PATTANAIK (J)\n\nCITATION:\n JT 1996 (7)   706\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t    WITH<br \/>\n      SPECIAL LEAVE PETITION (CIVIL) NO.14887 OF 1996<br \/>\n\t\t\t(CC-3212\/96)<br \/>\n\t\t\t O R D E R<br \/>\n     Delay condoned.\n<\/p>\n<p>     The two  petitioners in  these cases  were recruited as<br \/>\nlegal assistants  after having\tput in\tmore  than  8  years<br \/>\npractice at the Bar. One was recruited on April 24, 1963 and<br \/>\nthe other  on July  3, 1964.  After  putting  in  qualifying<br \/>\nservice of  25 years,  they retired from service on June 13,<br \/>\n1989 and  March 31, 1992 respectively. They relied upon Rule<br \/>\n2423-A of  the Railway\tEstablishment  Mannual\tII  claiming<br \/>\naddition of  5 years  qualifying service  for computation of<br \/>\ntheir pension.\tThe Tribunal  in the  impugned orders  dated<br \/>\n6.12.1995 allowed  the applications and computation thereof.<br \/>\nThe same are assailed in their applications.\n<\/p>\n<p>     Rule 2423-A reads thus:\n<\/p>\n<p>     &#8220;2423-A (C..S.R.404-B):- An Officer<br \/>\n     appointed to  a service  or post on<br \/>\n     or after Ist April, 1968 may add to<br \/>\n     his    service    qualifying    for<br \/>\n     superannuation pension (but not for<br \/>\n     any other\tclass  of  pension)  the<br \/>\n     actual period  not\t exceeding  one-<br \/>\n     fourth the length of his service or<br \/>\n     the actual\t period by which his age<br \/>\n     at the  time of recruitment exceeds<br \/>\n     twentyfive years  or  a  period  of<br \/>\n     five years, whichever is the least,<br \/>\n     if the service or post is one:-<\/p>\n<pre>\n     (a)   for\t  which\t   post-graduate\n     research\t    or\t      specialist\n<\/pre>\n<p>     qualification,  or\t  experience  in<br \/>\n     scientific\t    technological     or<br \/>\n     professional fields,  is  essential<br \/>\n     and\n<\/p>\n<p>     (b) to  which  candidates\tof  more<br \/>\n     than twenty  five years  of age are<br \/>\n     normally recruited.\n<\/p>\n<p>\t  Provided that\t this concession<br \/>\n     shall not be admissible to any such<br \/>\n     officer\tunless\t   his\t  actual<br \/>\n     qualifying service\t at the\t time he<br \/>\n     quits  Government\tService\t is  not<br \/>\n     less than ten years.\n<\/p>\n<p>\t  Provided further that any such<br \/>\n     officer who is recruited at the age<br \/>\n     of thirtyfive  years or  more  may,<br \/>\n     within a  period  of  three  months<br \/>\n     from the  date of\this appointment,<br \/>\n     elect  to\t forego\t his  rights  to<br \/>\n     pension where  under  he  shall  be<br \/>\n     eligible to  subscribe to the State<br \/>\n     Railway   Provident   Fund\t  as   a<br \/>\n     nonpensionable employee.&#8221;\n<\/p>\n<p>The amended rule reads thus:\n<\/p>\n<blockquote><p>     &#8220;The above\t Rule was amended as can<br \/>\n     be seen from the Railway Ministry&#8217;s<br \/>\n     letter No.F(E)III\/76  PNI 12  dated<br \/>\n     15-11-76,\twhereby\t  an  additional<br \/>\n     proviso was  added to  the rule  as<br \/>\n     Under:-\n<\/p><\/blockquote>\n<blockquote><p>\t  Provided  further   that  this<br \/>\n     concession shall be admissible only<br \/>\n     if the recruitment rules in respect<br \/>\n     of the  said service\/post contain a<br \/>\n     specific provision that the service<br \/>\n     or post  is one  which carries  the<br \/>\n     benefit of this rule.\n<\/p><\/blockquote>\n<blockquote><p>     (2)  A   railway  servant\t who  is<br \/>\n     recruited at the age of thirty-five<br \/>\n     years or  more, may within a period<br \/>\n     of three  months from  the date  of<br \/>\n     his appointment, elect to forgo his<br \/>\n     right  to\t pension,  whereupon  he<br \/>\n     shall be  eligible to  subscribe to<br \/>\n     the State Railway Provident Fund as<br \/>\n     a nonpensionable employee.<br \/>\n     (3) The  option referred to in sub-<br \/>\n     rule (2)  once exercised,\tshall be<br \/>\n     final.&#8221;<\/p><\/blockquote>\n<p>     Relying upon  this proviso\t by later  amendment, it  is<br \/>\ncontended that\tsince no  specific provision was made in the<br \/>\nconditions of  service\tat  the\t time  of  appointment.\t the<br \/>\nrespondents are\t not entitled to the benefit of the rule, It<br \/>\nis not\tin dispute  that the  rule came\t to  be\t amended  in<br \/>\nNovember 15,  1976 long after their appointment, Under these<br \/>\ncircumstances, the amendment would be prospective. It is not<br \/>\nin dispute that this amendment came to be made pursuant to<br \/>\nrecommendation\tmade  by  the  III  Pay\t Commission  and  on<br \/>\nacceptance thereof  the rule came to be amended. Under these<br \/>\ncircumstances,\tthe   amendment\t cannot\t have  retrospective<br \/>\neffect in respect of the persons already in service would be<br \/>\nprospective; it would be applicable only to those candidates<br \/>\nappointed after\t the date  of the  amendment introducing the<br \/>\nproviso.\n<\/p>\n<p>     The special leave petitions are accordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India The Secretary (Estt)Railway &#8230; vs Shri D.
