DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/07\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP, waives service of notice of Rule for respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>This<br \/>\n\tapplication is filed by the applicant under Section 438 of the Code<br \/>\n\tof Criminal Procedure, 1973 in connection with CR No.I-50\/2011<br \/>\n\tregistered with Radhanpur Police Station for the offences punishable<br \/>\n\tunder Sections 363, 366 &amp; 114 of the Indian Penal Code.\n<\/p>\n<p>Having<br \/>\n\theard learned advocate for the applicant and learned APP for the<br \/>\n\trespondent &#8211; State of Gujarat, it appears that the learned 2nd<br \/>\n\tAdditional Sessions Judge, Patan, has rejected the bail application<br \/>\n\tof the applicant by applying wring criteria for exercising<br \/>\n\tjurisdiction under section 438 of the Code.  Now, it is held by the<br \/>\n\tApex Court in the case of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v.<br \/>\n\tState of Maharashtra &amp; Ors. Reported<\/a> in [2011]1 SCC 694,<br \/>\n\twherein the Apex Court reiterated the law laid down by the<br \/>\n\tConstitutional Bench in the case of Shri Gurubaksh Singh<br \/>\n\tSibbia &amp; Ors. Reported in [1980]2 SCC 565,<br \/>\n\tand<br \/>\n\theld that section 438 of the Code is not extraordinary in the sence<br \/>\n\tthat it should be invoked only<br \/>\n\tin exceptional or rare cases and a great ignominy, humiliation and<br \/>\n\tdisgrace is attached to arrest.\n<\/p>\n<p>In<br \/>\n\tview of the above, order dated 10.06.2011 passed by the 2nd<br \/>\n\tAdditional Sessions Judge, Patan in Criminal, Misc. Application<br \/>\n\tNo.220 of 2011 is hereby quashed and set aside and the learned Judge<br \/>\n\tis directed to decide the said application afresh within a period of<br \/>\n\t10 days from today taking into consideration the law laid down by<br \/>\n\tthe Apex Court in the case of  Siddharam<br \/>\n\tSatlingappa Mhetre [supra].\n<\/p>\n<p>\tAccordingly,<br \/>\n\tthis application stands disposed of.
