He now<br \/>\nstands convicted under Section 304A of Indian Penal Code and<br \/>\nwas  sentenced\tto imprisonment for three months.   All\t the<br \/>\nthree  courts,\tthe trial court, the Sessions Court and\t the<br \/>\nHigh  Court  in revision &#8211; took the same stand.\t Hence\tthis<br \/>\nappeal.\t  The finding of facts cannot be disturbed now.\t The<br \/>\nonly question which survives for decision is whether on such<br \/>\nfacts a conclusion that the appellant is guilty of negligent<br \/>\ndriving must necessarily follow.  The facts which the courts<br \/>\nfound to have been established in the case are these:\n<\/p>\n<p>      On  17.12.1993 the appellant was driving a bus of\t the<br \/>\nAndhra\tPradesh Road Transport Corporation.  A passenger  by<br \/>\nname Agamma boarded the bus enroute at some point.  When the<br \/>\nbus  moved forward she fell out of the vehicle and its\trear<br \/>\nwheel  ran over her.  She died of the injuries sustained  in<br \/>\nthat accident.\n<\/p>\n<p>      The  conductor of the bus was examined as PW3.  He did<br \/>\nnot  say  how the accident happened.  However,\the  admitted<br \/>\nthat  while  the  bus  was in motion he\t heard\ta  sound  of<br \/>\naccident and the bus was then stopped.\tThe only witness who<br \/>\nspoke  about the occurrence was PW4.  What that witness\t has<br \/>\ndeposed in the examination-in-chief is the following:\n<\/p>\n<p>      &#8220;Agamma  was  boarding the bus and the bus was  moved;<br \/>\nand she fell down beneath the bus and died on the spot;\t the<br \/>\nbus  stopped at some distance.\tI saw the driver of the\t bus<br \/>\nat that time.\n<\/p>\n<p>      What is the culpable negligence on the part of the bus<br \/>\ndriver\tin the above accident?\tA passenger might fall\tdown<br \/>\nfrom  a\t moving vehicle due to one of the following  causes:<br \/>\nIt  could be accidental;  it could be due to the  negligence<br \/>\nof  the passenger himself;  it could be due to the negligent<br \/>\ntaking off of the bus by the driver.  However, to fasten the<br \/>\nliability  with\t the driver for negligent driving in such  a<br \/>\nsituation there should be the evidence that he moved the bus<br \/>\nsuddenly  before the passenger could get into the vehicle or<br \/>\nthat  the  driver moved the vehicle even before getting\t any<br \/>\nsignal from the rear side.\n<\/p>\n<p>      A\t driver who moves the bus forward can be expected to<br \/>\nkeep  his  eyes\t ahead and possibly on the  sides  also.   A<br \/>\ndriver\tcan take the reverse motion when that driver assures<br \/>\nhimself that the vehicle can safely be taken backward.\n<\/p>\n<p>      It  is a wrong proposition that for any motor accident<br \/>\nnegligence of the driver should be presumed.  An accident of<br \/>\nsuch  a\t nature as would prima facie show that it cannot  be<br \/>\naccounted  to  anything\t other than the\t negligence  of\t the<br \/>\ndriver of the vehicle may create a presumption and in such a<br \/>\ncase  the  driver has to explain how the  accident  happened<br \/>\nwithout\t negligence on his part.  Merely because a passenger<br \/>\nfell down from the bus while boarding the bus no presumption<br \/>\nof negligence can be drawn against the driver of the bus.\n<\/p>\n<p>      The  principle of res ipsa loquitor is only a rule  of<br \/>\nevidence  to determine the onus of proof in actions relating<br \/>\nto negligence.\tThe said principle has application only when<br \/>\nthe  nature of the accident and the attending  circumstances<br \/>\nwould  reasonably lead to the belief that in the absence  of<br \/>\nnegligence the accident would not have occurred and that the<br \/>\nthing  which  caused injury is shown to have been under\t the<br \/>\nmanagement and control of the alleged wrong doer.\n<\/p>\n<p>      A\t rash  act  is primarily an over hasty act.   It  is<br \/>\nopposed\t to  a\tdeliberate act.\t Still a rash act can  be  a<br \/>\ndeliberate  act\t in the sense that it was done\twithout\t due<br \/>\ncare  and  caution.  Culpable rashness lies in\trunning\t the<br \/>\nrisk of doing an act with recklessness and with indifference<br \/>\nas  to the consequences.  Criminal negligence is the failure<br \/>\nto  exercise  duty  with  reasonable  and  proper  care\t and<br \/>\nprecaution  guarding against injury to the public  generally<br \/>\nor  to\tany individual in particular.  It is the  imperative<br \/>\nduty of the driver of a vehicle to adopt such reasonable and<br \/>\nproper care and precaution.\n<\/p>\n<p>      In  the  present case the possible explanation of\t the<br \/>\ndriver is that he was unaware of even the possibility of the<br \/>\naccident which happened.  It could be so.  When he moved the<br \/>\nvehicle\t forward his focus normally would have been  towards<br \/>\nwhat  was ahead of the vehicle.\t He is not expected to\tmove<br \/>\nthe  vehicle  forward when passengers are in the process  of<br \/>\nboarding  the  vehicle.\t But when he gets a signal from\t the<br \/>\nconductor  that the bus can proceed he is expected to  start<br \/>\nmoving the vehicle.  Here no witness has said, including the<br \/>\nconductor,  that the driver moved the vehicle before getting<br \/>\nsignal\tto  move forward.  The evidence in this case is\t too<br \/>\nscanty to fasten him with criminal negligence.\tSome further<br \/>\nevidence  is  indispensably  needed  to\t presume  that\t the<br \/>\npassenger  fell down due to the negligence of the driver  of<br \/>\nthe  bus.   Such further evidence is lacking in\t this  case.<br \/>\nTherefore,  the\t court is disabled from concluding that\t the<br \/>\nvictim\tfell  down only because of the negligent driving  of<br \/>\nthe  bus.   The corollary thereof is that the conviction  of<br \/>\nthe  appellant\tof  the offence is  unsustainable.
