SANKARAN, J.\n                    ---------------------------\n                     B.A. No. 5287 of 2009\n                 ------------------------------------\n             Dated this the 15th day of October, 2009\n\n                            O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under Section 438<\/p>\n<p>of the Code of Criminal Procedure.        The petitioner is accused<\/p>\n<p>No.3 in Crime No.370\/2009 of Mala Police Station.<\/p>\n<p>     2.    The offences alleged against the petitioner are under<\/p>\n<p>Sections 341 and 379 of the Indian Penal Code.<\/p>\n<p>     3.    The prosecution case is that the petitioner and others<\/p>\n<p>committed theft of motor spare parts from a workshop.<\/p>\n<p>     4.    When the Bail Application came up for hearing on<\/p>\n<p>30\/9\/2009, the following order was passed:<\/p>\n<blockquote><p>           &#8220;After having heard the learned counsel for the<\/p>\n<p>     petitioner and the learned Public Prosecutor, I am of<\/p>\n<p>     the view that before disposing of the Bail Application,<\/p>\n<p>     an opportunity should be given to the petitioner to<\/p>\n<p>     appear before the investigating officer. Accordingly,<\/p>\n<p>     there will be a direction to the petitioner to appear<\/p>\n<p>     before the investigating officer at 9 A.M. on 8th and 9th<\/p>\n<p>     October, 2009.\n<\/p><\/blockquote>\n<p>B.A. No. 5287\/2009<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>            Post on 15\/10\/2009.\n<\/p>\n<p>            It is submitted by the learned Public Prosecutor<\/p>\n<p>      that the petitioner will not be arrested until further<\/p>\n<p>      orders in connection with Crime No.370\/2009 of Mala<\/p>\n<p>      Police Station.&#8221;\n<\/p>\n<p>      5.     The learned counsel for the petitioner as well as the<\/p>\n<p>learned Public Prosecutor submitted that the petitioner has<\/p>\n<p>complied with the directions contained in the order dated<\/p>\n<p>30\/9\/2009.\n<\/p>\n<p>      6.     Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioner.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioner, the officer in charge of the police station shall release<\/p>\n<p>him on bail on his executing bond for Rs.15,000\/- with two<\/p>\n<p>solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>         A) The petitioner shall         report  before     the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on all alternate Mondays, till the final report is<br \/>\n             filed or until further orders;\n<\/p><\/blockquote>\n<p>B.A. No. 5287\/2009<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>         B) The     petitioner  shall    appear    before     the<br \/>\n             investigating officer for interrogation as and<br \/>\n             when required;\n<\/p>\n<p>         C) The petitioner shall not try to influence the<br \/>\n             prosecution   witnesses or tamper with the<br \/>\n             evidence.\n<\/p>\n<p>         D) The petitioner shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail.<\/p>\n<p>         E) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.\n<\/p>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                    K.T.
