or tamper<br \/>\n                          with evidence.\n<\/p><\/blockquote>\n<blockquote><p>                     (iv) In case,    petitioner is   involved in<br \/>\n                           any similar offence, bail is liable  to<br \/>\n                           be cancelled.\n<\/p><\/blockquote>\n<p>        (2) This order will be in force only for a period of 15<\/p>\n<p>              days from today.
